Regulations on job code, occupational standards; criteria and conditions for promotion to higher ranks of specialized vocational staff in the field of employment
Pursuant toLaw on Civil Servants November 15, 2010; Law Amending and Supplementing Certain Provisions of the Law on Public Officials and Civil Servants and the Law on Civil Servants November 25, 2019;
Pursuant toLabor Law November 16, 2013;
Pursuant to Decree No.Decision No. 115/2020/NĐ-CP September 25, 2020 of the Government on recruitment, utilization, and management of civil servants; Decree No. Decision No. 85/2023/NĐ-CP December 7, 2023 of the Government amending and supplementing certain provisions of Decree No. Decision No. 115/2020/NĐ-CP September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;
Pursuant to Decree No.Decision No. 23/2021/NĐ-CP March 19, 2021 of the Government detailing Clause 3 Article 37 and Article 39 of the Labor Law on employment service centers and enterprises engaged in employment services;
Pursuant to Decree No.Decision No. 62/2022/NĐ-CP September 12, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
At the proposal of the Director of the Employment Department;
The Minister of Labor - Invalids and Social Affairs issues this Circular regulating job codes, occupational standards; criteria and conditions for promotion to higher ranks of specialized vocational staff in the field of employment.
Article 1. Scope of Regulation and Applicability
1. This Circular provides for:
a) Job codes, occupational standards for specialized vocational staff in the field of employment;
b) Criteria and conditions for promotion to the rank of Employment Service Consultant Level II.
2. This Circular applies to specialized vocational staff in the field of employment working at Employment Service Centers and other relevant agencies, organizations, and individuals.
Article 2. Job Codes and Classification of Occupational Titles for Specialized Vocational Staff in the Field of Employment
Occupational titles for specialized vocational staff in the field of employment include:

Article 3. General Professional Ethics Standards for Specialized Vocational Staff in the Field of Employment
1. Honesty, objectivity, dedication, and responsibility towards assigned work, compliance with laws and fulfillment of all duties as a civil servant in professional activities.
2. Accurate and complete information, adherence to procedures and formalities in providing public employment services; modest and appropriate behavior when interacting with organizations and individuals.
3. Respect for the right to work, choose professions, jobs, and workplaces; social security rights of all citizens; awareness of improving and enhancing the quality of products and services related to employment.
4. Foster unity, be proactive and actively cooperate with colleagues to accomplish assigned tasks.
5. Maintain confidentiality of information and documents of organizations and individuals according to the law.
Article 4. Employment Service Consultant Level II - Job Code: V.09.06.01
1. Duties Implement according to the Job Description and Competency Framework for Position and Occupational Title in the Field of Employment as stipulated in Appendix V.4 attached to Circular No. 11/2023/TT-LDTBXH dated October 17, 2023 of the Minister of Labor - Invalids and Social Affairs guiding positions, leadership roles, occupational titles, and the structure of civil servants by occupational titles in public institutions under the labor, war invalids, and social affairs sectors.
Clause 2. Professional Competence Standards
a) Proficient in the Party's policies, State laws, strategies for developing the labor market, employment services, and unemployment insurance;
b) Possess professional knowledge and skills in employment counseling, job placement, labor supply, labor market information, implementation of unemployment insurance policies; be familiar with Vietnam’s regulations on labor and employment; promptly update information on the Vietnamese labor market;
c) Have management capabilities, guidance, and inspection skills in organizing and implementing professional activities related to employment counseling, job placement, labor supply, labor market information, and implementation of unemployment insurance policies;
d) Have the ability to organize and implement research and application of scientific and technological advancements to enhance the quality and effectiveness of employment counseling, job placement, labor supply, labor market information, and implementation of unemployment insurance policies;
đ) Have analytical and synthesis skills regarding professional activities to propose solutions to improve the efficiency of employment counseling, job placement, labor supply, labor market information, and implementation of unemployment insurance policies;
e) Have skills in drafting, presenting, organizing, and implementing professional tasks, plans, programs, projects related to employment counseling, job placement, labor supply, labor market information, and implementation of unemployment insurance policies;
g) Have information technology skills and database management according to job requirements.
3. Educational and Training Standards
a) Hold a bachelor's degree or higher in a relevant field;
b) Hold a certificate in occupational standards for specialized vocational staff in the field of employment or a certificate in professional knowledge and skills in employment services issued by a competent state agency.
Article 5. Job Placement Service Consultant Level III - Code: V.09.06.02
1. Tasks
Implement according to the Job Description and Competency Framework for the position and occupational title in the field of employment as stipulated in Appendix V.4 attached to Circular No. 11/2023/TT-BLDTBXH dated October 17, 2023, issued by the Minister of Labor, Invalids and Social Affairs guiding positions, leadership and management roles, occupational titles, and the structure of civil servants based on occupational titles in public service units under the labor, war invalids, and social affairs sectors.
Clause 2. Professional Competence Standards
a) Adhere strictly to the Party's guidelines and policies and state laws and regulations of the industry.
b) Master legal provisions, systems, and policies regarding labor and employment, unemployment insurance, and basic knowledge about job counseling, job introduction, labor supply, labor market information, and implementation of unemployment insurance policies.
c) Understand the characteristics and nature of clients seeking job counseling, job introduction, labor supply, labor market information, and implementation of unemployment insurance policies.
d) Be familiar with procedures and have the ability to independently perform skills and tasks related to job counseling, job introduction, labor supply, labor market information, and implementation of unemployment insurance policies.
đ) Possess organizational capabilities and effectively coordinate with relevant agencies, units, and individuals during the execution of job counseling, job introduction, labor supply, labor market information tasks, and resolution of unemployment insurance benefits as prescribed.
e) Have basic computer technology skills and the ability to utilize databases as required by the job position.
3. Educational and Training Standards
a) Hold a bachelor's degree or higher in a relevant field;
b) Hold a certificate in occupational standards for specialized vocational staff in the field of employment or a certificate in professional knowledge and skills in employment services issued by a competent state agency.
Article 6. Job Placement Service Consultant Level IV - Code: V.09.06.03
1. Tasks
Implement according to the Job Description and Competency Framework for the position and occupational title in the field of employment as stipulated in Appendix V.4 attached to Circular No. 11/2023/TT-BLDTBXH dated October 17, 2023, issued by the Minister of Labor, Invalids and Social Affairs guiding positions, leadership and management roles, occupational titles, and the structure of civil servants based on occupational titles in public service units under the labor, war invalids, and social affairs sectors.
Clause 2. Professional Competence Standards
a) Understand the basic policies and procedural guidance on job counseling, job introduction, labor supply, labor market information, and unemployment insurance policies.
b) Understand the characteristics and nature of workers registering for employment services and resolution of unemployment insurance policies.
c) Be capable of applying information technology to perform assigned tasks.
d) Proficiently use technical equipment and tools to meet job requirements.
3. Educational and Training Standards
a) Graduated from a college level or higher with a major or specialized training relevant to the field of work.
b) Hold a certificate in occupational standards for specialized vocational staff in the field of employment or a certificate in professional knowledge and skills in employment services issued by a competent state agency.
Article 7. Criteria and Conditions for Promotion to Job Placement Service Consultant Level II
A civil servant may be considered for promotion from Job Placement Service Consultant Level III to Level II when meeting the following criteria and conditions:
1. The criteria and conditions specified in Clause 16, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023, of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020, of the Government on recruitment, utilization, and management of civil servants.
2. There must be a vacant position within the approved structure of the occupational title of civil servant.
3. Authorized to participate in the promotion review process by the competent authority.
4. Must have held the Job Placement Service Consultant Level III or equivalent position for at least nine years (excluding probationary and trial periods). In cases where the time spent in a position equivalent to Job Placement Service Consultant Level III is counted, the minimum time required in the Job Placement Service Consultant Level III position is one year (twelve months) up to the deadline for submitting the application for promotion review.
5. Meet one of the following conditions:
a) During the period holding the Job Placement Service Consultant Level III or equivalent position, being nominated by the competent authority to participate in scientific tasks confirmed in writing (attached to the application file), including: Participating in drafting regulations, rules, technical procedures in the sector, field, agency, or unit of employment that have been promulgated and recognized by the head of the agency or unit responsible for implementation; Participating in scientific and technological tasks at the grassroots level or higher that have been accepted and evaluated as satisfactory; Participating in drafting proposals, normative legal documents that have been promulgated and recognized by the head of the agency or unit responsible for implementation.
b) During the period holding the Job Placement Service Consultant Level III or equivalent position, achieving commendation from a ministry, department, provincial-level entity or higher for outstanding performance in professional duties.
Article 8. Responsibilities of agencies and organizations
1. This Circular serves as the basis for implementing the recruitment, utilization, and management of the specialized vocational staff in the employment sector.
2. The head of the public service unit directly managing and utilizing specialized vocational staff in the employment sector shall be responsible for:
a) Reviewing job positions within the unit, formulating plans to appoint to specialized vocational staff career titles corresponding to the unit's authority, submitting them for review and decision-making by the competent authority or deciding according to their authority;
b) Deciding on the appointment to career titles for specialized vocational staff in the employment sector according to their authority or proposing the competent authority to issue an appointment decision after the appointment plan has been approved by the competent authority.
3. The head of the agency with authority to manage public service units directly managing and utilizing specialized vocational staff in the employment sector shall be responsible for:
a) Approving plans to appoint career titles and set salaries for specialized vocational staff in public service units under their jurisdiction; resolving issues within their authority during the process of appointing career titles and setting salaries for specialized vocational staff in public service units under their jurisdiction;
b) Deciding on the appointment to career titles and setting salaries for staff under their management to specialized vocational staff career titles in public service units according to their authority;
c) Reporting the results of the appointment to career titles and setting salaries for specialized vocational staff in public service units under their jurisdiction to the competent agency as prescribed.
Article 9. Transitional Provisions
1. For public service units that have been approved by the competent authority for projects or plans to assess promotions of specialized vocational staff career titles before this Circular takes effect, they shall continue to implement according to the approved projects or plans within six months from the date this Circular takes effect. If not completed within this period, they shall follow this Circular.
2. Staff who already hold certificates for vocational training in employment services and unemployment insurance issued by the Ministry of Labor, Invalids and Social Affairs before this Circular takes effect shall be considered as meeting the requirements for vocational training certificates for specialized vocational staff career titles in the employment sector.
3. Staff performing public service tasks related to employment who have been appointed to other specialized vocational staff career titles shall have the head of the public service unit directly managing and utilizing specialized vocational staff in the employment sector decide or propose the competent authority to decide on transferring career titles according to the law.
Article 10. Effective Date
1. This Circular takes effect from May 1, 2025.
2. In cases where laws or regulations cited in this Circular are amended, supplemented, or replaced by other laws or regulations, the provisions of the amended, supplemented, or replacing laws or regulations shall apply.
Article 11. Responsibility for Implementation
1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies; Chairpersons of People's Committees of provinces and centrally governed cities, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, if there are any difficulties, individuals and organizations are advised to report to the Ministry of Labor, Invalids and Social Affairs for consolidation, examination, and resolution./.
