Approving the Plan for Equipping Military Weapons for Forest Protection Forces

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development

Pursuant to Decree No. 39/CP dated May 15, 1994 of the Government on the organizational system and tasks and powers of forest rangers

Pursuant to Decree No. 47/CP dated August 12, 1996 of the Government on management of weapons, explosives, and auxiliary tools

Considering the Report No. 01/KL-QLBVR dated January 4, 1999 of the Director of the Forest Protection Department proposing approval of the Plan for Equipping Military Weapons for Forest Protection Forces

Pursuant to …;

Article 1. Approves the Plan for Equipping Military Weapons for Forest Protection Forces of provinces and centrally governed cities and national parks.

The Forest Protection Department shall organize the distribution to units with the quantity and types of military weapons and ammunition stocks according to the approved plan attached to this Decision.

Article 2. Chiefs of Provincial Forest Protection Branches, Directors of National Parks shall be responsible for organizing safe and full reception of the allocated weapons, coordinating with provincial public security agencies to implement registration procedures, issue permits for weapon usage, develop plans for managing and using weapons; coordinating with local military authorities to organize annual training on maintenance, storage, and use of military weapons for forest protection forces under their management; ensuring that the management and use of weapons for forest management and protection activities comply with the Regulations on Management of Weapons, Explosives, and Auxiliary Tools issued together with Decree No. 47/CP dated August 12, 1996 of the Government and Circular No. 05/TT-BNV(C13) dated September 28, 1996 of the Ministry of Home Affairs (now the Ministry of Public Security) guiding the implementation of certain issues in Decree No. 47/CP dated August 12, 1996 of the Government on management of weapons, explosives, and auxiliary tools.

Article 3. The Director of the Forest Protection Department shall be responsible for organizing and directing: monitoring and summarizing the quantity, quality, and usage situation of weapons across the entire force; developing annual repair and replenishment plans for weapons for the force; conducting initial training for units on weapon management, storage, and use; implementing inspection and supervision systems for weapon and auxiliary tool management and use by units within the entire forest protection force.

Article 4. Heads of the Office of the Ministry, Director of the Forest Protection Department, Heads of the Financial and Accounting Department, Chiefs of Provincial Forest Protection Branches, and Directors of National Parks shall be responsible for implementing this Decision.

Implementing the Prime Minister's opinion in Official Letter No. 1072/CP-KTN dated September 8, 1998 regarding equipping weapons for forest protection forces

Pursuant to the Regulations on Management of Weapons, Explosives, and Auxiliary Tools issued together with Decree No. 47/CP dated August 12, 1996 of the Government

Based on the approved quantity of weapons and the organizational structure, staffing, and tasks of each unit

The Forest Protection Department has developed and submitted to the Minister of Agriculture and Rural Development for approval the Plan for Equipping Military Weapons for Forest Protection Forces as follows:

2. Individuals who have registered as the principal investigator of a Research Project or Pilot Production Project and those participating in its implementation shall not participate in the Evaluation and Selection Council for that Research Project or Pilot Production Project (hereinafter referred to as the Council). In necessary cases, members of the Council may be staff members of the organization registering as the principal investigator of the Research Project or Pilot Production Project, but not more than one person and they cannot serve as Chairperson, Vice-Chairperson, or reviewing member.

- The allocation, management, storage, and use of military weapons must be carried out in accordance with the Regulations on Management of Weapons, Explosives, and Auxiliary Tools issued together with Decree No. 47/CP dated August 12, 1996 of the Government;

- Weapons are primarily equipped for forest protection forces at the grassroots level based on the organizational structure, staffing, and requirements of forest management and protection tasks of each unit;

- Military weapons can only be used for official duties and may only be assigned to individuals with appropriate responsibilities and qualifications as stipulated.

II. OBJECTS ELIGIBLE FOR EQUIPMENT AND USE OF MILITARY WEAPONS

1. Individuals eligible to use Type K59 pistols:

- Chiefs and Deputy Chiefs of Provincial Forest Protection Branches;

- Heads and Deputy Heads of Departments within Provincial Forest Protection Branches;

- Chiefs and Deputy Chiefs of Forest Protection Stations, Forest Product Inspection Stations;

- Chiefs and Deputy Chiefs of Mobile Forest Protection Teams;

- Chiefs of Forest Protection Stations and Forest Product Inspection Stations directly subordinate to Provincial Forest Protection Branches.

2. AK rifles are provided to the following units:

- Forest Protection Stations, Forest Product Inspection Stations;

- Mobile Forest Protection Teams;

- Forest Protection Stations, Forest Product Inspection Stations.

III. DISTRIBUTION, RECEIPT, AND MANAGEMENT AND USE OF MILITARY WEAPONS

The Forest Protection Department is responsible for organizing the distribution of weapons according to the approved plan; monitoring and summarizing the quantity and quality of weapons; organizing initial training for units on weapon management, storage, and use; developing annual repair and replenishment plans for weapons for the force; implementing inspection and supervision systems for weapon and auxiliary tool management and use throughout the forest protection force.

Provincial Forest Protection Branches and National Parks are the direct recipients of military weapons provided by the State for forest protection forces; heads of these agencies shall be responsible for the management and use of weapons within their jurisdiction; units and individuals allocated weapons for work purposes shall be responsible under the law and to their superiors for the management, storage, and use of weapons in accordance with the Regulations on Management of Weapons, Explosives, and Auxiliary Tools issued pursuant to Decree No. 47/CP dated August 12, 1996 of the Government and Circular No. 05/TT-BNV(C13) dated September 28, 1996 of the Ministry of Home Affairs (now the Ministry of Public Security), guiding the implementation of certain issues in Decree No. 47/CP of the Government on management of weapons, explosives, and auxiliary tools.
