BASED ON THE ORGANIZATION LAW OF THE GOVERNMENT NO. 63/2025/QH15;
BASED ON THE LOCAL GOVERNMENT ORGANIZATION LAW NO. 72/2025/QH15;
BASED ON THE HEALTHCARE AND DISEASE TREATMENT LAW NO. 15/2023/QH15;
BASED ON DECREE NO. 96/2023/NĐ-CP OF THE GOVERNMENT ISSUED ON DECEMBER 30, 2023, REGULATING SOME ARTICLES OF THE HEALTHCARE AND DISEASE TREATMENT LAW;
BASED ON DECREE NO. 42/2025/NĐ-CP OF THE GOVERNMENT ISSUED ON FEBRUARY 27, 2025, REGULATING THE FUNCTION, MISSIONS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF HEALTH;
IN ACCORDANCE WITH THE RECOMMENDATION OF THE DIRECTOR OF THE DEPARTMENT OF HEALTHCARE AND DISEASE TREATMENT MANAGEMENT;
THE MINISTER OF HEALTH ISSUES THIS CIRCULAR TO REGULATE THE DELEGATION OF ADMINISTRATIVE PROCEDURE DECISIONS FOR ADDING TECHNIQUES TO THE LIST OF SPECIAL TECHNIQUE TYPES.
Article 1. Delegation of administrative procedure decisions for adding techniques to the list of special technique types, which fall under the Ministry of Health's management authority, to the people's committees of provinces and municipalities directly under the Central Government
The people's committees of provinces and municipalities directly under the Central Government shall adjust the operation permit for healthcare facilities that request to add techniques listed in the annex attached to this circular, except for healthcare facilities managed by the Ministry of Health, the Ministry of National Defense, or the Ministry of Public Security.
Article 2. Transitional Provisions
This circular takes effect on May 1, 2026.
Article 3. Transitional Provisions
In case a healthcare facility has submitted an application for adjusting its operation permit due to the addition of techniques listed in the special technique type list before this circular comes into force, the receiving authority shall continue to process it according to current regulations until the administrative procedure is concluded.
