Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 13/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under People's Committees of provinces and centrally governed cities;
Pursuant to Circular No. 12/2008/TTLT-BGTVT-BNV dated December 5, 2008 of the Ministry of Transport and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of transport-related specialized agencies under provincial and district People's Committees;
Pursuant to Decision No. 82/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs promulgating the standards for Directors of Departments and equivalent positions under People's Committees of provinces and centrally governed cities;
At the proposal of the Director of the Cadre and Civil Servant Department,

Article 1. Position and responsibilities of the Director of the Department of Transport
The Director of the Department of Transport under the People's Committee of a province or centrally governed city (hereinafter referred to collectively as the People's Committee at the provincial level) is a leading civil servant heading the Department of Transport, responsible for leading, directing, managing, and operating the activities of the Department of Transport, advising the Chairman of the People's Committee at the provincial level to perform state management functions over transport within the province in accordance with the law.
Article 2. Tasks of the Director of the Department of Transport
1. The Director of the Department of Transport is responsible before the People's Committee, the Chairman of the People's Committee at the provincial level, and simultaneously before the Minister of Transport and the law in performing state management functions over transport within the province.
2. Organizing the implementation of the tasks and powers of the Department of Transport assigned or delegated by the People's Committee, the Chairman of the People's Committee at the provincial level, and in accordance with the law.
3. Organizing mid-term and final reviews to assess the results of the Department of Transport's activities according to its assigned functions and tasks; implementing information synthesis, statistics, reporting, and archiving work related to transport within the province in accordance with the law.
4. Managing the administrative apparatus, cadres, civil servants, public officials, and employees of the Department of Transport; managing and using financial resources and assets effectively in accordance with the law.
5. Performing other tasks assigned by the People's Committee, the Chairman of the People's Committee at the provincial level, and the Minister of Transport.
Article 3. Standards for the Director of the Department of Transport
1. Quality and ethics
Patriotic, politically steadfast, firmly committed to the Party's reform policies, national independence, and socialism, devotedly serving the people. Working with high responsibility, efficiency, thrift, honesty, impartiality, dedication, integrity, sincerity, and straightforwardness. Having a spirit of self-criticism and criticism. Being united, democratic, sincere with colleagues and coworkers, trusted by the collective. Closely connected with the people, trusted by the local residents. Having a sense of discipline, setting an example by complying with laws and regulations of the State and internal rules and regulations of the agency. Not engaging in corruption and resolutely fighting against corruption and waste.
2. Competence
a) Possessing the ability to advise, organize, and implement the policies of the Party and the State regarding the transport sector.
b) Possessing the ability to research and draft regulatory legal documents, propose management solutions and methods concerning transport, serving the state management activities of the provincial People's Committee.
c) Possessing leadership skills, having the ability to unite, consolidate, and organize cadres, civil servants, and public officials within the department to fulfill assigned tasks and coordinate with relevant levels and agencies to implement these tasks.
3. Knowledge
a) Mastering the policies, guidelines, and policies of the Party and the State regarding the transport sector.
b) Mastering legal regulatory documents on transport and local regulations.
c) Having in-depth knowledge of transport operations; having experience in organizing, managing, and leading.
d) Understanding the political, economic, and social situation of the locality, the country, and regions and countries around the world.
4. Qualifications
a) Graduated from a university in transport or a related field.
b) Meeting the professional standards of a senior specialist grade or higher.
c) Graduated from advanced political theory studies.
d) Graduated from administrative state management studies at the senior specialist grade or higher.
đ) Proficient in a commonly used foreign language at level C. For provinces with a large number of ethnic minority populations, it is encouraged to learn and use ethnic minority languages to serve work.
e) Proficient in using computers and office equipment for work purposes.
5. Other conditions
a) Having worked in the transport sector for five years or more, including at least three years in management roles within the transport sector.
b) The initial appointment age should not exceed 55 years old for males and 50 years old for females.
c) Having good health to ensure work performance.
Article 4. Effective date
This Circular takes effect forty-five days from the date of signature and replaces Decision No. 2771/TCCB-LĐ dated May 16, 1995 of the Minister of Transport stipulating the professional standards for Directors of Provincial Departments of Transport or Provincial Departments of Public Works and Transport.
Article 5. Responsibilities for Implementation
1. Chairmen of People's Committees of provinces and centrally governed cities, Heads of the Office of the Ministry, Heads of the Ministry's Inspectorate, Heads of Departments, Bureaus, agencies, organizations, and individuals concerned are responsible for implementing this Circular.
2. In the course of implementation, if there are issues arising or difficulties encountered, provinces and centrally governed cities shall promptly report to the Ministry of Transport for consideration and resolution within their authority./.
