Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Electricity Law on December 14, 2004;

Pursuant to Decision No. 110/2007/QĐ-TTg dated July 18, 2007 of the Government approving the National Power Development Plan for the period 2006-2015 with consideration to 2025;

Considering the proposal of the Chairman of the National Steering Committee for Power VI,

Article 1. This Decision promulgates the Operational Regulations of the National Steering Committee for Power Development for the period 2006-2015 with consideration to 2025.

Article 2. This Decision shall take effect from the date of signing.

Article 3. The Chairman of the National Steering Committee for Power VI, Ministers, Heads of ministerial-level agencies, Heads of government agencies; Chairmen of provincial People's Committees under central cities; State-owned Enterprise Groups: Vietnam Electricity, Vietnam Oil and Gas Corporation, Vietnam Coal and Mineral Industries Group, and related units shall be responsible for implementing this Decision.

REGULATIONS

OPERATIONS OF THE NATIONAL STEERING COMMITTEE FOR POWER VI

(promulgated together with Decision No. 04/QĐ-TTg dated January 3, 2008 of the Prime Minister)

Chapter 1.

GENERAL PROVISIONS

Article 1. The National Steering Committee for Power Development for the period 2006-2015 with consideration to 2025 (hereinafter referred to as the National Steering Committee for Power VI) shall direct the construction of power projects according to Decision No. 110/2007/QĐ-TTg dated July 8, 2007 of the Prime Minister.

Article 2. The tasks, powers, and composition of the National Steering Committee for Power VI are stipulated in Decision No. 1436/QĐ-TTg dated October 24, 2007 of the Prime Minister.

Article 3. Powers of the National Steering Committee for Power VI:

1. The National Steering Committee for Power VI may exercise the powers of the Prime Minister to perform the tasks prescribed in Article 2 of Decision No. 1436/QĐ-TTg dated October 24, 2007 of the Prime Minister.

2. All decisions made by the Chairman of the National Steering Committee for Power VI, or decisions made by persons authorized by the Chairman, shall be implemented as decisions of the Prime Minister.

3. The National Steering Committee for Power VI may invite domestic and foreign experts to provide advice when necessary.

Article 4. The operating expenses of the National Steering Committee for Power VI shall be approved by the Deputy Chairman and included in the costs of power projects under Power VI planning.

Chapter 2.

WORKING PROCEDURES

Article 5.

1. The Chairman, Deputy Chairmen, and members of the National Steering Committee for Power VI work on a part-time basis.

2. The National Steering Committee for Power VI operates under the principle of centralized unity, members of the National Steering Committee for Power VI are responsible for their assigned tasks; the Chairman or a person authorized by the Chairman decides matters of the National Steering Committee for Power VI.

Article 6. The Chairman convenes and chairs regular quarterly or biannual meetings and extraordinary meetings when necessary. The Chairman may delegate authority to the Deputy Chairman to chair meetings. Members are responsible for fully participating in meetings of the National Steering Committee and preparing reports as required.

Article 7. Regular meeting agendas aim to evaluate the activities of the National Steering Committee for Power VI, the results of tasks performed by ministries, sectors, localities, project sponsors, consulting units, and contractors; and to recommend solutions to the Prime Minister for issues beyond the authority of the National Steering Committee for Power VI.

Article 8. The National Steering Committee for Power VI assigns members to coordinate with ministries, sectors, and localities to inspect the implementation of mechanisms and policies issued; to propose supplements, amendments, or new mechanisms and policies, and measures to complete tasks assigned by the Prime Minister; the National Steering Committee for Power VI serves as the coordinating body to direct the activities of ministries, sectors, and localities to implement investment projects according to Power VI planning.

Article 9. Reporting system:

- Periodic reports: monthly, quarterly, semi-annually, annually; members of the National Steering Committee for Power VI report on the implementation of tasks assigned by the Chairman to promptly address requirements and recommendations.

- In September each year, the National Steering Committee for Power VI listens to reports from the Deputy Chairman and the Minister of Industry and Trade on the implementation of tasks and plans for power projects according to Power VI planning, and approves plans and progress for the following year.

- Members of the National Steering Committee for Power VI are responsible for submitting ad hoc reports as required by the Chairman; the Chairman submits ad hoc reports to the Prime Minister regarding the implementation of power project investments according to Power VI planning.

Article 10. Travel system:

Based on work requirements, members of the National Steering Committee for Power VI proactively travel to grasp situations and resolve difficulties within their functions and assigned tasks.

Chapter 3.

ASSIGNMENT OF RESPONSIBILITIES OF MEMBERS OF THE NATIONAL STEERING COMMITTEE

Article 11. Assignment of responsibilities among members of the National Steering Committee for Power VI.

1. Chairman of the National Steering Committee for Power VI:

a) Decides and is responsible before the Prime Minister for all activities of the National Steering Committee for Power VI according to its functions, tasks, and powers as stipulated in Decision No. 1436/QĐ-TTg dated October 24, 2007 of the Prime Minister;

b) Directs the overall operations of the National Steering Committee for Power VI, approves work plans, and chairs meetings of the National Steering Committee for Power VI;

c) Decides on mechanisms, policies, and resolves specific issues within the Prime Minister's authority during the organization and implementation of power projects according to Power VI planning;

d) Inspects and urges ministries, sectors, localities, sponsors, consulting agencies, contractors, and related units to implement power projects according to Power VI planning;

e) Delegates authority to the Deputy Chairman or other members of the National Steering Committee for Power VI to handle matters within the Chairman's authority when necessary.

2. Deputy Chairman, Minister of Industry and Trade:

a) Assist the Director of the Management Board in handling tasks related to power projects according to the functions and responsibilities of the Ministry of Industry (now the Ministry of Industry and Trade) as stipulated in Decision No. 110/2007/QĐ-TTg dated July 18, 2007 of the Government approving the National Power Development Plan for the period 2006-2015 with consideration up to 2025, and the tasks of the Steering Committee for Power Planning VI in its field of management;

b) Deputize for the Director of the Steering Committee for Power Planning VI, take the lead, and coordinate with relevant ministries, sectors, and localities to resolve inter-sectoral issues and issues related during the implementation of power projects;

Directly direct the General Synthesis Team;

d) Be responsible for resolving the following issues:

- Reviewing and approving power development plans for provinces and cities; grid connection planning for electricity purchase and sale with countries in the region; grid connection planning for regional hydroelectric power plants; thermal power center planning, to facilitate investment preparation for power projects, while approving revisions to these plans.

- Establishing construction cost standards and unit prices applicable to power projects under Power Planning VI.

3. Members of the Steering Committee for Power Planning VI:

Members of the Steering Committee shall, based on their units' functions and responsibilities in investment and construction management, take the lead and coordinate with relevant ministries, sectors, and localities to inspect, supervise, guide investors, and promptly resolve any difficulties and issues arising during the implementation of power projects.

Article 12. The establishment, duties, authorities, and staffing of the General Synthesis Team shall be decided by the Deputy Director and the Minister of Industry and Trade.

Chapter 4.

IMPLEMENTING PROVISIONS

Article 13. This Regulation applies to the Steering Committee for Power Planning VI and relevant ministries, sectors, localities, organizations, and individuals implementing it.

Article 14. Members of the Steering Committee for Power Planning VI must individually bear responsibility before the Director of the Steering Committee for Power Planning VI and before the Prime Minister for the tasks assigned by the Steering Committee for Power Planning VI; they must use personnel, means, and equipment managed by their units to perform the assigned tasks.

Article 15. During the implementation of this Regulation, if there are any difficulties, the Steering Committee for Power Planning VI shall compile opinions and propose necessary supplements and amendments for submission to the Prime Minister for consideration and decision./.
