which have been amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017
On the basis of Decree No. 127/2007/NĐ-CP dated August 1, 2007, issued by the Government detailing a number of articles of the Law on Standards and Technical Regulations;
The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology on the announcement of conformity to standards, announcement of conformity to technical regulations, and methods for assessing compliance with standards and technical regulations, which have been amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Article 1. Amending and supplementing certain provisions of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology on the announcement of conformity to standards, announcement of conformity to technical regulations, and methods for assessing compliance with standards and technical regulations, which have been amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017

Pursuant to Decree No.55/2025Decree No. 02 dated 3 day5 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Chairman of the National Standardization, Measurement, and Quality Control Committee; The Minister of Science and Technology issues this Circular stipulating the delegation and determination of authority when organizing local administration at two levels in the field of standards, measurement, and quality under the state management responsibility of the Ministry of Science and Technology

1. Amending and supplementing Clause 5 of Article 12 as follows:"5. In cases where products or goods are managed by multiple technical regulations, organizations or individuals announcing conformity to technical regulations must register the announcement of conformity to technical regulations at the competent state agency according to the provisions of Clause 2, Article 48 of the Law on Standards and Technical Regulations, including:a) The specialized department as stipulated in Clause 2, Article 14 of Decree No. 127/2007/NĐ-CP dated August 1, 2007, issued by the Government detailing a number of articles of the Law on Standards and Technical Regulations; of b) In cases where there is no specialized department, the agency under the Ministry or the agency equivalent to a ministry managing the sector or field designated or assigned responsibility by the Minister or the head of the agency equivalent to a ministry to receive the announcement of conformity to technical regulations from organizations or individuals. The agencies specified in points a and b of this clause shall be referred to as specialized agencies..

The conformity mark may only be used when the product or good has fully implemented the management measures as prescribed in the corresponding technical regulations."

2. Amending the first paragraph of Article 14 as follows:

"Organizations or individuals announcing conformity to technical regulations establish the announcement of conformity to technical regulations and submit it directly or online through the online public service portal or send it via postal service to the specialized agency. The components of the announcement are as follows:"

The Minister, the head of the agency equivalent to a ministry, the head of the agency under the Government, the Chairman of the People's Committee of provinces and centrally-run cities, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties or obstacles, please reflect them in writing to the Ministry of Science and Technology for guidance or research to amend and supplement appropriately./.

The conformity mark may only be used when the product or commodity has fully implemented all management measures in accordance with the relevant technical regulations.

2. Amend the first paragraph of Article 14 as follows:

"Organizations and individuals declaring conformity shall establish a declaration of conformity dossier and submit it directly, online through the public service portal, or send it via postal service to the specialized agency. The components of the dossier are specified as follows:"

Article 2. Responsibility for Implementation

The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees under the central city, and related organizations and individuals are responsible for implementing this Circular.

Article 3. Implementation Provisions

1. This Circular shall take effect from July 15, 2025.

2. In the course of implementation, if there are difficulties or obstacles, organizations and individuals are requested to report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements to ensure compliance./.
