Chapter I

GENERAL PROVISIONS

This Circular stipulates standards, files, procedures for appointing and relieving judicial appraisers, establishing and announcing lists of judicial appraisers, persons conducting judicial appraisals on a case-by-case basis, organizations conducting judicial appraisals on a case-by-case basis; procedures for selecting persons to participate in judicial appraisals and forming appraisal boards in the field of culture.

Article 2. Applicability

1. Officials, civil servants, public officials under the Ministry of Culture, Sports and Tourism, Department of Culture, Sports and Tourism.

2. Agencies and units under the Ministry of Culture, Sports and Tourism; Departments of Culture, Sports and Tourism.

3. Other organizations and individuals related thereto.

Chapter II

STANDARDS, FILES, PROCEDURES FOR APPOINTING AND RELIEVING JUDICIAL APPRAISERS,

ESTABLISHING AND ANNOUNCING LISTS OF JUDICIAL APPRAISERS, PERSONS CONDUCTING JUDICIAL APPRAISALS,

Article 3. Standards for appointing forensic examiners

1. Standards for appointing judicial appraisers shall be implemented in accordance with Clause 1, Article 7 of the Law on Judicial Appraisal.

2. The standard "Having a bachelor's degree or higher" stipulated in Point b, Clause 1, Article 7 of the Law on Judicial Appraisal means having a bachelor's degree, master's degree, or doctoral degree issued by an educational institution in Vietnam (in cases where the bachelor's degree, master's degree, or doctoral degree is issued by an educational institution abroad, such degrees must be recognized in Vietnam in accordance with the provisions of the law on education and international treaties to which the Socialist Republic of Vietnam is a party) belonging to one of the following training majors:

a) Fine Arts;

b) Applied Fine Arts;

c) Performing Arts;

d) Audiovisual Arts;

d) Vietnamese language and culture;

e) Humanities;

g) Sociology and anthropology;

h) Library science;

i) Museology;

k) Law;

l) Other relevant majors.

3. The standard "Having at least five years of practical experience in the specialized field of study" stipulated in Point b, Clause 1, Article 7 of the Law on Judicial Appraisal means having directly worked in the specialized field of study specified in Clause 2 of this Article for at least five years.

Article 4. Procedures for appointing forensic examiners

1. Procedures for appointing judicial appraisers at the Ministry of Culture, Sports and Tourism:

a) The head of the agency or unit under the Ministry selects persons meeting the criteria stipulated in Article 3 of this Circular, prepares a file to propose the appointment of forensic examiners, and sends it to the Department of Organization and Cadres.

b) The Director of the Cadre and Civil Servant Affairs Department shall take the lead, coordinate with the Director of the Legal Affairs Department to examine the file, select and submit to the Minister of Culture, Sports and Tourism for decision on the appointment of judicial appraisers.

2. Procedures for appointing judicial forensic experts at the local level:

The Director of the Department of Culture, Sports and Tourism shall take the lead, coordinate with the Director of the Department of Justice to select persons who meet the standards stipulated in this Circular, accept the application file of persons applying for the appointment of judicial appraisers as stipulated in Article 5 of this Circular, and propose the Chairman of the Provincial People's Committee to appoint judicial appraisers.

Article 5. File for requesting appointment as a legal expert

1. A letter proposing the appointment of forensic examiners from the head of the unit or a request from the person proposing the appointment of forensic examiners.

2. A copy of the bachelor's degree or higher certificate as stipulated in Clause 2, Article 3 of this Circular.

3. Curriculum vitae and Judicial Background Certificate.

4. A certificate confirming the actual time spent working in the specialized field where the person proposed for appointment or who has applied for appointment works.

Article 6. Dismissal of Judicial Appraisers

Clause 1. Cases of relief, files for proposing the relief of judicial appraisers shall be implemented according to the provisions of clause 1 and clause 2 of Article 10 of the Law on Judicial Appraisal.

Clause 2. The head of the agency or unit under the Ministry shall prepare a file to propose the relief of judicial appraisers to be sent to the Department of Organization and Cadres.

The Director of the Cadre and Civil Servant Affairs Department shall take the lead, coordinate with the Director of the Legal Affairs Department to review the file, submit to the Minister of Culture, Sports and Tourism for examination and decision on the relief of judicial appraisers at the Ministry of Culture, Sports and Tourism.

3. The Director of the Department of Culture, Sports and Tourism shall unify opinions with the Director of the Department of Justice, prepare the file to propose the Chairman of the Provincial People's Committee to examine and decide on the relief of judicial appraisers in the locality.

Article 7. Establishing and Announcing Lists of Judicial Appraisers, Case-based Judicial Appraisers, and Case-based Judicial Appraisal Organizations

1. Establishment and Publication of Lists of Judicial Appraisers

a) For judicial appraisers appointed by the Minister of Culture, Sports and Tourism:

- The Cadre and Civil Servant Affairs Department shall establish and send the list of judicial appraisers to the Information Technology Center for publication on the Ministry's website, and simultaneously send it to the Ministry of Justice to compile a general list.

- The Information Technology Center shall be responsible for publishing the list of judicial appraisers on the Ministry's website within three (3) days from the date of receipt of the list.

b) For judicial appraisers appointed by the Chairman of the Provincial People's Committee:

The Department of Culture, Sports and Tourism shall be responsible for preparing and sending the list of judicial appraisers for publication on the provincial people's committee's website.

2. Establishing and announcing lists of persons conducting judicial appraisals on a case-by-case basis, organizations conducting judicial appraisals on a case-by-case basis under the management authority of the Ministry of Culture, Sports and Tourism

a) Persons meeting the standards stipulated in Article 18 of the Law on Judicial Appraisal and this Circular, organizations meeting the conditions stipulated in Clause 1, Article 19 of the Law on Judicial Appraisal may be selected to establish lists of persons conducting judicial appraisals on a case-by-case basis, organizations conducting judicial appraisals on a case-by-case basis;

b) Annually, the heads of agencies and units under the Ministry shall select and prepare lists of persons conducting judicial appraisals on a case-by-case basis to be submitted to the Cadre and Civil Servant Affairs Department before March 1.

The Cadre and Civil Servant Affairs Department shall take the lead, coordinate with the Legal Affairs Department to examine the lists of persons conducting judicial appraisals on a case-by-case basis, select organizations meeting the conditions, and submit to the leadership of the Ministry for decision on announcing lists of persons conducting judicial appraisals on a case-by-case basis, organizations conducting judicial appraisals on a case-by-case basis;

c) The Cadre and Civil Servant Affairs Department shall send the list along with information about the appraisal specialty, experience, and capability of persons conducting judicial appraisals on a case-by-case basis, organizations conducting judicial appraisals on a case-by-case basis to the Information Technology Center for publication on the Ministry's website, and simultaneously send it to the Ministry of Justice to compile a general list.

Chapter III

PROCEDURES FOR SELECTING PERSONS TO PARTICIPATE IN JUDICIAL APPRAISALS

AND FORMING APPRAISAL BOARDS

Article 8. Appointment of persons to participate in judicial appraisal

1. At the Ministry of Culture, Sports and Tourism:

a) In case the Ministry of Culture, Sports and Tourism receives a judicial appraisal request with content within the scope of its administrative management, the Head of the Legal Department shall take the lead, coordinate with the Head of the Cadre and Civil Servant Organization Department and the heads of relevant agencies and units to select judicial appraisers suitable for the content of the appraisal request, propose whether the form of the appraisal should be individual or collective, and submit it to the Ministry's leadership for decision on appointing individuals to carry out the appraisal and determining the form of the appraisal for the requested contents.

In case the content of the judicial appraisal request does not fall within the scope of the Ministry’s administrative management, the Head of the Legal Department shall take the lead, coordinate with the Head of the Cadre and Civil Servant Organization Department, and submit to the Ministry's leadership to refuse the judicial appraisal and respond to the requesting agency.

b) In case agencies and units under the Ministry receive an appraisal request or requirement within their jurisdiction, the head of the agency or unit shall be responsible for receiving it and assigning someone to carry out the judicial appraisal according to the law.

2. At the Department of Culture, Sports and Tourism:

a) In case the Department of Culture, Sports and Tourism receives a judicial appraisal request with content within the scope of its administrative management, the Director of the Department of Culture, Sports and Tourism shall select judicial appraisers suitable for the content of the appraisal request, decide on the form of the appraisal being either individual or collective, and inform the requesting agency of the list of assigned appraisers and the form of the appraisal for the requested contents.

b) In case the content of the appraisal does not fall within the scope of the Department’s administrative management, the Director of the Department of Culture, Sports and Tourism shall be responsible for refusing the judicial appraisal and responding in writing to the requesting agency.

3. The person assigned to carry out the judicial appraisal shall be responsible for receiving the content of the appraisal request, organizing the appraisal process, concluding on the appraisal contents, and responding to the requesting agency according to the law. If they find themselves unable to conduct the assigned appraisal contents, they must refuse in writing. The refusal letter shall be sent to the assigner and the requesting agency.

Article 9. Establishment of the Appraisal Board

1. Conditions for establishing the Appraisal Board:

a) The Appraisal Council in the field of culture shall be established in cases stipulated in Article 30 of the Law on Judicial Appraisal.

b) The Appraisal Council in the field of culture shall be decided to be established by the Minister of Culture, Sports and Tourism.

2. Establishing the Appraisal Board:

a) The Head of the Legal Department shall take the lead, coordinate with the Head of the Cadre and Civil Servant Organization Department to select judicial appraisers suitable for the content of the appraisal request, complete the file, and submit it to the Minister for decision to establish the council.

b) The composition, number of members, and operational mechanism of the Appraisal Council shall be implemented according to Article 30 of the Law on Judicial Appraisal.

Chapter IV

IMPLEMENTATION

Article 10. The People's Organization at the provincial level shall be responsible for: a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters.

1. The Legal Affairs Department shall take the lead and coordinate with the Cadres and Civil Servants Organization Department to guide and inspect the implementation of this Circular.

2. Heads of agencies and units under the Ministry, Directors of Departments of Culture, Sports and Tourism of provinces and centrally governed cities shall be responsible for organizing the implementation of this Circular.

Article 11.nto effecitselffor implementation

This Circular takes effect from July 1, 2013.

During implementation, if there are any difficulties, organizations and individuals are advised to report to the Ministry of Culture, Sports and Tourism for appropriate amendments and supplements./.
