CIRCULAR

GUIDELINES ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF SPORT TRAINING AND COMPETITION CENTERS OF PROVINCES AND CITIES UNDER THE CENTRAL GOVERNMENT

Pursuant to the Law on Physical Culture and Sports dated November 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Law on Physical Culture and Sports dated June 14, 2018;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

Pursuant to Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;

At the proposal of the Director-General of the General Department of Physical Training and Sport;

The Minister of Culture, Sports and Tourism issues this Circular guiding the functions, tasks, powers and organizational structure of Sport Training and Competition Centers of provinces and cities directly under the Central Government.

Article 1. Scope of Regulation and Applicability

1. This Circular guides the functions, tasks, powers and organizational structure of Sport Training and Competition Centers of provinces and cities directly under the Central Government (hereinafter referred to as Sport Training and Competition Centers at provincial level).

2. This Circular applies to Sport Training and Competition Centers at provincial level; agencies, organizations, and individuals establishing, managing, and related to the activities of Sport Training and Competition Centers at provincial level.

Article 2. Position and Functions

1. Sport Training and Competition Centers at provincial level are public service units under the Department of Culture, Sports and Tourism, the Department of Culture and Sports of provinces and cities directly under the Central Government with the function of selecting, training, and coaching sports athletes; organizing physical exercise, performance, and sports competitions; coordinating to guide the implementation of mass sports movements for all people; implementing public service provision and serving state management according to the provisions of the law.

2. Sport Training and Competition Centers at provincial level have legal personality, separate seals, bank accounts, and headquarters as prescribed by law.

Article 3. Duties and Authorities

Sport Training and Competition Centers at provincial level shall perform the following tasks and powers:

1. Developing programs and plans of activities; medium-term, short-term, and annual development plans of the Center to be submitted to competent authorities for approval and implementation after approval.

2. Cooperating with the specialized department managing physical culture and sports under the Department of Culture, Sports and Tourism, the Department of Culture and Sports to advise the leadership of the Department to submit to the Provincial People's Committee or Municipal People's Committee long-term, medium-term projects and plans, and directions for the development of physical culture and sports in the locality.

3. Organizing selection, specialized training, coaching, and management of athletes in teams, young athletes, and talented sports athletes according to approved plans by competent authorities.

4. Organizing, coordinating to organize cultural studies and moral education for athletes, health care, examination, and treatment of injuries; implementing policies and regulations for coaches and athletes as prescribed.

5. Implementing political and ideological education and organizing cultural activities to ensure spiritual life for athletes.

6. Organizing, coordinating to organize sports performances and domestic and international sports competitions after approval by competent authorities.

7. Organizing, coordinating to organize training and upgrading the professional skills of sports instructors, coaches, referees, and other personnel involved in local physical culture and sports activities according to approved plans by competent authorities.

8. Jointly operating with organizations and individuals to exploit facilities, equipment, and organize sports services according to the provisions of the law.

9. Applying science and technology, sports medicine to serve training work; coordinating research to serve athlete selection, training, and improving sports achievements.

10. Cooperating, exchanging professional knowledge and experience in physical culture and sports with relevant domestic and international units according to the provisions of the law.

11. Managing the organizational structure, human resources, finance, assets, and facilities and equipment assigned according to the provisions of the law.

12. Performing other tasks assigned by the Director of the Department of Culture, Sports and Tourism, the Director of the Department of Culture and Sports according to the provisions of the law.

Article 4. Organizational Structure

1. The leadership of Sport Training and Competition Centers at provincial level consists of a Director and Deputy Directors as prescribed; the Director of the Center is responsible before the Director of the Department of Culture, Sports and Tourism, the Director of the Department of Culture and Sports, and the law for all activities of the Center; Deputy Directors of the Center are responsible before the Director of the Center and the law for the areas of work assigned to them.

2. Professional and technical organizations:

Sport Training and Competition Centers at provincial level shall have administrative and general affairs departments and specialized departments to implement the tasks as prescribed in Article 3 of this Circular.

Based on the functions, tasks, powers, number of staff, nature, characteristics, and actual conditions, the Director of Sport Training and Competition Centers at provincial level shall propose specific organizational structures of the Center to competent authorities according to the provisions of the law.

3. The establishment of departments and the number of deputy heads of the heads of departments within Sport Training and Competition Centers at provincial level shall be implemented according to point d, Clause 1 and Clause 3, Article 6 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, restructuring, and dissolution of public service units.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The General Department of Physical Culture and Sports is responsible for guiding, urging, and inspecting the implementation of this Circular.

2. The Director of the Department of Culture, Sports and Tourism, the Department of Culture and Sports shall establish the functions, tasks, powers, and organizational structure of Sport Training and Competition Centers at provincial level based on the provisions of this Circular and submit them to competent authorities for promulgation according to the provisions of the law.

Article 6. Implementation Provisions

1. This Circular takes effect from September 10, 2022.

2. During the implementation process, if there are difficulties or obstacles, they are requested to reflect them to the Ministry of Culture, Sports and Tourism (through the General Department of Physical Training and Sports) for consolidation and reporting to the Minister for consideration, amendment, and supplementation to ensure appropriateness./.
