CIRCULAR

Regarding the use of telephone machines in people's courts

and local civil enforcement agencies

Implementing the regulations on the use of telephones stipulated in Circular No. 98/TT-BTC dated July 14, 1998 of the Ministry of Finance and the Ministry of Justice regarding the use of telephone machines in people's courts and local civil enforcement agencies as follows:

I. INSTALLATION OF TELEPHONE MACHINES

1. Fixed-line telephones:

a) People's Courts at provincial and centrally-administered city levels shall be installed with 02 (two) long-distance calling fixed-line telephones for shared use by the agency.

b) People's Courts at district level shall be installed with 01 (one) long-distance calling fixed-line telephone for shared use within the agency.

c) Civil Enforcement Departments and Civil Enforcement Teams at district level shall be installed with 01 (one) long-distance calling fixed-line telephone for shared use within the agency.

The remaining telephone machines in courts and local enforcement agencies shall be used for intra-city calls.

2. Installation of message machines:

Civil Enforcement Departments shall be equipped with 01 (one) message machine for use in mobile work.

3. Installation and use of mobile telephones:

According to the regulations of the Ministry of Finance, agencies and units shall not be equipped with mobile telephones.

In special cases where units already have mobile telephones, they shall be handled according to the following principles:

- For People's Courts at provincial and centrally-administered city levels that have purchased mobile telephones, the Chief Judge may use the machine and the agency shall pay a monthly fixed-line rental fee of 200,000 VND for call charges. In addition to this amount, the user must pay out-of-pocket for other expenses.

- Civil Enforcement Departments and People's Courts at district level shall not use mobile telephones. If these units have already purchased mobile telephones, they must sell them back and terminate monthly rental payments. When selling back mobile telephones, priority should first be given to the current users, or staff members within the agency. If there are no takers within the agency, they can be sold to other interested parties.

II. MANAGEMENT AND USE REGULATIONS

1. Unit heads must strictly manage the use of communication equipment in their units in accordance with the regulations of the Ministry of Finance and the directives of the Minister of Justice. Staff members are not allowed to use the agency's long-distance calling telephones for personal matters. Anyone using public telephones for personal purposes must pay the postal service.

2When using inter-provincial calling telephones or calling mobile phones, a logbook must be maintained for each transaction, recording the date and time of the call, the number dialed, and the nature of the transaction.

The unit head or the authorized person (if the head is absent) is responsible for approving each transaction.

At the end of each month, the finance department of the agency is responsible for checking and reconciling with the postal service's billing statement to exclude transactions not approved by the unit head and requesting the user to pay the postal service charges for those transactions.

3. The Chief Judge of People's Courts at provincial and centrally-administered city levels shall be provided with a private telephone and the agency shall pay the monthly rental fees according to Circular No. 71-TC/HCSN dated September 30, 1995 of the Ministry of Finance (the agency only pays for the rental and call charges outside of the family's payment).

III. IMPLEMENTATION PROVISIONS

1. Telecommunication and telegraph charges are recorded under Item 111: "Communication and Information Transmission" in the current State Budget Classification.

The budget allocation for annual telecommunication and telegraph charges shall be included in the annual budget estimate of the unit; at the end of the year, if there is any surplus, the unit shall submit a written request to the Ministry to transfer it to another item for expenditure.

2. This Circular takes effect fifteen days from the date of issuance.

Heads of units are responsible for informing and ensuring that staff members comply with the provisions of this Circular.

During implementation, if any issues arise, units are advised to report to the Ministry (Planning and Finance Department) for guidance on implementation.
