DECISION OF THE MINISTER OF SCIENCE AND TECHNOLOGY

Regarding the issuance of model inspection records

and decisions to be used in inspection activities

and administrative penalty enforcement

in the field of state management

THE MINISTER OF SCIENCE AND TECHNOLOGY

- Pursuant to the Inspection Law on June 24, 2004;

- Pursuant to the Complaints and Petitions Law on December 11, 1998 and the Law Amending and Supplementing Certain Provisions of the Complaints and Petitions Law on June 24, 2004;

- Pursuant to the Ordinance on Handling Administrative Violations on July 2, 2002;

- Pursuant to Decree No. 134/2003/NĐ-CP dated November 14, 2003 of the Government detailing the implementation of certain provisions of the Ordinance on Handling Administrative Violations in 2002;

- Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing Decree No. 54/2003/NĐ-CP dated May 19, 2003;

- At the proposal of the Inspector General of the Ministry and the Director of the Ministry's Office,

DECISION:

Article 1. This Decision annexes 31 models of inspection records and decisions to be used in inspection and administrative penalty enforcement activities in the field of state management over science and technology.

- Models No. 1 to No. 31 shall apply to the inspection and administrative penalty enforcement activities of the Ministry of Science and Technology and its subordinate units.

- Models No. 2 to No. 31 (excluding Model No. 27) shall apply to specialized science and technology inspection activities.

Article 2. Inspection organizations at all levels with the function of administrative inspection and specialized inspection in fields under the state management of the Ministry of Science and Technology are responsible for uniformly applying these model documents in their inspection and supervision activities.

Article 3. This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 1410/2000/QĐ-BKHCNMT dated August 7, 2000 of the Minister of Science, Technology, and Environment regarding the issuance of model documents on inspection and administrative penalty enforcement in the field of state management over science, technology, and environment.

Article 4. The Inspector General of the Ministry, the Director of the Ministry's Office, and the Heads of related units are responsible for implementing this Decision./.
