CIRCULAR
Regulations on job code, occupational standards, appointment, and salary grading for teaching civil servants in public high schools
On the basis of The Education Law dated June 14, 2019;
Pursuant to the Civil Servant Law dated November 15, 2010;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 115/2020/NĐ-CP dated November 25 10 2020 pursuant to the Government's Decree on recruitment, utilization, and management of civil servants;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for officials, civil servants, and personnel in armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for officials, civil servants, and personnel in armed forces;

The Minister of Education and Training issues this Circular regulating job codes, occupational standards, and appointment, salary grading of teaching civil servants in public high schools. secondary general education .
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates job codes, occupational standards, and appointment, salary grading of teaching civil servants in public high schools.
Article 2. This Circular applies to teaching civil servants implementing secondary general education programs, including teachers, principals, deputy principals, directors, deputy directors (hereinafter collectively referred to as secondary general education teachers) in high schools, comprehensive schools with multiple levels including secondary general education, centers for continuing education, vocational education and training centers, special schools, and other relevant organizations and individuals.
Private high schools may apply the provisions of this Circular to recruit, employ, and manage teachers.
Secondary general education teacher positions include:
1. Secondary General Education Teacher Level III - Job Code V.07.05.15.
2. Secondary General Education Teacher Level II - Job Code V.07.05.14.
3. Secondary General Education Teacher Level I - Job Code V.07.05.13.
Chapter II
OCCUPATIONAL STANDARDS
Article 3. Secondary General Education Teacher Level III - Job Code V.07.05.15
1. Tasks
a) Develop educational plans for assigned subjects and participate in developing departmental educational plans according to secondary general education program goals;
b) Implement tasks organizing teaching and educational activities according to school educational plans and departmental educational plans; manage students in educational activities organized by the school;
c) Conduct activities to assess learning outcomes and discipline according to regulations;
d) Organize psychological counseling, career guidance, and entrepreneurship activities for assigned class students and their parents;
đ) Participate in identifying and nurturing talented and excellent students, remedial instruction for weak students at the secondary general education level, or guiding student teaching internships and school social work activities for secondary general education students;
e) Participate in departmental activities; engage in scientific research; complete required educational activity management documentation; implement inclusive education within assigned scope; participate in organizing contests (for teachers or students) at school level or higher;
g) Complete required training courses and professional development programs; self-study and enhance professional skills;
h) Performing other tasks assigned by the principal.
a) Adhere to Party policies, state laws, and local regulations regarding secondary general education;
b) Continuously improve moral character, demonstrate responsibility, maintain the dignity, reputation, and credibility of educators; set a good example for students;
c) Show love, treat students fairly and respect their personalities; protect students' legitimate rights and interests; support colleagues;
d) Strictly follow regulations on educator ethics, behavior, and attire;
3. Educational and Training Standards
a) Hold a bachelor's degree in teacher education for secondary general education teachers. In cases where there is a shortage of teachers with a bachelor's degree in teacher education, they must have a bachelor's degree in a relevant field and a certificate in secondary general education teacher professional development program issued by the Minister of Education and Training;
Article 4. Professional Competence Standards
a) Understand the policies, laws, regulations, and requirements of the Party, State, industry, and locality regarding secondary general education and implement them in assigned tasks;
b) Know how to develop lesson plans, create interdisciplinary lessons for overlapping knowledge between subjects; adopt modern teaching methods, techniques, and integrated models;
c) Be able to effectively utilize technological equipment, teaching materials, and learning resources in teaching and managing students;
d) Possess the ability to coordinate between schools, families, and society to educate students' morals and lifestyles; provide psychological counseling, career guidance, identify talents and abilities, and support students in life skill education; organize experiential career and entrepreneurship activities for secondary general education students;
đ) Have the ability to teach through the internet and television according to the subject curriculum;
e) Use various assessment methods to evaluate students' learning outcomes and progress towards developing their qualities and capabilities;
g) Apply practical experience and research results to actual teaching and student education or produce teaching aids and equipment for secondary general education;
h) Guide secondary general education students in conducting scientific and technical research at school level or higher.
i) Possess self-study and self-improvement capabilities to develop their professional expertise.
Article 4. Second-grade High School Teacher - Code V.07.05.14
1. Tasks
In addition to the tasks of a third-grade high school teacher, a second-grade high school teacher must also perform the following tasks:
a) Serve as a lecturer or demonstrate teaching in training classes for teachers at the school level or higher, or trial new models, methods, and technologies; lead specialized training content and subject meetings or participate in building electronic learning materials.
b) Participate in guiding or evaluating scientific and technological research products at the school level or higher.
c) Participate in external evaluations or professional inspection work for teachers at the school level or higher.
d) Participate in the jury panel for high school teacher excellence competitions or excellent class teacher competitions at the school level or higher.
đ) Participate in setting questions or grading high school student excellence exams at the school level or higher.
e) Participate in guiding or evaluating student science and technology competitions or research products at the school level or higher.
g) Engage in social activities, community service; attract organizations and individuals to participate in organizing teaching and educational activities for students.
In addition to the professional ethics standards of a third-grade high school teacher, a second-grade high school teacher must always set a good example in implementing regulations on teacher ethics.
3. Educational and Training Standards
a) Hold a bachelor's degree or higher in the field of teacher education for high school teachers.
In cases where there are not enough teachers with a bachelor's degree in the field of teacher education for certain subjects, they must hold a bachelor's degree in a relevant specialty and have a certificate in high school teacher vocational training according to the program issued by the Minister of Education and Training.
Article 4. Professional Competence Standards
a) Firmly grasp the Party's policies, guidelines, laws, regulations, and requirements of the industry and locality regarding secondary education and effectively implement them in assigned tasks.
b) Possess the ability to adjust teaching and education plans to fit the actual conditions of the school and locality; update and flexibly apply various teaching and educational methods to meet reform requirements and fit actual conditions.
c) Possess the ability to research and promptly update professional knowledge requirements; creatively apply various forms, methods, and select content for personal professional development and enhancement.
d) Possess the ability to evaluate or guide colleagues in applied pedagogical research; evaluate student scientific and technological research products at the school level or higher.
đ) Possess the ability to creatively apply various forms and methods to assess students' learning outcomes and progress towards developing their qualities and abilities.
e) Possess the ability to effectively apply psychological counseling, career guidance, and school social work measures suitable for different student groups in teaching and educational activities.
h) Be recognized as a grassroots model worker or excellent high school teacher or excellent class teacher at the school level or higher.
Article 5. Senior High School Teacher Grade I - Code V.07.05.13
1. Tasks
In addition to the duties of a Senior High School Teacher Grade II, a Senior High School Teacher Grade I must perform the following duties:
a) Participate in compiling or reviewing or selecting textbooks, local educational materials, or other teaching materials and materials for teacher training;
b) Serve as a speaker, share experiences or demonstrate teaching in training classes, professional development workshops for teachers at provincial level or higher, or participate in teaching on television;
c) Lead content for teacher training, guide colleagues in implementing policies and new content of the sector or specialized activities at provincial level or higher;
d) Participate in external evaluation or professional inspection work for teachers at provincial level or higher;
đ) Participate in organizing committees, judging panels, or question-setting committees in teacher competitions at provincial level or higher;
e) Participate in guiding or evaluating student competitions or scientific research products at provincial level or higher;
g) Participate in setting questions and grading in senior high school student excellence exams at provincial level or higher.
In addition to the professional ethics standards of a Senior High School Teacher Grade II, a Senior High School Teacher Grade I must be a model in terms of teacher ethics and encourage, support colleagues in adhering to teacher ethics regulations.
3. Educational and Training Standards
a) Hold a master's degree or higher in teacher education for senior high school teachers, or hold a master's degree or higher in a relevant field corresponding to the subject taught, or hold a master's degree or higher in educational management;
Article 4. Professional Competence Standards
a) Actively and proactively implement and promote the dissemination of Party and State policies, regulations, and requirements of the sector and locality regarding secondary education into assigned tasks;
b) Possess the ability to guide and support colleagues in planning and education; apply teaching methods and education approaches aimed at developing students' qualities and abilities; effectively carry out counseling and supporting activities for students in teaching and education;
c) Possess the ability to evaluate or guide colleagues in applied pedagogical research; guide and evaluate scientific research products of senior high school students at provincial level or higher;
d) Possess the ability to guide and support colleagues and share experiences in personal professional development to meet educational reform requirements;
đ) Apply and guide, support colleagues in using various forms and methods of assessment to evaluate students' learning outcomes and progress in a way that develops their qualities and abilities;
e) Apply and guide, support colleagues in effectively implementing psychological counseling, vocational guidance for students, and school social work, integrating these into teaching and educational activities;
h) Be recognized as a Model Worker at the ministry/bureau/sector/provincial level or higher; or receive commendation at the provincial level or higher; or be recognized as having achieved one of the titles: Excellent Teacher, Excellent Class Teacher at the provincial level or higher;
Chapter III
GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES
Article 6. Principles for Appointment to Professional Titles for Secondary School Teachers
1. The appointment of secondary school teachers to professional titles as stipulated in this Circular must be based on the current job positions held and meeting the criteria for professional titles as prescribed in Articles 3, 4, 5, and Article 7 of this Circular.
2. When appointing secondary school teachers from professional titles under the Joint Circular No. 23/2015/TTLT-BGDĐT-BNV dated September 16, 2015, issued by the Ministry of Education and Training and the Ministry of Home Affairs, which stipulates the code numbers and criteria for professional titles of public secondary school teachers (hereinafter referred to as Joint Circular No. 23/2015/TTLT-BGDĐT-BNV), to professional titles under this Circular, it shall not combine with promotion of professional titles.
3. The level of education obtained shall not be considered as a basis for appointing to a higher professional title than the one already successfully recruited for secondary school teachers newly hired.
Article 7. Cases of Appointment to Professional Titles for Secondary School Teachers
1. Civil servants who have been appointed to professional titles of secondary school teachers according to the Joint Circular No. 23/2015/TTLT-BGDĐT-BNV shall now be classified at corresponding professional titles as prescribed in Article 2 of this Circular.
2. Newly recruited secondary school teachers, after completing the probationary period as prescribed and being evaluated by the head of the public institution as meeting the requirements, shall be appointed to the corresponding professional title of secondary school teacher they were recruited for.
Article 8. Salary Classification
1. Civil servants appointed to professional titles of secondary school teachers as stipulated in this Circular shall apply the corresponding salary scale promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on salary regulations for civil servants, officials, and members of the armed forces, specifically as follows:
a) Secondary school teachers of Grade III, code number V.07.05.15, shall apply the salary coefficient of type A1 civil servant, ranging from coefficient 2.34 to 4.98;
b) Secondary school teachers of Grade II, code number V.07.05.14, shall apply the salary coefficient of type A2 civil servant, group A2.2, ranging from coefficient 4.0 to 6.38;
c) Secondary school teachers of Grade I, code number V.07.05.13, shall apply the salary coefficient of type A2 civil servant, group A2.1, ranging from coefficient 4.40 to 6.78.
2. The classification of salaries when appointing to professional titles shall be implemented according to the guidelines set out in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding the classification of salaries when upgrading, transferring, or changing types of civil servants and officials, and according to the current laws. When implementing new salary policies, the transition to new salaries shall be carried out according to the provisions of the Government.
Chapter IV
IMPLEMENTING PROVISIONS
1. Secondary school teachers holding a bachelor's degree shall be recognized as equivalent to the bachelor's degree specified in point a Clause 3 Article 3, point a Clause 3 Article 4 of this Circular.
2. In cases where secondary school teachers applying for or being reviewed for promotion to the professional title of Grade II secondary school teacher (code number V.07.05.14) have a master's degree before recruitment, meet the training qualification criteria for Grade II secondary school teachers, and have held the professional title of Grade III secondary school teacher (code number V.07.05.15) or equivalent for at least six years (excluding the probationary period), calculated up to the deadline for submitting application forms for the examination or review for promotion, then they shall be deemed to have met the required time in grade as stipulated in point i Clause 4 Article 4 of this Circular.
3. Certificates for training according to the criteria for professional titles of Grades I and II as stipulated in the Joint Circular No. 23/2015/TTLT-BGDĐT-BNV shall be recognized as equivalent to certificates for training according to the criteria for professional titles of Grades I and II as stipulated in this Circular.
4. Programs for training according to the criteria for professional titles of Grades I and II of secondary school teachers (issued together with Decision No. 2509/QĐ-BGDĐT dated July 22, 2016; Decision No. 2510/QĐ-BGDĐT dated July 22, 2016 of the Minister of Education and Training) shall continue to be implemented until replacement programs are available.
5. The requirement for certificates for training according to the criteria for professional titles of Grade III secondary school teachers as stipulated in point b Clause 3 Article 3 of this Circular shall apply to secondary school teachers recruited after this Circular takes effect.
6. For tasks assigned according to the professional titles of secondary school teachers that public secondary schools are not authorized to undertake or lack the conditions to implement, the head of the public secondary school shall report to the competent authority directly deciding on the conversion to related tasks.
Article 10. Implementation Organization
2. The heads of public secondary schools directly managing and utilizing civil servants shall be responsible for:
b) Report to the competent authority on the results of appointment and salary grading for secondary school teachers as prescribed;
c) Develop training and professional development plans for secondary school teachers; create conditions for secondary school teachers to be trained and professionally developed to meet the occupational title standards as prescribed by law;
d) Base on the duties of the occupational title rank to reasonably assign tasks to secondary school teachers, thereby leveraging their capabilities and enhancing their work efficiency;
3. The head of the competent authority managing public secondary schools shall be responsible for:
a) Approving the appointment plan for occupational titles and salary grading for secondary school teachers in public secondary schools under its jurisdiction; resolving issues within its authority during the process of appointing occupational titles and salary grading for secondary school teachers in public secondary schools under its jurisdiction;
b) Deciding within its authority or delegating the decision-making power for appointing to occupational title ranks and salary grading for secondary school teachers in public secondary schools according to the delegated authority;
c) Reporting the results of appointing occupational titles and salary grading for secondary school teachers in public secondary schools under its jurisdiction to the competent authority as prescribed;
Article 11. Effectiveness and Implementation Responsibility
1. This Circular takes effect from March 20, 2021.
2. The Director of the Office, the Director of the Department of Teachers and Educational Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government; the Directors of Departments of Education and Training, and the Directors of Departments of Education, Science and Technology in Bac Lieu Province are responsible for implementing this Circular;
3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the new documents.
4. This Circular replaces Joint Circular No. 23/2015/TTLT-BGDĐT-BNV dated September 16, 2015 issued by the Ministry of Education and Training and the Ministry of Home Affairs stipulating the code numbers and occupational title standards for public secondary school teachers;
5. Any difficulties encountered during implementation should be reported to the Ministry of Education and Training for consideration and resolution./.
