Circular No. 04/TTLB-NN-TM on Import Control and Supply of Fertilizers in 1995

CIRCULAR

JOINT MINISTRY OF TRADE - MINISTRY OF AGRICULTURE AND FOOD INDUSTRY DECREE NO. 04 TTLB/NN-TM OF FEBRUARY 10, 1995 ON IMPORT CONTROL AND SUPPLY OF FERTILIZERS IN 1995

REGULATING IMPORTS AND SUPPLY OF FERTILIZERS IN 1995 

Pursuant to Decision No. 752/TTg dated December 10, 1994 of the Prime Minister on "Policy for Commodities and Management of Export and Import Activities in 1995," and Circular No. 6842/KTTH dated December 6, 1994 of the Government on "Management to Ensure Demand and Stabilize Fertilizer Prices," the Ministry of Trade and the Ministry of Agriculture and Food Industry hereby jointly guide the importation of fertilizers in 1995 as follows:

1\. The quantity of urea fertilizer imported in 1995 is approximately 1 million 300 thousand tons.

For other types of fertilizers (DAP, NPK, Potash, SA...), the Ministry of Agriculture and Food Industry and the Ministry of Trade shall examine the quantities and designate enterprises to import to meet production needs.

Imports of fertilizers prior to this document shall be regulated according to the provisions set forth in Decision No. 78/TTg dated February 28, 1994.

2\. Based on the import capacity of enterprises in 1993-1994, in 1995, 26 enterprises will be designated to import the entire quantity of fertilizers mentioned in Point 1 according to the principle:

- Provinces that are members of the Million Ton Rice Club and provinces in the Mekong Delta with large amounts of commercial rice production: each province 1 (one) enterprise (selected from among enterprises continuously importing urea in the two years 1993-1994).

- Ho Chi Minh City, Hanoi, Hai Phong, Quang Nam-Danang Province, Phu Yen Province, Ba Ria-Vung Tau Province, Tay Ninh Province: each place 1 (one) enterprise (selected from among enterprises continuously importing urea in the two years 1993-1994 and achieving the highest volume in their respective locality). If the People's Committee of the province or city issues a letter introducing an enterprise, the Ministry of Trade will consider the opinions of the provincial or municipal leadership.

- Ministry of Agriculture and Food Industry: in addition to the Central Agricultural Supplies Corporation (Vigecam), three more enterprises continuously importing urea in the two years 1993-1994 and achieving the highest volume in the Ministry of Agriculture and Food Industry will also be added.

- Ministry of Trade: three enterprises continuously importing urea in the two years 1993-1994 and achieving the highest volume in the Ministry of Trade will be designated.

3\. Assigning import quotas for fertilizers:

The Ministry of Trade assigns import quotas for fertilizers (by written document) to each enterprise once at the beginning of 1995 (according to Model A attached), specifically:

+ Vigecam: 780 thousand tons equivalent to 40%.

+ 25 other enterprises: 520 thousand tons equivalent to 40%.

The quantity handled by Vigecam and the quantity handled by other enterprises are sufficient to meet the demand for each crop season in each region as determined by the Ministry of Agriculture and Food Industry.

Enterprises are not allowed to transfer their assigned quotas, including cases where joint ventures or joint operations are used as a pretext.

4\. The Ministry of Agriculture and Food Industry and the Ministry of Trade are responsible to the State for the issue of fertilizer imports and supply according to the following division of responsibilities:

4.1 The Ministry of Agriculture and Food Industry is responsible for:

Developing plans and balancing supply and demand for fertilizers in each crop season in each region nationwide. Together with the Ministry of Trade, it monitors and inspects the progress of goods arrivals, supply conditions, and prices of fertilizers nationwide. It proposes timely adjustments to the quantity of imported fertilizers.

4.2 The Ministry of Trade is responsible for:

Article 1 ||| Direct the import of fertilizers according to the overall plan and balance of the Ministry of Agriculture and Rural Development. Designate enterprises to import fertilizers. Announce import targets for fertilizers for each enterprise and send these notifications to the Ministry of Agriculture and Rural Development.

5- Provincial Departments of Agriculture shall be responsible for:

State management of fertilizer usage within their province. Confirm the quantity of fertilizers imported by enterprises under their jurisdiction and assist these enterprises in organizing sales networks for fertilizers within their area.

In addition to fully fulfilling the responsibilities of other enterprises, it must also:

Gradually reorganize the wholesale network, direct sales network of fertilizers to farmers; strictly manage the foreign currency and physical reserve funds in all three regions of North, Central, and South, in accordance with regulations. When price fluctuations and supply-demand imbalances occur, promptly mobilize the reserve force to intervene in the market at the direction of the Ministry of Agriculture and Rural Development and the Ministry of Trade, aiming to stabilize fertilizer supply and prices nationwide.

7- Enterprises shall be responsible for sending a quick report on implementation status to the Ministry of Trade (Department of Import-Export) and the Ministry of Agriculture and Rural Development (Planning Department) on the 20th of each month, including transaction details, signing of foreign trade contracts, opening of letters of credit, queuing situation at departure ports, ship schedules, and expected arrival times at Vietnamese border gates (according to attached form 3).

Two months before the deadline (specified for each season), if a foreign trade contract has not been signed, the enterprise must return the allocation to the Ministry of Trade for reallocation to another enterprise.

The time specified in the notification for goods arrival is when the goods have actually reached the Vietnamese border gate and have completed inter-departmental inspection procedures.

8- Establish a steering group for fertilizer imports (hereinafter referred to as the Steering Group), consisting of representatives from the Ministry of Agriculture and Rural Development, the Ministry of Trade, the State Planning Commission, and the Government Price Control Board. The representative from the Ministry of Agriculture and Rural Development will serve as the head of the group. The Steering Group will convene once a month at the end of each month. The Steering Group is responsible for advising the leadership of the Ministry of Trade and the Ministry of Agriculture and Rural Development on the management and supply of fertilizer imports.
