Amending and supplementing certain Articles of Circular No. 05/2017/TT-BNNPTNT dated March 1, 2017 of the Ministry of Agriculture and Rural Development guiding certain contents of the National Target Program on New Rural Area Construction for the period 2016-2020.

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Prime Minister promulgating the Regulation on Management and Implementation of National Target Programs;

Implementing Decision No. 1600/QĐ-TTg dated August 16, 2016 of the Prime Minister approving the National Target Program on New Rural Area Construction for the period 2016-2020 and Decision No. 1760/QĐ-TTg dated November 10, 2017 of the Prime Minister amending and supplementing Decision No. 1600/QĐ-TTg dated August 16, 2016 of the Prime Minister approving the National Target Program on New Rural Area Construction for the period 2016-2020;

At the proposal of the Director of the Office, the Central Office for New Rural Area Construction and the Director of the Department of Legal Affairs;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain Articles of Circular No. 05/2017/TT-BNNPTNT dated March 1, 2017 of the Minister of Agriculture and Rural Development guiding certain contents of the National Target Program on New Rural Area Construction for the period 2016-2020;

Article 1. Amending and supplementing certain Articles of Circular No. 05/2017/TT-BNNPTNT dated March 1, 2017 of the Ministry of Agriculture and Rural Development guiding certain contents of the National Target Program on New Rural Area Construction for the period 2016-2020, as follows:

1. Point b Clause 2 Article 5 is amended and supplemented as follows:

b) "Investment in building new and repairing, upgrading, and expanding centralized rural water supply facilities currently existing for communes in mountainous areas, remote areas, ethnic minority areas, and areas with difficulties in accessing clean water, and ensuring the sustainable operation of water supply facilities according to the guidelines for implementing criterion number 17.1 (the ratio of households using safe and clean water) as stipulated in Decision No. 1980/QĐ-TTg dated October 17, 2016 of the Prime Minister on issuing the National Criteria for New Rural Communes for the period 2016-2020, prioritizing investment in expanding water supply from urban water supply facilities and existing water supply facilities that have expansion potential; for areas without conditions to invest in centralized water supply facilities, supporting and guiding people to treat household water from decentralized water supply systems, especially poor households, near-poor households, and policy beneficiary families."

2. Adding point c to Clause 2 Article 7 as follows:

"c) Building concentrated production zones for key agricultural products, ensuring quality, food safety, disease safety, environmental protection, and adaptation to climate change."

3. Amending and supplementing the first paragraph and Clause 5 at Article 8; adding Clauses 6 and 7 to Article 8 as follows:

“The organization of agricultural production reform shall be implemented in accordance with Decree No. 193/2013/NĐ-CP dated November 21, 2013 of the Government detailing some provisions of the Law on Cooperatives; Decree No. 107/2017/NĐ-CP dated September 15, 2017 of the Government amending and supplementing some provisions of Decree No. 193/2013/NĐ-CP; Decision No. 2261/QĐ-TTg dated December 15, 2014 of the Prime Minister approving the Program to Support Cooperative Development for the period 2015-2020; Decision No. 445/QĐ-TTg dated March 21, 2016 of the Prime Minister approving the Pilot Project to Perfect and Widespread the Model of Modern Cooperatives in the Mekong Delta Region for the period 2016-2020; Decision No. 461/QĐ-TTg dated April 27, 2018 of the Prime Minister approving the Program to Develop 15,000 Effective Agricultural Cooperatives and Cooperative Federations by 2020 and related guiding documents, focusing on the following contents:"

"5. Building and promoting models of effective cooperatives and cooperative federations in the agricultural sector; prioritizing high-tech agricultural cooperatives, agricultural cooperatives linking product sales, and cooperatives developing production linked to the One Commune One Product Program;"

"6. Directing and implementing the Program to Develop 15,000 Effective Agricultural Cooperatives and Cooperative Federations by 2020 at the local level;"

"7. Supporting infrastructure construction for agricultural cooperatives in accordance with Decision No. 2261/QĐ-TTg dated December 15, 2014 of the Prime Minister approving the Program to Support Cooperatives for the period 2015-2020."

4. Article 9 shall be amended and supplemented as follows:

“The development of rural industries shall be implemented in accordance with the provisions of Decree No. 52/2018/NĐ-CP dated April 12, 2018 of the Government on Developing Rural Industries; Decision No. 490/QĐ-TTg dated May 7, 2018 of the Prime Minister promulgating the One Commune One Product Program for the period 2018-2020 and related guiding documents."

 5. The title of Article 10 is amended and supplemented as follows:

"Clean Water Supply and Rural Environmental Sanitation."

6. Point b Clause 2 Article 11 is amended and supplemented as follows:

“Training and capacity building programs under the framework issued by the Ministry of Agriculture and Rural Development.

In addition to the training and capacity building topics already issued by the Ministry of Agriculture and Rural Development, localities may consider supplementing additional topics, training activities, and study tours suitable to practical needs and available resources. Training and capacity building sessions can be held multiple times to provide appropriate knowledge tailored to the specific characteristics of trainees."

7. Adding to the end of point b Clause 2 Article 12 as follows:

"Promoting regulations on food safety conditions for food production and business establishments."

8. Removing the first paragraph of point c Clause 2 Article 12.

Article 2. Effective Date

1. This Circular takes effect from May 16, 2019.

2. During implementation, if there are arising issues or difficulties, relevant agencies, units, organizations, and individuals should report to the Ministry of Agriculture and Rural Development for research, amendment, and supplementation to ensure suitability./.
