Joint Circular No. 04/2010/TTLT-BTNMT-BNV guiding the tasks, powers, organization, and staffing of the Department of Natural Resources and Environment under the People's Committee of provinces and centrally-run cities; and the Department of Natural Resources and Environment under the People's Committee of districts, towns, urban districts, and provincial cities regarding land valuation work.

Article 1. Tasks, Powers, Organization, and Staffing of the Department of Natural Resources and Environment Regarding Land Valuation Work

1. Tasks and Powers

a) Submit to the People's Committee at the provincial level for issuance within its authority programs, projects, plans, and normative legal documents on the land price list and adjustments to the land price list in accordance with the law;

b) Implement normative legal documents, programs, projects, standards, technical regulations, economic and technical norms on the establishment, adjustment of the land price list; disseminate and popularize laws on the land price list; guide professional matters related to the land price list for civil servants of the Environmental Resources Division at the district level;

c) Resolve issues arising in the establishment, adjustment, and implementation of the land price list at the local level;

d) Conduct surveys, collect data, and compile statistics on prices of various types of land and establish a database on land prices;

đ) Update land price information in the land information system and provide information and data on land prices in the provincial land price list;

e) Prepare and submit the land price list review file to the Department of Finance for review in accordance with the law; coordinate with the Department of Finance and relevant specialized agencies when the People's Committee at the provincial level decides to establish a land price list review board;

g) Report to the People's Committee at the provincial level and the Ministry of Natural Resources and Environment periodically or urgently on the situation of implementing tasks related to the establishment and implementation of the land price list at the local level;

h) Carry out other land valuation tasks assigned by the People's Committee at the provincial level.

2. Organization and Staffing

a) The Department of Natural Resources and Environment has organizations to perform the tasks specified in Clause 1 of this Article but not exceeding the number of organizations prescribed in Circular Joint No. 03/2008/TTLT-BTNMT-BNV dated July 15, 2008 of the Ministry of Natural Resources and Environment and the Ministry of Interior guiding the functions, tasks, powers, and organizational structure of specialized agencies on natural resources and environment under the People's Committees at all levels.

b) The staffing of the organization engaged in land valuation work under the Department of Natural Resources and Environment is administrative staffing assigned by the People's Committee at the provincial level, ensuring sufficient staffing to perform the tasks specified in Clause 1 of this Article.

Article 2. Tasks, powers, and staffing of the Natural Resources and Environment Department regarding land valuation work

1. Tasks and Powers

a) Advising and assisting the People's Committee at the district level to organize the implementation of the land price list within the district;

b) Cooperating with the organization conducting land valuation work under the Department of Natural Resources and Environment to carry out investigations and surveys on land prices, statistics on various types of land prices; building and updating information on land prices, establishing a database on land prices within the district;

c) Cooperating with the Finance and Planning Department and other relevant specialized agencies in implementing the land price list within the district;

d) Reporting to the People's Committee at the district level and the Department of Natural Resources and Environment periodically or urgently on the situation of implementing the land price list within the district.

2. Staffing The staffing for land valuation work of the Natural Resources and Environment Department is administrative staffing assigned by the People's Committee at the district level, ensuring sufficient staffing to perform the tasks stipulated in Clause 1 of this Article.

Article 3. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from March 19, 2010.

2. Based on the provisions of Articles 1 and 2 of this Joint Circular, the People's Committee at the provincial level shall specify the tasks, powers, organization, and staffing of the Department of Natural Resources and Environment regarding land valuation work; guiding the People's Committee at the district level to specify the tasks and staffing of the Natural Resources and Environment Department regarding land valuation work. In the course of implementation, if there are difficulties, it is recommended to reflect them to the Ministry of Natural Resources and Environment for coordination with the Ministry of Home Affairs to consider and resolve.
