Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Considering the proposal of the Minister of Agriculture and Rural Development,
DECISION:
Article 1. Position and Functions
1. The Forestry General Department is an agency under the Ministry of Agriculture and Rural Development, performing the function of advising and assisting the Minister of Agriculture and Rural Development in state management and enforcement of state management over forestry nationwide; managing and directing public service activities within the scope of management of the General Department.
2. The Forestry General Department has legal personality, a seal with the State Emblem, a separate account, operational funds provided by the state budget, and its headquarters is located in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Agriculture and Rural Development for issuance within his/her authority or for submission by the Minister of Agriculture and Rural Development to the competent state agency:
a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government, draft decisions of the Prime Minister on forestry;
b) Strategies, plans, long-term, five-year, annual plans, programs, projects, proposals, and important national works on forestry;
c) National technical standards, professional procedures, technical regulations, and economic-technical norms in the forestry sector.
2. Submit to the Minister of Agriculture and Rural Development national standards for review and publication by the competent authority.
3. Organize the dissemination, popularization, and education on forestry laws.
4. Implement regulatory legal documents, strategies, plans, programs, projects, and proposals on forestry after approval or issuance.
5. Issue professional guidance documents, internal regulatory documents, and individual documents within the scope of management of the Forestry General Department; review and publish industry-based standards.
6. Regarding forest management:
a) Submit to the Minister of Agriculture and Rural Development for submission to the competent authority for issuance of forest management regulations;
b) Submit to the Minister of Agriculture and Rural Development criteria for determining and classifying forests, functional zones of special-use forests; publish planning, protection, and development plans for forests, statistics on forests, and annual and five-year forest trends according to the law;
c) Direct the investigation and determination of boundaries of various types of forests; guide the content, forms, methods of forest statistics, inventory, monitoring of forest changes, forest resources, land for planting forests, and establishment of forest management files;
d) Review forest protection and development planning and investment programs for concentrated raw material areas of localities as prescribed;
đ) Guide and direct the implementation of forest allocation, forest leasing, forest recovery, change of forest land use purposes, shifting cultivation planning, and sustainable forest certification activities;
7. Regarding forest protection:
a) Direct, guide, and inspect forest protection, prevent illegal logging and destruction of forests, and handle violations of laws in forest management and protection and forestry products management;
b) Direct, guide, and inspect forest fire prevention and firefighting; organize early warning and forecasting of forest fire risks; detect early signs of forest fires. Submit to the Minister of Agriculture and Rural Development for organizing specialized firefighting forces;
c) Advise the Minister of Agriculture and Rural Development to mobilize inspection forces and equipment from relevant agencies and request mobilization of forces and equipment from other ministries, sectors, and localities promptly to stop serious deforestation incidents and firefighting when necessary according to the law;
d) Direct the professional and vocational affairs of inspection forces and forest protection forces uniformly; direct and organize the provision of weapons, tools, and equipment for inspection forces and forest protection forces;
đ) Coordinate with plant protection agencies to organize disease forecasts, guide, and inspect pest control activities in forests;
8. Regarding natural forest conservation:
a) Develop for the Minister of Agriculture and Rural Development to submit to the competent authority for regulations on the organization and management of special-use forests, management systems, protection, and lists of endangered, precious, and rare flora and fauna species;
b) Guide and direct the construction of a national system of special-use forests; directly manage assigned national parks;
c) Guide natural conservation and environmental education linked to communities in nature reserves. Direct and guide investment in infrastructure construction and research, management, and protection activities for special-use forests;
d) Organize surveys and assessments of endemic animals, plants, and microorganisms as prescribed by law;
đ) Submit to the Minister of Agriculture and Rural Development regulations on hunting wild animals, publish the List of species under the Convention on International Trade in Endangered Species of Wild Fauna and Flora. Organize the implementation of Convention regulations;
e) Guide, inspect, and direct handling of violations in captive breeding, artificial propagation of wild animals and plants, and forest environmental protection according to the law.
9. On forest development:
a) Submit to the Minister of Agriculture and Rural Development criteria for the status of various types of forests, criteria for planted forests and encircled-nourished forests, measures for forest development; guide agricultural and aquaculture production combined with forestry production;
b) Direct the construction and monitor the implementation of programs, projects, and policies for forest development linked to poverty reduction, environmental protection, and improving people's lives in forested areas.
c) Direct and guide the implementation of scattered tree planting and the cultivation and development of non-timber forest products.
10. Regarding forest tree seedlings:
a) Direct and guide the planning and development of forest tree seedling nurseries and seedling forests;
b) Submit to the Minister of Agriculture and Rural Development for approval the regulations on seed management, the list of forest tree species, seed sources, and forest tree seedling nurseries; organize and direct activities related to the inspection and testing of forest tree seed quality; issue, revoke various types of permits and certificates regarding forest tree seeds according to regulations.
11. Regarding forest utilization:
a) Submit to the Minister of Agriculture and Rural Development for approval the regulations on wood harvesting and forest products; the limit on natural forest wood harvesting;
b) Direct and review plans for sustainable forest management and forest zoning; guide the review of comprehensive design exploitation files for natural forest wood;
c) Submit to the Minister of Agriculture and Rural Development for approval the processing plan for wood and forest product manufacturing linked with raw material region planning and forest development organization; the regulations on the use of forest environmental services;
d) Direct, inspect, and guide the exploitation and use of forests.
12. Organize and direct basic investigation work, statistics, and data management according to regulations.
13. Organize the implementation of scientific research, the application of scientific and technological progress in forestry and forest promotion work according to the classification of the Minister of Agriculture and Rural Development.
14. Implement international cooperation in forestry according to the classification of the Minister of Agriculture and Rural Development and in accordance with the law.
15. Implement administrative reform in the forestry sector according to the Ministry of Agriculture and Rural Development's administrative reform plan.
16. Manage organizational structure and staffing; implement salary systems and incentive policies, commendation, rewards, disciplinary measures; provide professional training for civil servants and employees under the General Department; practice thrift, prevent waste; combat corruption within the General Department; participate in professional training for civil servants and employees under its management according to the law and the classification of the Minister of Agriculture and Rural Development.
17. Guide and inspect the activities of associations and non-governmental organizations in the forestry sector according to the classification of the Minister of Agriculture and Rural Development and the law.
18. Inspect, audit, resolve complaints and accusations, and handle violations in the forestry sector.
19. Manage construction investment according to the classification of the Minister of Agriculture and Rural Development and the law.
20. Manage finances and assets according to regulations. Manage the Forest Protection and Development Fund and international financial resources supporting the forestry sector.
21. Manage and perform the tasks of the Permanent Office of the New Forest Planting Project Management Board; the Central Steering Committee Office for Urgent Issues in Forest Protection and Fire Prevention and Control; the Authority Managing CITES; Vietnam's Representative at the Global Tiger Forum; the ASEAN Agreement on Transboundary Haze Pollution; the Coordination Office for Sector Support Partnerships; the Permanent Office of the Convention to Combat Desertification; the Point of Contact for the Community Forestry Development Protocol in Asia-Pacific.
22. Perform other tasks assigned by the Minister of Agriculture and Rural Development or as stipulated by law.
Article 3. Organizational Structure
1. Planning and Finance Department;
2. Science, Technology, and International Cooperation Department;
3. Forest Development Department;
4. Forest Utilization Department;
5. Natural Conservation Department;
6. Forest Inspection Service;
7. General Department Office (with representation in Ho Chi Minh City);
8. General Department Inspectorate;
9. CITES Management Authority of Vietnam;
10. Forest Investigation and Planning Institute;
11. Tam Dao National Park;
12. Ba Vi National Park;
13. Cuc Phuong National Park;
14. Bach Ma National Park;
15. Cat Tien National Park;
16. YokDon National Park.
In this Article, organizations from Clause 1 to Clause 9 assist the Director General in performing state management functions; organizations from Clause 10 to Clause 16 are subordinate public service units of the General Department.
Article 4. Leadership of the General Department
1. The Forestry General Department has a Director-General and not more than three Deputy Director-Generals.
2. The Director General of the Forests General Department shall concurrently hold the position of Deputy Minister of Agriculture and Rural Development, and shall be responsible to the Minister of Agriculture and Rural Development and the law for all activities of the General Department.
The Director General of the Forests General Department shall define the functions, tasks, authorities, and organizational structure of subordinate agencies and units; promulgate the working regulations of the General Department; appoint, dismiss, and remove leaders and managers holding positions within the General Department according to the law and the classification of personnel management by the Minister of Agriculture and Rural Development.
3. Deputy Directors General shall be appointed, dismissed, and removed by the Minister of Agriculture and Rural Development based on the proposal of the Director General; they shall be responsible to the Director General and the law for the areas of work assigned to them.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from March 15, 2010.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees directly under the Central Government, and the Director General of the Forests General Department are responsible for implementing this Decision./.
