Pursuant to the Government Organization Law dated June 19, 2015;
Pursuant to the State Budget Law on June 25, 2015;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law; Decree No. 165/2016/NĐ-CP dated December 24, 2016 of the Government on the management and use of the state budget for certain activities under the national defense and security sector;
The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.
The Prime Minister issues this Decision on the establishment, management, and use of the Crime Prevention and Control Fund.
Article 1. Scope of Regulation
This Decision stipulates the principles for the establishment, management, operation, and use of the Crime Prevention and Control Fund; the establishment, management, and use of the Central Crime Prevention and Control Fund; and the responsibilities of agencies in managing and operating the Central Crime Prevention and Control Fund.
Article 2. Applicability
1. Agencies and units with functions related to crime prevention and control activities.
2. Individuals and collectives with outstanding achievements in crime prevention and control work; families and individuals directly participating in crime prevention and control who suffer losses to life, health, and property.
Article 3. Principles for the establishment, management, operation, and use of the Crime Prevention and Control Fund
1. The Crime Prevention and Control Fund is a non-budget state financial fund established at the central level (referred to as the Central Crime Prevention and Control Fund) and at provincial levels (collectively referred to as the Provincial Crime Prevention and Control Fund) to support crime prevention and control work.
2. The Central Crime Prevention and Control Fund shall be managed and operated by the Minister of Public Security. The Provincial Crime Prevention and Control Fund shall be established, managed, and operated by the Chairman of the People's Committee of the province.
3. The Crime Prevention and Control Fund shall open an account at the State Treasury.
4. The preparation of budgets, payments, final accounts, and audits for the Crime Prevention and Control Fund shall be carried out in accordance with the provisions of the State Budget Law and Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law.
5. The expenditure items of the Crime Prevention and Control Fund shall not overlap with other expenditure items from other funding sources, and any surplus funds in the Crime Prevention and Control Fund at the end of the year that have not been used shall be transferred to the next year for continued use.
Article 4. Establishment of the Central Crime Prevention and Control Fund
The Central Crime Prevention and Control Fund shall be established and formed from the following sources of revenue:
1. The remaining balance of the Central Crime Prevention and Control Fund formed according to Decision No. 47/2012/QĐ-TTg dated November 1, 2012 of the Prime Minister.
2. Central government budget capital contribution when establishing the Central Crime Prevention and Control Fund according to this Decision.
3. Legal donations and voluntary contributions from organizations and individuals both within and outside the country for crime prevention and control work.
Article 5. Expenditure Items and Spending Limits from the Central Crime Prevention and Control Fund
The Central Crime Prevention and Control Fund shall be used for the following expenditure items:
1. Immediate cash rewards for individuals and collectives with outstanding achievements in crime prevention and control work and drug control. The specific reward amounts for each individual and collective case shall be decided by the Minister of Public Security, with a maximum of VND 5,000,000 per person per award for individuals and a maximum of VND 20,000,000 per collective per award for collectives.
2. Immediate financial compensation and assistance to families and individuals directly involved in crime prevention and control and drug control who suffer losses to life, health, and property. The spending amount shall be implemented in accordance with the provisions of Decree No. 103/2002/NĐ-CP dated December 17, 2002 of the Government on compensation and assistance for individuals, families, agencies, and organizations participating in drug control who suffer losses to life, health, and property.
Article 6. Responsibility for managing and operating the Central Crime Prevention Fund
1. Ministry of Public Security:
a) Be responsible for managing, directing, using, and settling accounts and finalizing the Central Crime Prevention Fund
The Director of the Office of the Ministry of Public Security assists the Minister of Public Security to monitor, manage, allocate, and settle accounts and finalize the Central Crime Prevention Fund according to this Decision, authorized to open an account at the State Treasury (at the location where the unit is based) to manage and establish accounting records to track revenues and expenditures, prepare reports on the finalization of the Central Crime Prevention Fund in accordance with the law.
b) Organize fundraising, grants, and accept donations from individuals and organizations both domestically and internationally for the Central Crime Prevention Fund.
c) Summarize the management and use of the Central Crime Prevention Fund periodically every six months and annually, and report promptly to the Prime Minister, simultaneously sending to the Ministry of Finance for monitoring and summarizing.
2. Ministry of Finance:
a) Allocate the state budget to support the registered capital for the operation of the Central Crime Prevention Fund.
b) Take the lead and coordinate with the Ministry of Public Security to guide the receipt, management, and use of the Central Crime Prevention Fund.
c) Coordinate with the Ministry of Public Security to inspect and supervise the management and use of the Central Crime Prevention Fund.
Article 7. Implementation Provisions
1. This Decision takes effect from March 10, 2019, and replaces Decision No. 47/2012/QĐ-TTg dated November 1, 2012, of the Prime Minister regarding the establishment, management, and use of the Crime Prevention Fund.
2. Provincial Crime Prevention Funds established under Decision No. 47/2012/QĐ-TTg dated November 1, 2012, of the Prime Minister regarding the establishment, management, and use of the Crime Prevention Fund must be re-established according to the State Budget Law and this Decision if they are to continue their operations.
3. In cases where the normative legal documents cited in this Decision are amended, supplemented, or replaced by new normative legal documents, the new normative legal documents shall apply.
4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees, and municipal People's Committees directly under the central government are responsible for implementing this Decision./
