Providing for the suspension of the implementation of Clause 1 Article 7 and Clause 2 Article 75 of Circular No. 02/2022/TT-BTNMT dated October 10, 2022 issued by the Minister of Natural Resources and Environment detailing certain provisions of the Law on Environmental Protection

Pursuant to the Law on Legislative Decrees promulgated on June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Decrees promulgated on June 18, 2020;

Pursuant to the Law on Environmental Protection promulgated on November 17, 2020;

Pursuant to Decision No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Law on Environmental Protection;

Pursuant to Decision No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Environmental Pollution Control Department;

The Minister of Natural Resources and Environment issues this Circular providing for the suspension of the implementation of Clause 1 Article 7 and Clause 2 Article 75 of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 issued by the Minister of Natural Resources and Environment detailing certain provisions of the Law on Environmental Protection.

Article 1. Suspension of Effectiveness

The implementation of Clause 1 Article 7 and Clause 2 Article 75 of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 issued by the Minister of Natural Resources and Environment detailing certain provisions of the Law on Environmental Protection is suspended.

Article 2. Effective Date

1. This Circular takes effect from the date of issuance.

2. The period during which the contents prescribed in Article 1 of this Circular are suspended shall be implemented from the effective date of this Circular until the effective date of new legislative regulations governing such matters.

Article 3. Implementation

1. The Director of the Environmental Pollution Control Department is responsible for guiding and implementing this Circular.

2. Provincial People's Committees, Departments of Natural Resources and Environment under provincial-level cities directly under the Central Government, and relevant organizations and individuals are responsible for enforcing this Circular./.
