Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Considering the proposal of the Editor-in-Chief of the Science Activities Journal and the Director of the Personnel Department;

DECISION:

Article 1. This Decision promulgates the Charter on Organization and Operation of the Science Activities Journal under the Ministry of Science and Technology.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Decision No. 457/QĐ dated December 21, 1976 of the State Committee for Science and Technology (now the Ministry of Science and Technology) promulgating the Charter on Organization and Operation of the Science Activities Journal.

Article 3. The Heads of the Office, the Director of the Personnel Department, the Editor-in-Chief of the Science Activities Journal, and the Heads of related units shall be responsible for implementing this Decision.

CHARTER

Organization and Operation of the Science Activities Journal

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1The Science Activities Journal (hereinafter referred to as the Journal) is a state-owned enterprise with revenue that fulfills the function of public opinion and theoretical discourse for the Ministry of Science and Technology.

The English name of the Journal is Science Activities Review.

The Journal has legal personality, its own seal, and is entitled to open accounts at the National Treasury and banks to operate and conduct transactions in accordance with the law.

The main office of the Journal is located in Hanoi and it has a representative office in Ho Chi Minh City.

Article 2The Journal is responsible for assisting the Minister of Science and Technology in organizing the editing and publishing of the Journal with content covering issues related to policies, strategies, and mechanisms for the development of science and technology by the Party and the State; about systems, policies, and management mechanisms for scientific and technological activities; about the situation of scientific and technological activities both domestically and internationally to build a modern and advanced scientific and technological foundation, effectively serving the industrialization and modernization cause, and contributing effectively to the country's economic and social development.

Article 3The main service targets of the Journal include:

Leaders at all levels and sectors of the Party and the State;

Economic managers; educational and training managers; managers and researchers in the field of science and technology;

Managers and workers in the field of production and business in all economic sectors.

Article 4The Journal has the following tasks and powers:

1. Study and propose to the Minister of Science and Technology directions, policies, and plans for the development of the Journal in each period in line with the country's socio-economic development and science and technology situation.

2. Implement the objectives and purposes determined in the Press Operating Permit. Specifically:

a) Propaganda and dissemination of the Party's and the State's policies and laws on building and developing science and technology in the country's construction and development cause;

b) Exchange and disseminate experiences in managing and organizing scientific and technological activities among ministries, sectors, localities, research and application agencies, and production and business establishments nationwide;

c) Reflect prominent situations of scientific and technological activities of ministries, sectors, localities, research and application agencies, and production and business establishments in all economic sectors nationwide;

d) Introduce outstanding achievements in science and technology worldwide;

e) Serve as a forum for managers, scientists, and technologists discussing issues related to the development of science and technology in the country.

3. Ensure the publication of the Journal in line with the Party's and the State's policies, with high quality in terms of science and technology.

4. Organize the network of contributors well.

5. Cooperate with press and publishing agencies, organizations, and scientists both domestically and internationally to develop the Journal based on its objectives and purposes and in accordance with the law.

6. Publish supplementary publications (special issues, supplements, special editions); organize service activities in relevant fields according to the Press Law; perform other tasks assigned by the Minister.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 5The organizational structure of the Journal includes:

Editorial Board.

Secretariat and Readership Board.

Management and Resources Board.

Southern Representative Office.

The Journal operates under a directorate system headed by the Editor-in-Chief and assisted by several Deputy Editors-in-Chief.

The Editor-in-Chief is responsible to the Minister for the entire organization and operation of the Journal; is responsible to the Party and the State for the content of the Journal.

The Editor-in-Chief is responsible for defining the tasks, organization, and operation of specialized boards within the Journal.

The Deputy Editors-in-Chief assist the Editor-in-Chief in leading the Journal's general work, are responsible to the Editor-in-Chief for the tasks assigned, and have the authority to make decisions within their delegated scope. In the absence of the Editor-in-Chief, a Deputy Editor-in-Chief may represent the Editor-in-Chief to manage and resolve the Journal's affairs.

Article 6The Journal has an Editorial Council. The organization, operation, and members of the Editorial Council are decided by the Editor-in-Chief.

1. Staff within the annual quota allocated by the Ministry.

2. Staff working under labor contracts: Based on job requirements and the financial capacity of the Journal, the Editor-in-Chief signs labor contracts with employees according to the Labor Code (without the need for agreement from the Personnel Department).

For indefinite-term labor contracts, a report must be submitted to the Personnel Department for monitoring.

3. Staff working as contributors.

Article 8The Journal implements labor management systems and pays salaries, wages, and other incomes, and implements social insurance for state employees and contractual workers from the Journal's budget according to current State regulations and those of the Ministry of Science and Technology.

Chapter III

WORK RELATIONSHIPS

Article 9. The Editor-in-Chief manages all activities of the Journal based on the Charter of Organization and Operation of the Journal and the working regulations of the Ministry.

Article 10The Journal is responsible for closely coordinating with units within the Ministry to effectively fulfill its assigned functions of public opinion and theoretical discussion. Specifically as follows:

The Ministry and its units provide all favorable conditions for the Journal to utilize relevant materials to serve its political tasks.

During the process of formulating annual publication directions and contents, the Journal receives timely notifications from subordinate units of the Ministry regarding State policies on science and technology development, results of outstanding scientific and technological activities within their jurisdiction.

For meetings discussing science and technology work at the Ministry level and within units, the Editorial Board is invited to attend to understand the situation, and prepare publication content promptly and in line with actual needs.

Chapter IV

FINANCIAL MANAGEMENT

Article 11Financial Affairs

1. Sources of income:

a) From the State budget allocation;

b) From magazine distribution activities, printing related publications, and other activities consistent with the Journal's objectives;

c) Other sources of income as prescribed (if any): Aid projects, gifts, loans...

2. Expenditures:

a) Expenditure for regular tasks and other assigned tasks;

b) Expenditure for distribution activities, printing publications, and other services as prescribed by law;

c) Labor hire costs;

d) Other expenditures as prescribed.

Article 12. The Editor-in-Chief is responsible for managing and using the Journal's financial resources efficiently; fulfilling State obligations, establishing development funds and welfare funds, and implementing accounting systems according to current State regulations.

Chapter V

IMPLEMENTING PROVISIONS

Article 13. The Journal Editor-in-Chief collaborates with the Director of the Personnel Department to implement this Charter.

Article 14. Any additions or amendments to this Charter shall be proposed by the Journal Editor-in-Chief in collaboration with the Director of the Personnel Department to the Minister of Science and Technology for consideration and decision./.
