Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Based on the opinions of the People's Committee of Vinh Long Province at Circular No. 1838/UBND-KTN dated July 4, 2014; the People's Committee of Tra Vinh Province at Circular No. 3131/UBND-KTKT dated October 1, 2014; the People's Committee of Soc Trang Province at Circular No. 1158/CTUBND-HC dated October 2, 2014; the Department of Transport of Dong Thap Province at Circular No. 851/SGTVT-QLGT.MT dated July 9, 2014 (authorized by the People's Committee of Dong Thap Province at Circular No. 746/VPUBND-KTN dated June 24, 2014); the Department of Transport of Hau Giang Province at Circular No. 1696/SGTVT-QLHT dated July 3, 2014; the People's Committee of Can Tho City at Circular No. 5553/UBND-KT dated November 25, 2015;

Article 1. Announcing the waters of seaports located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, the waters of seaports on the Hau River located within the jurisdictions of the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho
The waters of seaports located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, the waters of seaports on the Hau River located within the jurisdictions of the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho include the following waters:
1. Waters of seaports at the estuary of the Hau River.
2. Waters of seaports on the Hau River located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho.
Article 2. Scope of the waters of seaports located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, the waters of seaports on the Hau River located within the jurisdictions of the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho
The scope of the waters of seaports located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, the waters of seaports on the Hau River located within the jurisdictions of the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho, measured according to the highest tidal level, is specified as follows:
1. The boundary of the waters of seaports at the estuary of the Hau River is limited by straight lines connecting the following points in sequence: DA1, DA2, DA3, DA4, DA5, and DA6 with the following coordinates:
DA1: 09°41'32'' N, 106°34'37'' E;
DA2: 09°47'14" N, 106°37'02" E;
DA3: 09°40'04" N, 106°43'54" E;
DA4: 09°40'04" N, 107°00'01" E;
DA5: 09°10'14'' N, 106°21'55'' E;
DA6: 09°21'02'' N, 106°12'07'' E.
2. The boundary of the waters of seaports on the Hau River located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho is limited as follows: From points DA1 and DA6 running along the coast and both banks of the Hau River upstream to the transverse line crossing the river at the Cai San branch (bordering An Giang province) downstream and including the channel for large vessels entering the Hau River.
3. The boundaries at the branches, creeks, and canals of the river as stipulated in Clause 2 of this Article are limited by the straight line connecting the two most protruding points on the banks of those branches, creeks, and canals.
4. The boundary of the waters of seaports at the estuary of the Hau River as stipulated in this Circular is determined on Chart No. I-300-08 produced in 1978 by the Vietnam Navy. The coordinates of the points specified in this Circular are applied according to the VN-2000 Coordinate System and converted to corresponding coordinate systems as follows:

Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and delivery zones, quarantine zones, anchorage areas, transfer zones, and storm shelters for vessels entering and leaving seaports located within the jurisdictions of the provinces of Tra Vinh, Soc Trang, seaports on the Hau River located within the jurisdictions of the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho in accordance with regulations.
Article 4. Responsibilities of the Can Tho Maritime Port Office and related parties
1. The Can Tho Maritime Port Office shall be responsible for:
a) Implementing tasks and authorities as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities in the waters of coastal ports located within the territories of Tra Vinh Province, Soc Trang Province, and coastal ports on the Hau River within the territories of Hau Giang Province, Vinh Long Province, Dong Thap Province, and Can Tho City;
b) Based on actual conditions regarding weather, waves, draft, ship tonnage, and cargo characteristics, designate specific positions for ships to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid storms in accordance with regulations, ensuring maritime safety, maritime security, and environmental pollution prevention;
c) Based on actual conditions regarding weather, waves, draft, and ship tonnage entering and leaving coastal ports managed by the Dong Thap Maritime Port Office and the An Giang Maritime Port Office, designate specific positions for ships to pick up and drop off pilots, undergo quarantine, anchor, and avoid storms in accordance with regulations, ensuring maritime safety, maritime security, environmental pollution prevention, and promptly informing the relevant maritime port offices;
2. The Dong Thap Maritime Port Office and the An Giang Maritime Port Office shall be responsible for:
a) Notifying the Can Tho Maritime Port Office of the name, nationality, main technical parameters, and other necessary information of ships arriving to pick up and drop off pilots, anchor, and avoid storms in accordance with regulations at least four hours before the ships reach the boundary of the coastal port waters;
b) Notifying the Can Tho Maritime Port Office of the movement of ships departing from the designated positions for picking up and dropping off pilots, anchoring, and avoiding storms at least two hours before the ships leave these positions in accordance with regulations;
c) Processing procedures for ships to enter and leave wharves and piers according to regulations for ships arriving in coastal port waters under their management;
d) Cooperating with the Can Tho Maritime Port Office to resolve incidents involving ships entering and leaving coastal ports within the territories of Dong Thap Province and An Giang Province when such ships operate in the waters of coastal ports within the territories of Tra Vinh Province, Soc Trang Province, and coastal ports on the Hau River within the territories of Hau Giang Province, Vinh Long Province, Dong Thap Province, and Can Tho City;
3. The Inland Waterway Transport Region IV Management Office shall be responsible for organizing specialized state management at inland waterway ports and jetties (excluding passenger ferries) on the Hau River from the straight line cutting across the O Mon Branch mouth downstream to the straight line cutting across the Cai Sann Branch mouth (the border between An Giang Province and Can Tho City) downstream.
Article 5. Effective Date
This Circular takes effect from June 1, 2016. Decree No. 50/2007/QĐ-BGTVT dated September 12, 2007, promulgating the waters of coastal ports within the territory of Can Tho City, Vinh Long Province, and the management area of the Can Tho Maritime Port Office, is hereby abolished.
Article 6. Responsibility for Implementation
The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Transport Administration, the Directors of the Transportation Departments of Can Tho City, Tra Vinh Province, Vinh Long Province, Soc Trang Province, Hau Giang Province, Dong Thap Province, the Directors of the Can Tho Maritime Port Office, the An Giang Maritime Port Office, the Dong Thap Maritime Port Office, the Inland Waterway Transport Region IV Management Office, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular.
