CIRCULAR

Amending and supplementing some articles of Circular No.01/2022/TT-UBDT dated May 26, 2022 issued by the Minister, Head of the Committee for Ethnic Minorities stipulating the monitoring and evaluation procedures for implementing the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 

On the basis of Law on Public Investment dated November 29, 2024;

Pursuant to Decree No. 41/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Ethnic Affairs and Religion; Decree No. 114/2025/NĐ-CP dated June 3, 2025 of the Government amending Clause 12, Article 3 of Decree No. 41/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Ethnic Affairs and Religion;

Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating the management mechanism and organization of implementation of national target programs and Decree No. 38/2023/NĐ-CP dated June 24, 2023 of the Government amending and supplementing some articles of Decree No. 27/2022/NĐ-CP;

Implementing Decision No. 1719/QĐ-TTg dated October 14, 2021 of the Prime Minister approving the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025; Decision No. 920/QĐ-TTg dated May 14, 2025 of the Prime Minister adjusting certain contents of the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025;

At the proposal of the Director of the National Office for Ethnic Minorities and Mountainous Areas;

The Minister of Ethnic Affairs and Religion issues this Circular to amend and supplement some provisions of Circular No. 01/2022/TT-UBDT dated May 26, 2022 of the Committee for Ethnic Minorities stipulating the monitoring and evaluation procedures for implementing the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025.

Article 1. Amend and adjust some provisions of Circular No. 01/2022/TT-UBDT dated May 26, 2022 issued by the Minister, Head of the Committee for Ethnic Minorities stipulating the monitoring and evaluation procedures for implementing the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 01/2022/TT-UBDT) as follows:

1. Clause 2, Article 2 shall be amended and supplemented as follows:

"2. The project owner, sub-project owner, component content owner is the agency or organization entrusted to manage one or more projects, sub-projects, component contents under the Program; including the project owner, sub-project owner, component content owner at the central level mentioned in Decision No. 1719/QĐ-TTg, Decision No. 920/QĐ-TTg and the project owner, sub-project owner, component content owner at the provincial and commune levels within their scope and area of management."

2. Points b, d, Clause 2 and Clause 3, Article 3 shall be amended and supplemented as follows:

a) Points b, d, đ Clause 2, Article 3

"b) Collecting and compiling information and reports at the commune level

The People's Committee of the commune collects and compiles information on projects and activities managed by the commune and implemented by units within the commune according to the corresponding forms in Appendix No. 02, and sends it to the People's Committee of the province (through the Department of Ethnic Minorities and Religion or the agency responsible for state management functions regarding ethnic affairs and religious beliefs at the provincial level) before September 15 of the implementation year, updating and supplementing data from the previous year before January 31 of the following year.

d) Compiling information and reports at the provincial level

The provincial project owner compiles annual information on projects and activities managed by them within the province according to the form in Appendix No. 02 and sends it to the provincial project owner, sub-project owner, component content owner before September 15 of the implementation year, updating and supplementing data from the implementation year before January 31 of the following year.

The provincial project owner, sub-project owner, component content owner compiles information, prepares reports on the results of implementing the program components within their jurisdiction and organized implementation within the province according to Appendix No. 03 and sends it to the central-level project owner, sub-project owner, component content owner, Department of Ethnic Minorities and Religion (or the agency responsible for state management functions regarding ethnic affairs and religious beliefs at the provincial level) before September 20 of the implementation year; simultaneously updating and supplementing data from the implementation year according to Appendix No. 01 before February 5 of the following year.

The Provincial People's Committee compiles information from communes and provincial project owners, sub-project owners, component content owners, prepares annual reports on the results of implementing the program within their delegated management scope and organized implementation within the province according to Appendix No. 03 and sends it to the Ministry of Ethnic Affairs and Religion (National Office for Ethnic Minorities and Mountainous Areas) before September 25 of the implementation year; simultaneously updating and supplementing data from the implementation year according to Appendix No. 01 before February 10 of the following year."

b) Clause 3, Article 3

"3. Information, data, and reports on the results of implementing the program at the commune level are shared between the lead agencies receiving reports at the provincial level without requiring communes to submit multiple reports to higher-level management agencies."

3. Points a, c, đ Clause 2, Article 5 shall be amended and supplemented as follows:

"a) Collecting and compiling information and reports at the commune level

The People's Committee of the commune collects and compiles information on projects and activities managed by the commune and implemented by units within the commune according to the corresponding forms in Appendix No. 02 and sends it to the People's Committee of the province (through the Department of Ethnic Minorities and Religion or the agency responsible for state management functions regarding ethnic affairs and religious beliefs at the provincial level).

c) Compiling information and reports at the provincial level

The project owner, sub-project owner, and provincial component content owner shall compile information and prepare reports on the implementation of the project, sub-project, and component content within their provincial management scope according to Model 04, and submit them to the project owner, sub-project owner, central-level component content owner, Department of Ethnic Minorities and Religion (or the provincial-level state management agency for ethnic affairs and beliefs and religions).

The Department of Ethnic Minorities and Religion (or the provincial-level state management agency for ethnic affairs and beliefs and religions) shall compile information from the commune level and the project owners, sub-project owners, and provincial component content owners, prepare a report on the implementation of the provincial program according to Model 04, submit it to the provincial People's Committee for approval, and send it to the Ministry of Ethnic Minorities and Religion (National Office for Ethnic Minorities and Mountainous Areas); simultaneously update mid-term and final data in Model 01.

d) The deadline for submitting the report on the implementation of the program at the commune, provincial, and central levels shall be in accordance with the requirements of the competent authority.

4. Point b Clause 2 Article 8 is amended and supplemented as follows:

"b) Provincial departments and agencies (project owners, sub-project owners, provincial component content owners) shall guide the People's Committees at the commune level in implementing supervision and evaluation work according to their functions and management scope.

Summarize the results of supervising and evaluating the implementation of projects, sub-projects, and component contents under their main management, and submit reports to the Department of Ethnic Minorities and Religion, the provincial People's Committee, the Provincial Steering Committee for National Target Programs, and relevant central ministries and agencies according to their functions and management scope."

5. Replace some phrases in Circular No. 01/2022/TT-UBDT as follows:

a) Replace the phrase "Committee for Ethnic Minorities" with "Ministry of Ethnic Minorities and Religion" in Clause 1 Article 2; Point d, đ Clause 2 Article 3; Point c, d Clause 2 Article 5; Clause 1, 2, 5 Article 7; Point a, b Clause 1, Point a Clause 2 Article 8; Clause 2 Article 10.

b) Replace the phrase "Ministry of Planning and Investment" with "Ministry of Finance" in Point đ Clause 2 Article 3; Point d Clause 2 Article 5; Point a Clause 1 Article 8.

c) Replace the phrase "Program Coordination Office" with "National Office for Ethnic Minorities and Mountainous Areas" in Point d, đ Clause 2 Article 3; Point c, d Clause 2 Article 5; Clause 5 Article 7; Point b Clause 1 Article 8; Clause 2 Article 10.

d) Replace the phrase "Ethnic Minority Department" with "Department of Ethnic Minorities and Religion" in Points c, d Clause 2 Article 3; Point b, c Clause 2 Article 5; Point a, b Clause 2 Article 8.

6. Repeal Point c Clause 2 Article 3, Point b Clause 2 Article 5, and Point c Clause 2 Article 8.

Article 2. Adjust the method of recording data into tables in the attached Appendix of Circular No. 01/2022/TT-UBDT

For data fields (rows, columns) in the tables in the attached Appendix of Circular No. 01/2022/TT-UBDT, which were previously assigned to the district level for compilation and reflection, they are now left blank, and the provincial level is responsible for compiling and reporting data from the commune level, while the central level compiles and reports data from the provincial level.

Article 3. Implementation Provisions

1. This Circular shall take effect from the date of issuance.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, the provisions of the amended, supplemented, or replacing documents shall apply.

3. If there are difficulties during implementation, please promptly reflect them to the Ministry of Ethnic Minorities and Religion for study and resolution./.
