Circular No. 04/2018/TT-BTTTT stipulates the List of products and goods that may cause safety hazards under the management responsibility of the Ministry of Information and Communications (Ministry of Information and Communications - BTTTT). Article 1. Scope of Regulation t sThis Circular stipulates the List of Products and Commodities Capable of Causing Safety Hazards under the Management Responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of Products and Commodities Group 2).of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs1. Organizations and individuals engaged in production and business of products and commodities listed in the List of Products and Commodities Group 2 in Vietnam.
2. Organizations and individuals involved in activities related to quality management of products and commodities listed in the List of Products and Commodities Group 2 in Vietnam.
Article 3. List of Products and Commodities Group 2
Article 2. Applicability
This Circular applies to:
1. The List of Products and Commodities Group 2 and its management form are prescribed as follows:
a) "List of Telecommunications and Information Technology Products and Commodities that must be certified and declared compliant" is prescribed in Appendix I of this Circular.
b) "List of Telecommunications and Information Technology Products and Commodities that must be declared compliant" is prescribed in Appendix II of this Circular.
2. The Ministry of Information and Communications periodically reviews, amends, and supplements the List of Products and Commodities Group 2 in accordance with state management policies.
1. Quality management of products and commodities listed in the List of Products and Commodities Group 2 shall be carried out in accordance with the regulations of the Ministry of Information and Communications on certification and declaration of compliance for telecommunications and information technology products and commodities and corresponding technical standards and specifications.
2. In case new technical standards replace existing ones specified in the List of Products and Commodities Group 2, the new standards shall apply. In case new standards replace existing ones specified in the List of Products and Commodities Group 2, the new standards shall apply according to the regulations of the Ministry of Information and Communications.
3. In case there is a discrepancy between the provisions of technical standards and this Circular regarding certification and declaration of compliance, the provisions of this Circular shall prevail.
Clause 1. The management of product and good quality in the List of Products and Goods Group 2 shall be carried out according to the regulations of the Ministry of Information and Communications on certification for conformity, declaration for conformity, and quality inspection for specialized information technology and telecommunications products and goods and corresponding technical standards.
1. This Circular takes effect from July 1, 2018 and replaces Circular No. 42/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications on the List of Products and Commodities Capable of Causing Safety Hazards under the Management Responsibility of the Ministry of Information and Communications.
2. Products and commodities that have been issued certificates of compliance before this Circular takes effect shall continue to apply Circular No. 42/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications on the List of Products and Commodities Capable of Causing Safety Hazards under the Management Responsibility of the Ministry of Information and Communications until the expiration date stated on the certificate of compliance.
3. During the application of technical standards and specifications and testing, organizations and individuals responsible shall promptly reflect any issues encountered and follow the guidance of the Ministry of Information and Communications (Department of Science and Technology).
Article 5. Effectiveness and Responsibility for Implementation
4. The Chief of the Office, Directors of Departments, Heads of agencies and units under the Ministry of Information and Communications, and relevant organizations and individuals are responsible for implementing this Circular./.

(*) For this standard, equipment does not need to undergo conformity certification but only needs to declare conformity as equipment listed in Appendix II of this Circular.
(**) Conformity certification and declaration of conformity shall be implemented when the equipment complies with the frequency bands and technical conditions, operational requirements stipulated in the Circular issued by the Minister of Information and Communications on the List of Radio Frequency Equipment Exempted from License, Technical Conditions, and Operational Requirements.
(***) Other short-range radio transmitting and receiving equipment refers to short-range radio transmitting and receiving equipment that is not listed, or has been listed but does not fall within the scope regulated by the corresponding technical standards and regulations at item 2.3 of the List in Appendix I of this Circular.
