CIRCULAR

Issuing Economic and Technical Standards

in cooperative search and rescue operations at sea anti-corruption; search and rescue at sea

Pursuant to the Vietnam Maritime Code on November 25, 2015;

1. Amending Clause 2 Article 2 as follows:

Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of public goods and services using state budget funds from regular budgets;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of Science, Technology and Environment Department and the Director of Vietnam Maritime Administration;

The Minister of Transport issues this Circular on Economic and Technical Standards in cooperative search and rescue operations at sea.

Article 1. Scope of Regulation

This Circular promulgates Economic and Technical Standards in cooperative search and rescue operations at sea, comprising four sets of economic and technical standards as follows:

1. Set 1. Economic and Technical Standards for the regular maintenance of maritime search and rescue vessels; cooperative search and rescue operations at sea.

2. Set 2. Economic and Technical Standards for equipment maintenance serving search and rescue operations; energy consumption of communication devices serving search and rescue operations; information transmission channels serving search and rescue operations.

3. Set 3. Economic and Technical Standards for spare parts and replacement materials of maritime search and rescue vessels and reserve materials and spare parts of maritime search and rescue vessels.

4. Set 4. Economic and Technical Standards for fuel consumption serving cooperative search and rescue operations.

Article 2. Applicability

The economic and technical standards issued with this Circular shall apply to the Vietnam Maritime Administration, the Vietnam Maritime Search and Rescue Coordination Center, and other organizations and individuals involved in cooperative search and rescue operations at sea.

Article 3. Implementation Provisions

1. This Circular takes effect from March 1, 2025.

2. The following Circulars are hereby abolished: Circular No. 93/2015/TT-BGTVT dated December 31, 2015 of the Minister of Transport on Economic and Technical Standards for fuel consumption of vessels participating in maritime search and rescue operations and Circular No. 35/2018/TT-BGTVT dated May 31, 2018 of the Minister of Transport on Economic and Technical Standards for maritime search and rescue operations.

3. Transitional Provisions:

a) For budgets of assigned tasks approved before the effective date of this Circular but not yet tendered or requested, adjustments and updates to the tasks and budgets shall be made according to the economic and technical standards issued with this Circular.

b) For budgets of assigned tasks approved before the effective date of this Circular and already tendered or requested, they shall be implemented in accordance with the laws in force at the time of tendering or requesting.
