Joint Circular No. 04/2010/TTLT-BNV-BTC guiding the implementation of certain Articles of Government Decree No. 01/2009/NĐ-CP dated January 2, 2009 on material standards for logistics support for personnel engaged in cryptographic work.

JOINT CIRCULAR

Guidelines for implementing certain Articles of Decree No. 01/2009/NĐ-CP dated January 2, 2009 of the Government on material standards for logistics support for personnel engaged in cryptographic work

To guide the implementation of certain provisions of Decree No. 01/2009/NĐ-CP dated January 2, 2009 of the Government on material standards for logistics support for personnel engaged in cryptographic work (hereinafter referred to as Decree No. 01/2009/NĐ-CP); after consultation and agreement with the Ministry of Planning and Investment, the Ministry of National Defense, the Ministry of Public Security, and the Ministry of Finance, guidelines for certain provisions concerning food standards, clothing standards, and plans for implementing certain material standards for logistics support for personnel engaged in cryptographic work are hereby provided as follows:

Article 1. Food Standards for Personnel Engaged in Cryptographic Work

1. The food standard for personnel engaged in cryptographic work who undertake particularly arduous, toxic, dangerous, or arduous, toxic, and dangerous tasks shall be calculated as follows:

a) Level 1: the food allowance is 1.6 times the basic food standard of non-commissioned officers and soldiers of the infantry branch of the People's Army, applicable to personnel engaged in cooking in furnaces, mixing synthetic paints, applying varnish, attaching protective coatings to various types of secret code materials;

b) Level 2: the food allowance is 1.5 times the basic food standard of non-commissioned officers and soldiers of the infantry branch of the People's Army, applicable to personnel engaged in decoding secret codes; researching, testing, and experimenting with cipher machines and producing cipher keys; producing printed circuit boards for cipher machines; casting, cleaning lead and plastic characters; operating Typo and offset printing machines for various types of secret code materials; manually cutting and trimming secret code materials;

c) Level 3: the food allowance is 1.3 times the basic food standard of non-commissioned officers and soldiers of the infantry branch of the People's Army, applicable to instructors teaching technical cipher courses.

2. Personnel engaged in cryptographic work during combat participation, exercises, flood prevention, accident response, and search and rescue operations shall receive additional food allowance equal to 0.8 times the basic food allowance of non-commissioned officers and soldiers of the infantry branch of the People's Army; during technical cipher training and combat readiness duty, they shall receive an additional food allowance equal to 0.5 times the basic food allowance of non-commissioned officers and soldiers of the infantry branch of the People's Army.

3. Food allowance according to medical standards:

a) Personnel engaged in cryptographic work who are injured or ill and treated at military infirmaries or hospitals or infirmaries of the Government Cryptographic Office shall receive food according to the medical standards of active-duty military personnel with the same salary coefficient, rank, position, and equivalent level;

b) Annually, based on the target group and the medical treatment system for personnel engaged in cryptographic work stipulated in Clause 2, Article 4 of Decree No. 01/2009/NĐ-CP, the Ministry of National Defense ensures the food allowance according to the medical standards at military infirmaries and hospitals; the Government Cryptographic Office bases the food allowance according to the medical standards for personnel engaged in cryptographic work at its infirmary to implement this.

4. The standards and food allowances specified in Clause 1 and Clause 2 of Article 1 of this Circular shall be implemented according to the standards and food allowances of active-duty military personnel. When the standards and food allowances of active-duty military personnel are adjusted, the standards and food allowances for personnel engaged in cryptographic work specified in Clause 1 and Clause 2 of Article 1 of this Circular shall be correspondingly adjusted.

b) Annually, based on the subjects and standards of the regime for personnel engaged in confidential work as stipulated in Clause 2, Article 4 of Decree No. 01/2009/NĐ-CP, the Ministry of National Defense ensures the food allowance according to the medical standard at military infirmaries and hospitals; the Government Confidentiality Service implements this allowance based on the medical standard food allowance for personnel engaged in confidential work at the Government Confidentiality Service's infirmary.

4. The standards and food allowances specified in Clauses 1 and 2 of Article 1 of this Circular shall be implemented according to the standards and food allowances of active-duty military personnel. When the standards and food allowances of active-duty military personnel are adjusted, the standards and food allowances for personnel engaged in confidential work as specified in Clauses 1 and 2 of Article 1 of this Circular shall be correspondingly adjusted.

Article 2. Uniform standards for personnel engaged in confidential work

The uniform standards for personnel engaged in confidential work shall be implemented according to the list number 1 attached to Decree No. 01/2009/NĐ-CP dated January 2, 2009 of the Government. This Circular provides additional guidance on the following points:

1. Operational uniform standards:

The operational uniform standards include blue shirts, operational bags, outdoor clothing, training uniforms, and high-top shoes provided to the following categories:

a) Blue shirts issued to personnel directly involved in coding, research, and testing cryptographic techniques and products;

b) Operational bags are provided to personnel receiving salaries based on the pay scale for officers of the People's Army, officers of the People's Public Security, and the confidential rank pay scale with a responsibility allowance for protecting secret codes at a rate of 0.30.

c) Outdoor training clothing issued to personnel directly involved in training and outdoor activities;

d) High-top shoes are provided to personnel directly working in border provinces and islands.

The State Confidentiality Administration is responsible for designing the models, colors, and materials of the operational uniforms and reporting to the Ministry of Home Affairs for decision-making. The procurement of operational uniforms shall be carried out in accordance with current regulations.

2. Cold weather uniforms:

Cold weather uniforms are equipped for personnel engaged in confidential work in cold regions 1 and cold regions 2 as follows:

a) Cold region 1 applies to personnel engaged in confidential work operating in border provinces and cities in the northern part including Son La, Dien Bien, Lai Chau, Lao Cai, Ha Giang, Tuyen Quang, Cao Bang, Bac Kan, Lang Son, Quang Ninh, and islands belonging to provinces and cities from Quang Binh northward;

b) Cold region 2 applies to personnel engaged in confidential work operating in provinces and centrally-administered cities in the Central Highlands region and other provinces and cities from Thua Thien-Hue northward.

3. Methods of ensuring various types of uniforms:

a) Ensuring by physical items applies to professional uniforms;

b) Ensuring by money or physical items applies to regular uniforms, anniversary uniforms, and cold-resistant uniforms.

4. Basis for determining the value of regular uniforms, annual uniforms, and cold weather uniforms:

The determination of the value of each type of uniform for personnel engaged in confidential work is based on the quality and price of military uniforms.

The agency responsible for determining the value of each type of uniform: The Ministry of Home Affairs stipulates the prices of each type of uniform after reaching a consensus with the Ministry of Finance.

When the cost of raw materials for uniforms fluctuates by less than 20%, the Ministry of Home Affairs will independently decide to adjust the prices of various types of uniforms; when the cost of raw materials for uniforms fluctuates by 20% or more, the Ministry of Home Affairs will coordinate with the Ministry of Finance to consider adjusting the prices accordingly.

Article 3. Implementation Plan for后勤物资物质标准的实施计划

1. Based on the provisions of Decree No. 01/2009/NĐ-CP and the guidance provided in this Circular, the Ministry of Finance ensures the budget for the Ministry of Home Affairs, relevant ministries, sectors, and localities with confidential organizations to implement the material support standards for personnel engaged in confidential work according to the following plan:

a) In 2009-2010, supplement and ensure standards such as food standards; uniform standards; kitchen and dining room equipment and catering supplies standards; medical supplies, bandages, and chemical standards; medical equipment and health care supplies standards; hygiene miscellaneous expenses standards; clean water usage quotas; equipment usage quotas; electricity consumption quotas as prescribed;

b) From 2010-2020, gradually allocate the budget to build collective barracks housing; office space standards; leadership residence area standards; collective canteen, school, and hospital space standards; public facility area standards and other auxiliary facilities. The implementation plan may be extended depending on the state budget's ability to ensure funding.

2. Based on the annual budget guarantee plan, the Ministry of Home Affairs ensures the material support standards for personnel engaged in confidential work at the State Confidentiality Administration; relevant ministries, sectors, and localities with confidential organizations ensure the material support standards for personnel engaged in confidential work according to current regulations.

Article 4. Establishment, Implementation, and Settlement of Financial Budgets

The establishment, implementation, and settlement of financial budgets to ensure material and logistical standards for personnel engaged in confidential work shall be carried out in accordance with the provisions of the State Budget Law, the Accounting Law, and other guiding documents implementing these laws. This Circular provides additional guidance on the following matters:

1. Establishment of budget projections:

a) The Government Confidential Service shall be responsible for preparing annual budget estimates to ensure material and logistical standards for personnel engaged in confidential work within the Government Confidential Service;

b) The Ministry of National Defense shall be responsible for preparing annual budget estimates to ensure material and logistical standards as follows:

- Standards for medicines, bandages, chemicals; standards for medical equipment and hygiene magazines as stipulated in Articles 7, 8, and 9 of Decree No. 01/2009/NĐ-CP for conducting health examinations and treatment for personnel engaged in confidential work at military dispensaries and hospitals;

- Equipment standards for personnel engaged in confidential work at the Ministry of National Defense as specified in Tables 13, 14, and 15 of Catalogue No. 4 issued together with Decree No. 01/2009/NĐ-CP and the meal allowance according to the medical standard as stipulated in Point 3 of Article 1 of this Joint Circular;

c) The Ministry of Public Security shall be responsible for preparing annual budget estimates to ensure equipment standards for personnel engaged in confidential work at the Ministry of Public Security as specified in Tables 13, 14, and 15 of Catalogue No. 4 issued together with Decree No. 01/2009/NĐ-CP;

d) Ministries, sectors, and localities directly managing personnel engaged in confidential work shall be responsible for preparing annual budget estimates to ensure material and logistical standards for personnel engaged in confidential work at these ministries, sectors, and localities as specified in Catalogues Nos. 1, 2, 3, 4, and 5 issued together with Decree No. 01/2009/NĐ-CP and this Joint Circular.

2. Management, expenditure, and settlement of financial budgets to ensure material and logistical standards shall be carried out in accordance with current financial management regulations and systems.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. This Joint Circular shall take effect 45 days from the date of signature, and the material and logistical standards for personnel engaged in confidential work shall be implemented from the date Decree No. 01/2009/NĐ-CP of the Government dated January 2, 2009 takes effect.

Abolish any provisions regarding material and logistical standards for personnel engaged in confidential work that conflict with the provisions of Decree No. 01/2009/NĐ-CP of the Government dated January 2, 2009 concerning material and logistical standards for personnel engaged in confidential work and this Joint Circular.

2. Any standards and norms not specified in this Joint Circular shall be implemented in accordance with the provisions of Decree No. 01/2009/NĐ-CP and Catalogues Nos. 1, 2, 3, 4, and 5 issued together with Decree No. 01/2009/NĐ-CP.

3. Students engaged in confidential work who are not members of the armed forces or People's Public Security Force and receive living allowances shall implement material and logistical standards equivalent to those for non-commissioned officers and infantry soldiers in the People's Army. Specifically, clothing standards shall be implemented in accordance with the annex attached to this Joint Circular.

4. The Ministry of Home Affairs shall be responsible for:

a) Take the lead in coordinating with relevant agencies to organize the implementation of material and logistical standards for personnel engaged in confidential work as stipulated in Decree No. 01/2009/NĐ-CP, Catalogues Nos. 1, 2, 3, 4, and 5 issued together with Decree No. 01/2009/NĐ-CP, and this Joint Circular;

b) Coordinate with the Ministry of National Defense and the Ministry of Public Security to monitor the implementation of equipment standards specified in Table 13, 14, and 15 of Catalogue No. 4 issued together with Decree No. 01/2009/NĐ-CP.

5. During the process of organizing implementation, if there are any difficulties, agencies and organizations using and managing personnel engaged in confidential work are requested to report to the Ministry of Home Affairs and the Ministry of Finance for consideration and resolution./.
