CIRCULAR
Issuing the "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders"

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to Decree No. 127/2007/ND-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Standards and Technical Regulations, and Decree No. 78/2018/ND-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/ND-CP;
Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
At the proposal of the Director General of the National Standardization, Metrology and Quality Control Department and the Head of the Legal Affairs Department;
The Minister of Science and Technology issues this Circular on issuing the "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders".
Article 1. Attached to this Circular is the National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders (QCVN 2:2021/BKHCN).
Article 2. Tar Content
1. As of January 1, 2024, helmets for motorcyclists and motorcycle riders imported and produced domestically must comply with the provisions of QCVN 2:2021/BKHCN before being circulated in the market.
2. It is encouraged that enterprises, organizations, and individuals producing and importing helmets for motorcyclists and motorcycle riders apply the provisions of QCVN 2:2021/BKHCN from the date this Circular takes effect.
Article 3. Effectiveness
1. This Circular shall take effect from August 1, 2021.
2. The following provisions shall cease to be effective from the date this Circular takes effect:
a) Decision No. 04/2008/QD-BKHCN dated April 28, 2008 of the Minister of Science and Technology on issuing and implementing the "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders";
b) Circular No. 02/2014/TT-BKHCN dated March 31, 2014 of the Minister of Science and Technology amending Article 2 of Decision No. 04/2008/QD-BKHCN dated April 28, 2008 of the Minister of Science and Technology on issuing and implementing the "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders".
Article 4. Transitional Provisions
Domestic-produced and imported helmets for motorcyclists and motorcycle riders that have been certified and declared compliant according to the provisions of QCVN 02:2008/BKHCN issued together with Decision No. 04/2008/QD-BKHCN dated April 28, 2008 of the Minister of Science and Technology and circulating in the market before January 1, 2024 may continue to circulate in the market until December 31, 2024.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Director of the General Department of Standardization, Metrology, and Quality Control is responsible for organizing guidance, dissemination, promotion, and implementation of this Circular.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-run cities, and related organizations and individuals are responsible for implementing this Circular.
3. During the implementation process, if any difficulties arise, agencies, organizations, and individuals shall promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
