Regulations on the Statistical Indicators System for the Labor - Invalids and Social Affairs Sector

 BASED ON THE STATISTICAL LAW dated November 23, 2015;

Pursuant to the Law Amending and Supplementing Certain Articles and the National Statistical Indicator Catalogue of the Statistics Law on November 12, 2021;

Pursuant to Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain articles of the Statistics Law;FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSPursuant to Decree No. 94/2022/NĐ-CP dated November 7, 2022 of the Government stipulating the contents of statistical indicators within the national statistical indicator system and the process of compiling gross domestic product indicators, provincial gross domestic product indicators, and central city gross domestic product indicators;

Pursuant to Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

The Minister of Labor - Invalids and Social Affairs promulgates this Circular regulating the statistical indicator system for the Labor - Invalids and Social Affairs sector.

At the proposal of the Director of the Department of Planning and Finance;

Article 1. Issued along with this Circular is the Statistical Indicator System for the Labor - Invalids and Social Affairs sector.

 1. The Statistical Indicator System for the Labor - Invalids and Social Affairs sector consists of a set of statistical indicators reflecting the main results of state management activities in the Labor - Invalids and Social Affairs sector aimed at serving the evaluation, forecasting of situations, strategic planning, policy formulation, and the development of economic and social plans for the country and the Labor - Invalids and Social Affairs sector during each period; meeting the information needs of organizations and individuals requiring information from the Labor - Invalids and Social Affairs sector.

2. The Statistical Indicator System for the Labor - Invalids and Social Affairs sector includes: the Statistical Indicator System Catalogue and the Content of Statistical Indicators detailed in Appendix I and Appendix II attached to this Circular.

1. The Department of Planning and Finance shall be responsible for organizing and coordinating with relevant units:

Article 2. Implementation

- Developing and submitting to the Ministry for issuance the Statistical Reporting System for the Labor - Invalids and Social Affairs sector, compiling statistical data within the statistical indicator system of the Labor - Invalids and Social Affairs sector.

- Guiding units in building specialized databases, applying information technology in collecting, compiling, exploiting, and providing information in specialized databases to serve state statistical work.

2. Heads of units under the Ministry, Directors of Provincial Departments of Labor - Invalids and Social Affairs, and heads of related units shall organize the collection, compilation, and reporting of statistical information to the Ministry of Labor - Invalids and Social Affairs.

1. This Circular takes effect from June 21, 2024.

2. This Circular replaces Circular No. 01/2018/TT-BLDTBXH dated February 27, 2018 issued by the Minister of Labor - Invalids and Social Affairs regarding the Statistical Indicator System for the Labor - Invalids and Social Affairs sector.

Article 3. Effectiveness

3. In the course of implementation, if there are difficulties, units shall report to the Ministry of Labor - Invalids and Social Affairs (through the Department of Planning and Finance) for consolidation and resolution.

Unemployment insurance participants supported for vocational training are those individuals who have been decided by the Director of the Department of Labor, Invalids, and Social Affairs to be supported for vocational training according to regulations.

1. Concept, content, calculation method

Workers going to work abroad for a limited time under contracts are Vietnamese citizens residing in Vietnam, meeting all conditions stipulated by Vietnamese law and the law of the country accepting workers, going to work abroad under contracts for sending workers to work abroad or individual contracts.

Contract for sending workers to work abroad is a written agreement between enterprises, public institutions and workers regarding the rights and obligations of each party in sending workers to work abroad in the following forms:

- Contracts for sending workers to work abroad with enterprises operating the service of sending workers to work abroad, public institutions permitted to operate the service of sending workers to work abroad;

- Contracts for sending workers to work abroad with enterprises that win bids, accept bids or organizations and individuals investing abroad who send workers to work abroad;

- Contracts for sending workers to work abroad in the form of advanced skill training with enterprises sending workers abroad for advanced skill training;

Individual contract is the direct written agreement between the worker and the foreign party regarding the worker's employment abroad.

110. Number of workplace accidents

1. Concept, content, calculation method

Workplace accidents are incidents causing injury to any part or function of the body or resulting in death of a worker during the course of work, closely related to the performance of job duties, including during rest breaks, meal times, supplementary food provision periods, menstrual hygiene, bathing, breastfeeding, using the restroom, and preparation and conclusion of work at the workplace.

Workplace accidents are classified as follows:

- Fatal workplace accidents;

- Serious workplace accidents (serious injuries);

- Minor workplace accidents (minor injuries).

The victim of a workplace accident is the person injured or killed in workplace accidents. A fatal workplace accident is an accident where the victim dies immediately at the scene, on the way to emergency care, during emergency care, during treatment, or due to the recurrence of the original injury caused by the workplace accident (as concluded in the forensic examination report).

111. Number of people involved in workplace accidents

1. Concept, content, calculation method

1. Concept, content, calculation method

A strike is a temporary, voluntary, and organized cessation of work by workers aimed at achieving demands during the resolution of labor disputes, organized and led by a trade union representing workers as one party in collective labor disputes.

Labor dispute is a dispute arising between parties in a labor relationship concerning rights, obligations, and interests.

Labor disputes include individual labor disputes between workers and employers and collective labor disputes between groups of workers and employers.

Group of workers is an organized group of workers employed by the same employer or within a part of the organizational structure of the employer.

Collective labor dispute over rights is a dispute between a group of workers and an employer arising from different interpretations and implementations of labor laws, collective labor agreements, labor regulations, rules, and other lawful agreements.

Collective labor dispute over benefits is a labor dispute arising from a group of workers' demand for establishing new labor conditions compared to those stipulated in labor laws, collective labor agreements, labor regulations, or other lawful rules and agreements during negotiations between the group of workers and the employer.

Number of strike participants are workers employed in a business or a part of a business who have registered to participate in a strike to resolve collective labor disputes.

201. Number of vocational education institutions

1. Concept, content, calculation method

1.1. Vocational education institutions include: Vocational training centers; Secondary vocational schools; Higher vocational colleges. Vocational education institutions are organized in the following forms:

- Public vocational education institution is a vocational education institution owned by the State, invested in and built by the State.

- Private vocational education institution is a vocational education institution owned by social organizations, social-professional organizations, private economic organizations, or individuals, invested in and built by these organizations or individuals.

- Foreign-invested vocational education institution includes vocational education institutions with 100% foreign capital; joint venture vocational education institutions between domestic investors and foreign investors.

1.2. Entities engaged in vocational education activities include:

- Enterprises registered to conduct vocational education at the primary level. Enterprises include those established and operating under the Enterprise Law, cooperatives established and operating under the Cooperative Law, and other economic organizations with legal personality under the Civil Code.

- Vocational training centers - continuing education centers participating in vocational education activities.

1.3. Administrative body managing public vocational education institutions

- The administrative body managing public higher vocational colleges is the agency or organization entrusted to manage the college according to the law, including:

+ Higher vocational colleges directly under ministries, ministerial-level agencies, government agencies, central agencies of political-social organizations;

+ Higher vocational colleges directly under units under ministries, ministerial-level agencies, government agencies, central agencies of political-social organizations;

+ Higher vocational colleges directly under provincial People's Committees (referred to collectively as provincial People's Committees).

- The administrative body managing public secondary vocational schools is the agency or organization entrusted to manage the school according to the law, including:

+ Secondary vocational schools directly under ministries, ministerial-level agencies, government agencies, central agencies of political-social organizations;

+ Secondary vocational schools directly under units under ministries, ministerial-level agencies, government agencies, central agencies of political-social organizations;

1. Concept, content, calculation method

Teachers in vocational education entities include theoretical teachers, practical teachers, or teachers who teach both theory and practice.

Teachers in vocational training centers and secondary vocational schools are called teachers; teachers in higher vocational colleges are called lecturers. Teacher titles in vocational education institutions include teacher, senior teacher, advanced teacher; lecturer, senior lecturer, advanced lecturer.

National Vocational Education Administration

203. Number of students, pupils, and trainees in the vocational education system

1. Concept, content, calculation method

1.1. Vocational learners are individuals currently studying vocational education programs at vocational education entities, including college students in college training programs; secondary vocational school students and primary vocational school students; regular training program trainees as stipulated in the Vocational Education Law.

Vocational education is a level of the national education system aimed at training primary, secondary, and higher vocational levels, and other vocational training programs for workers, meeting the demand for direct workforce in production, business, and services; it is implemented in two forms: regular training and continuous training.

(1) Regular training is a form of training conducted through full-time courses throughout the period by vocational education institutions and vocational education activity entities (university education institutions, enterprises registered to conduct vocational education activities) to train primary, secondary, and higher vocational levels.

(2) Continuous training is a form of training that combines work and study, distance learning, or self-study with guidance for primary, secondary, and higher vocational training programs, and other vocational training programs, flexibly implemented regarding curriculum, time, method, and location of training, suitable for the needs of learners. Continuous training is carried out for the following programs:

- Continuous training programs according to learners' requirements; programs for updating, enhancing knowledge and vocational skills;

- Apprenticeship training programs, trade transmission, and practice programs;

- Technology transfer programs;

- Other training programs with a duration of less than three months;

- Programs for obtaining a college, intermediate, or primary certificate through continuous training;

1.2. Duration of Training

The duration of primary level training is from three months to less than one year of study.

The duration of intermediate level training under the academic system for individuals holding a junior high school graduation certificate or higher is from one to two years of study depending on the major or profession being trained; the duration of intermediate level training under the modular or credit accumulation method is the time required to accumulate the specified number of modules or credits for each training program.

The duration of college level training under the academic system is from two to three years of study depending on the major or profession being trained for individuals holding a high school graduation certificate; from one to two years of study depending on the major or profession being trained for individuals holding an intermediate level certificate in the same field or profession and a high school graduation certificate or having completed and passed the required amount of general high school knowledge; the duration of college level training under the modular or credit accumulation method is the time required to accumulate the specified number of modules or credits for each training program for individuals holding a high school graduation certificate or having completed and passed the required amount of general high school knowledge.

1. Concept, content, calculation method

Rural laborers are those belonging to the workforce and working within the rural economic system;

Vocational training is a right and duty of rural workers aimed at creating employment, changing professions, increasing income, and improving the quality of life.

Rural workers are supported for vocational training according to a policy that divides them into three groups, including:

- Group 1:

+ Individuals entitled to preferential policies for those who have contributed to the revolution and their children;

+ Ethnic minorities;

+ Individuals from households whose agricultural land has been reclaimed;

1. Concept, content, calculation method

Those currently receiving monthly preferential allowances for persons contributing to the revolution include those who have contributed to the revolution and their dependents as follows:

+ Engaged in grassroots activities during the period from January 1, 1945 to the date of the local uprising and continued to participate in one of the two resistance wars, and when engaged in grassroots activities during the period from January 1, 1945 to the date of the local uprising were Village Secretary, Chairman, Director of the Viet Minh, Secretary of the National Salvation League of Farmers, Secretary of the National Salvation League of Youth, Secretary of the National Salvation League of Women, Secretary of the National Salvation League of Children at the village level or equivalent; team leader, group leader, or squad leader of self-defense combat teams, propaganda liberation teams, youth salvation teams, farmer salvation teams, women's salvation teams, child salvation teams in areas where the mass revolutionary organization had not yet formed at the village level; individuals who were admitted to the Viet Minh organization and then assigned to stay in the locality to develop revolutionary bases; individuals who participated in the August 1945 revolution and held one of the leadership positions specified in this point or participated in revolutionary organizations or armed forces at the district level or higher from August 19, 1945 to August 31, 1945;

+ Individuals who were active in the revolutionary movement as specified in points a and b of this clause did not continue to participate in one of the two resistance wars due to reduction in force, demobilization, or lack of health.

- A war invalid is an officer, professional soldier, non-commissioned officer, or soldier in the People's Army, or an officer, non-commissioned officer, or soldier in the People's Police who has been injured with a disability rate of 21% or more and has been recognized by competent authorities as a war invalid, granted a "War Invalid Certificate" and a "War Invalid Medal".

- A person enjoying policies similar to those for war invalids is someone who is not an officer, professional soldier, non-commissioned officer, or soldier in the People's Army, or an officer, non-commissioned officer, or soldier in the People's Police, but has been injured with a disability rate of 21% or more and has been recognized by competent authorities as a person enjoying policies similar to those for war invalids, granted a "Certificate for Persons Enjoying Policies Similar to Those for War Invalids". Type B war invalids are military personnel or police officers who have been injured with a disability rate of 21% or more while training or working and were recognized by competent authorities before December 31, 1993.

- A veteran with a disease is an officer, professional soldier, non-commissioned officer, or soldier in the People's Army, or an officer, non-commissioned officer, or soldier in the People's Police who has contracted a disease with a disability rate of 61% or more while performing urgent and dangerous tasks and does not meet the conditions for retirement benefits. Such individuals will be granted a "Veteran with Disease Certificate" when they leave service in the People's Army or People's Police.

- A Mother Heroic in Vietnam is a person awarded or posthumously awarded the title "Mother Heroic in Vietnam" according to the Ordinance on National Honorary Titles "Mother Heroic in Vietnam", specifically:

+ Having two children who are martyrs and having a husband or being a martyr themselves;

+ Having two children where both children are martyrs or only one child who is a martyr;

+ Having three or more children who are martyrs;

+ Having one child who is a martyr, a husband who is a martyr, and being a martyr themselves.

- Heroes of the People's Armed Forces, Labor Heroes during the Resistance War currently receiving monthly allowances are:

+ Individuals awarded the title "Hero of the People's Armed Forces" by the State according to the provisions of the law;

+ Individuals honored as Labor Heroes during the Resistance War for outstanding achievements in labor and production serving the resistance.

- A person involved in the resistance who was exposed to toxic chemicals is someone who worked, fought, or served in combat from August 1, 1961 to April 30, 1975 in areas where the US military used chemical toxins in the B, C, K battlefields and certain locations in Vinh Linh district, Quang Tri province, and subsequently developed diseases related to exposure to chemical toxins with a disability rate of 21% or more, leading to birth defects, disabilities, or infertility, and has been granted a "Certificate for Persons Involved in the Resistance Exposed to Toxic Chemicals" by competent authorities.

- A person engaged in revolutionary activities, resistance, national defense, or international duties who was captured and imprisoned by the enemy is someone who participated in revolutionary activities, resistance, national defense, or international duties, was captured and imprisoned by the enemy without disclosing harmful information to the revolution or resistance, and did not become a collaborator for the enemy, and has been recognized by competent authorities as such.

+ In cases where a war invalid, veteran with a disease, or a person enjoying policies similar to those for war invalids with a disability rate of 61% or more dies, their relatives, including the father, mother, spouse of appropriate age as stipulated in Clause 2 of Article 169 of the Labor Code, underage children, or adult children still in education or severely disabled, are entitled to receive a pension.

+ In cases where a person involved in the resistance who was exposed to toxic chemicals with a disability rate of 61% or more dies, their relatives, including the father, mother, spouse of appropriate age as stipulated in Clause 2 of Article 169 of the Labor Code, underage children, or adult children still in education or severely disabled, are entitled to receive a pension.

Persons eligible for one-time preferential benefits include:

Due to dependence on drugs, drug addicts often resort to criminal activities to satisfy their addiction.

The number of drug addicts discovered and managed through files includes those caught in the act of illegally using drugs by the police, documented in records, and managed, or those voluntarily reported by drug addicts or their families and managed by the People's Committee of the commune.

The number of drug addicts undergoing rehabilitation is the total number of drug addicts who undergo treatment measures (voluntary or compulsory) at home and in the community or at rehabilitation centers to quit drugs and recover physically and mentally.

The number of drug addicts under post-rehabilitation management is those who have completed rehabilitation at Social Rehabilitation Centers and must comply with post-rehabilitation management measures at post-rehabilitation management centers or at their place of residence.

The number of drug addicts receiving vocational training and job placement is the number of individuals who have completed rehabilitation and post-rehabilitation management and received vocational training at vocational education institutions; obtained stable employment and income.
