Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,

Pursuant to …;:

Article 1. Attached to this Decision is the "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders".

Article 2. As of November 15, 2008, helmets for motorcyclists and motorcycle riders produced domestically or imported shall only be allowed to circulate in the market after being certified and announced as compliant with the National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders issued together with this Decision and the provisions of the law on standards and technical regulations, except in cases provided for in Clause 2 of Article 3 of this Decision.

Article 3

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. Helmets for motorcyclists and motorcycle riders that were circulating in the market before November 15, 2008 and meet the requirements set forth in Clause 4 of this Article shall continue to be circulated.

3. From the date this Decision takes effect until November 14, 2008, the production and importation of helmets for motorcyclists and motorcycle riders shall continue to be carried out according to the Decisions specified in Clause 4 of this Article or according to the National Technical Regulation attached to this Decision. In the case of compliance with the National Technical Regulation attached to this Decision, certification and announcement of conformity for domestically produced helmets for motorcyclists and motorcycle riders, and certification of conformity for imported helmets for motorcyclists and motorcycle riders must be completed when organizations or individuals commence production or importation.

In the case where domestically produced or imported helmets for motorcyclists and motorcycle riders have been certified, evaluated, and announced as conforming to the National Technical Regulation attached to this Decision before November 15, 2008, they may immediately be circulated in the market.

As of November 15, 2008, the following Decisions shall cease to be effective:

a) Decision No. 51/2001/QD-BKHCNMT dated October 18, 2001 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) regarding the mandatory announcement of compliance with Vietnamese standards for domestically produced helmets for motorcycle riders;

b) Decision No. 52/2001/QD-BKHCNMT dated October 18, 2001 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) regarding the management of quality of imported helmets for motorcycle riders;

c) Decision No. 29/2004/QD-BKHCN dated October 27, 2004 of the Minister of Science and Technology regarding the management of quality of helmets for children participating in traffic on motorcycles and motorcycles;

Article 4. The Director of the General Department of Standardization, Metrology and Quality, relevant agencies, organizations, and individuals shall be responsible for implementing this Decision./.
