CIRCULAR
Regulations on economic and technical norms for public services funded by the state budget concerning the maintenance, preservation, and use of the national measurement standards system; establishing calibration, verification, and testing procedures for measuring instruments and measurement standards
Pursuant to the Law on Measurement dated November 11, 2011;
Pursuant to the Law on Science and Technology dated June 18, 2013;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 86/2012/NĐ-CP dated October 19, 2012 of the Government detailing and guiding the implementation of certain provisions of the Law on Measurement;
Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;
Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Implementing Decision No. 2099/QĐ-TTg dated December 27, 2017 of the Prime Minister promulgating the list of public services funded by the state budget under the management of the Ministry of Science and Technology;
At the proposal of the Director General of the National Standardization, Metrology and Quality Control Department and the Head of the Legal Affairs Department;
The Minister of Science and Technology issues this Circular regulating economic and technical norms for public services funded by the state budget concerning the maintenance, preservation, and use of the national measurement standards system; establishing calibration, verification, and testing procedures for measuring instruments and measurement standards.
Article 1. Scope of Regulation
This Circular stipulates 31 (thirty-one) economic and technical norms for public services funded by the state budget concerning the maintenance, preservation, and use of the national measurement standards system; establishing calibration, verification, and testing procedures for measuring instruments and measurement standards, specifically:
1. Economic and technical norms for public services funded by the state budget concerning the maintenance, preservation, and use of the national measurement standards system for the laser He-Ne 633 nm frequency-stabilized iodine source, 206/WINTER Model 100 attached as Appendix I to this Circular;
2. Economic and technical norms for public services funded by the state budget concerning the maintenance, preservation, and use of the national measurement standards system for Flat Angle including two standards: National standard for small flat angle and national standard for full circle flat angle attached as Appendix II to this Circular;

Article 2. Applicability
1. Agencies and organizations using the state budget to implement the establishment of verification, calibration, and testing procedures for measuring instruments and national measurement standards.
2. Agencies and organizations designated to maintain national measurement standards using the state budget to implement public service activities for the maintenance, preservation, and use of the national measurement standards system.
3. State agencies, organizations, and individuals related to state management activities in measurement.
Article 3. Explanation of Terms
1. National measurement standard (hereinafter referred to as national standard) is the highest measurement standard of the country used to determine the value of other measurement standards within the field of measurement.
2. Verification, calibration, and testing procedures for measuring instruments and national measurement standards are technical measurement requirements established uniformly for state management in technical measurement by the General Department of Standardization, Measurement, and Quality Control.
3. Public service activities funded by the state budget for the maintenance, preservation, and use of the national measurement standards system; establishment of verification, calibration, and testing procedures for measuring instruments and national measurement standards are public services in the field of science and technology carried out by public institutions serving state management in measurement, guaranteed by the state with funding.
4. Economic and technical norms for public services funded by the state budget for the maintenance, preservation, and use of the national measurement standards system; establishment of verification, calibration, and testing procedures for measuring instruments and national measurement standards (hereinafter referred to as economic and technical norms) are necessary levels of expenditure concerning labor, machinery, equipment, and materials required to complete one unit of product (or a specific amount of work) under specific conditions serving state management.
5. Other terms shall be understood according to the provisions of Article 3 of the Law on Measurement dated November 11, 2011.
6. In this Circular, the following abbreviations have the meanings set forth below:

Article 4. Methods for building economic-technical norms
1. Establishing economic and technical norms applicable to the following legal regulations:
a) Law on Measurement dated November 11, 2011;
b) Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, employees, and armed forces;
c) Decree No. 38/2019/NĐ-CP dated May 9, 2019 of the Government stipulating the basic salary for cadres, civil servants, public officials, and armed forces personnel;
d) Circular No. 14/2013/TT-BKHCN dated July 12, 2013 of the Minister of Science and Technology on measurement for national standards.
đ) Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology, stipulating measurement regulations for Group 2 measuring instruments;
e) Circular No. 07/2019/TT-BKHCN dated July 26, 2019, issued by the Minister of Science and Technology, amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology, stipulating measurement regulations for Group 2 measuring instruments;
g) Circular No. 40/2017/TT-BTC dated April 28, 2017, issued by the Minister of Finance, stipulating travel expenses and conference regulations;
h) Joint Circular No. 55/2015/TTLT-BTC-BKHCN dated April 22, 2015, issued by the Minister of Finance and the Minister of Science and Technology; guiding the standards for construction, allocation of budget estimates, and final accounts for financial expenses related to scientific and technological tasks using state budget funds;
i) Circular No. 45/2018/TT-BTC dated May 7, 2018, issued by the Minister of Finance, guiding management regulations, depreciation, and amortization of fixed assets at agencies, organizations, units, and fixed assets entrusted by the State to enterprises for management without being considered part of the state capital component in enterprises.
2. Establishing standards not yet specified in detail
The method for establishing economic and technical standards that are not specifically regulated by normative legal documents shall be implemented according to Article 10 of Circular No. 21/2019/TT-BKHCN dated December 18, 2019, issued by the Minister of Science and Technology, stipulating the procedures for establishing economic and technical standards for public service activities funded by the state budget under the management of the Ministry of Science and Technology.
a) Comprehensive Statistical Method
Based on annual statistical data or during reporting periods (statistical data ensuring reliability and legality over a continuous period of three years prior to the time of establishing economic and technical standards) and based on practical experience in maintaining the national measurement standard system, developing calibration, verification, and testing procedures for measuring instruments and standards, and participating in international comparisons.
b) Standard Method
Based on technical standards and legal provisions regarding working hours and rest periods, labor standards for each job shall be established.
Based on technical standards and legal provisions, determine the consumption levels for each job, and establish standards for equipment and materials.
c) Analytical and Experimental Method
Implement survey, analysis, evaluation, experimental activities for each factor constituting the standards applied to tasks in maintaining, preserving, and using the national measurement standard system; develop calibration, verification, and testing procedures for measuring instruments and standards.
Article 5. Content of economic and technical norms
1. The content of economic and technical standards shall be implemented according to Article 14 of Circular No. 21/2019/TT-BKHCN dated December 18, 2019, issued by the Minister of Science and Technology, stipulating the procedures for establishing economic and technical standards for public service activities funded by the state budget under the management of the Ministry of Science and Technology, including the following component standards:
a) Labor norms which is the necessary labor consumption level of workers according to their expertise and profession to complete the implementation of a public service activity concerning the maintenance, preservation, and use of the national measurement standard system; developing calibration, verification procedures for measuring instruments and standards meeting the criteria and standards prescribed by competent authorities.
Labor standards are the direct and indirect labor time required to produce a product or to perform a specific task or work step and the labor time during product inspection and acceptance. In this context:
a1) Direct labor standards are the time required to complete a public service activity. The labor time consumption rate in the standard is calculated in man-hours;
a2) Indirect labor standards (management, support) are defined as ten percent (10%) of the direct labor standards.

b) Machine and equipment standards are the necessary usage time for each type of machine and equipment to complete a public service activity concerning the maintenance, preservation, and use of the national measurement standard system; developing calibration, verification, and testing procedures for measuring instruments and standards meeting the criteria and standards prescribed by competent authorities, measured in shifts.
c) Material norms is the consumption level of each type of raw materials, fuels, materials, and supplies necessary to complete the implementation of a public service activity meeting the criteria and standards prescribed by competent authorities. The recovery rate of materials applies Circular No. 45/2018/TT-BTC dated May 7, 2018, issued by the Minister of Finance, guiding management regulations, depreciation, and amortization of fixed assets at agencies, organizations, units, and fixed assets entrusted by the State to enterprises for management without being considered part of the state capital component in enterprises, and based on actual implementation in recent years of each type of material consumed to complete the steps of the work.
2. Total standards, applying standards
a) Economic and technical standards for public service activities funded by the state budget concerning the maintenance, preservation, and use of the national measurement standard system; developing calibration, verification, and testing procedures for measuring instruments and standards are the maximum costs and consumption of labor, equipment, and materials to complete a unit of product or a volume of work meeting the criteria and standards prescribed by competent authorities.
b) Economic and technical standards are the necessary consumption standards of labor, machines, equipment, and materials to complete a unit of product or a specific volume of work according to the procedures for maintaining, preserving, and using the national measurement standard system; calibration, verification, and testing procedures for measuring instruments and standards. Economic and technical standards serve to build budgets and unit prices for services using funds provided through state orders, assigned tasks to provide public services based on output quality or tendered provision of public services.
3. Agencies and organizations implementing the maintenance, preservation, and use of the extended national measurement standards system (outside those national standards specified in this Circular) shall base their actions on technical requirements; actual conditions and circumstances of the agencies, organizations, and regions to apply the entire or part of the norms prescribed in this Circular, except where otherwise provided.
Article 6. Basis for establishing economic-technical norms
The economic-technical norms stipulated in this Circular are established based on 31 approved service implementation procedures, specifically:
1. Service implementation procedure for maintaining, preserving, and using the national measurement standard source laser wavelength He-Ne 633nm frequency-stabilized by iodine, 206/WINTER Model 100;
2. Service implementation procedure for maintaining, preserving, and using the national measurement standard system for Flat Angle including two standards: Small Flat Angle National Standard and Full Circle Flat Angle National Standard;
3. Service implementation procedure for maintaining, preserving, and using the national measurement standard weight standard 1kg, VIE 982100/2;
4. Service implementation procedure for maintaining, preserving, and using the national measurement standard hardness tester HNG-250 scale HRC, 030-78/HNG-250;
5. Service implementation procedure for maintaining, preserving, and using the national measurement standard force gauge up to 100 kN, V03.TB1.20/100 kN/1000 kN-LA-KS;
6. Article 7. Implementation Organization
The Director of the General Department of Standards, Metrology and Quality has the responsibility to organize guidance, dissemination, promotion, and implementation of this Circular.
Article 8. Implementation clause
This Circular takes effect from July 15, 2022.
The Minister, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals are responsible for implementing this Circular./.
