THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Considering the proposals of the Heads of the Department of Science and Technology for Economic and Engineering Industries and the Head of the Department of Organization and Cadres;

DECISION:

Article 1The Rules on the Organization and Operation of the Department of Science and Technology for Economic and Engineering Industries under the Ministry of Science and Technology are hereby promulgated together with this Decision.

Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decision No. 734/QĐ-BKHCNMT dated June 12, 1998 promulgating the Charter on the Organization and Operation of the Department of Industrial Science and Technology Management and Decision No. 735/QĐ-BKHCNMT dated June 12, 1998 promulgating the Charter on the Organization and Operation of the Department of Agricultural Science and Technology Management issued by the Minister of Science, Technology and Environment (now the Ministry of Science and Technology).

Article 3. The Heads of the Office, the Head of the Department of Organization and Cadres, the Head of the Department of Science and Technology for Economic and Engineering Industries, and the Heads of related units are responsible for implementing this Decision.

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The Department of Science and Technology for Economic and Engineering Industries is a unit directly under the Ministry of Science and Technology, assisting the Minister in performing state management functions over scientific research and technological development activities in industries belonging to the fields of mechanical engineering, metallurgy, electricity, electronics, chemical industry, consumer goods and food industry, energy, oil and gas, postal and telecommunications, trade and tourism, materials, construction, transportation, water resources, urban and rural planning, agriculture, animal husbandry, veterinary medicine, forestry, fisheries, preservation and processing of agricultural, forest, and aquatic products, health sciences.

Article 2The Department of Science and Technology for Economic and Engineering Industries has specific tasks and powers as follows:

1. To study and propose or draft regulations within the assigned management field and guide sectors, localities, and units to implement them after issuance.

2. To study and propose policies, directions, strategies, plans, programs, topics, projects, five-year and annual plans for scientific research and technological development in the assigned management fields to the Minister.

3. To be the focal point for scientific and technological planning with other Ministries and sectors according to the Minister's assignment. Guide the preparation of plans and monitor their implementation in the assigned management fields.

Guide and assist localities in managing scientific research and technological development activities in the assigned management fields.

4. Within the assigned management fields, coordinate with Ministries, sectors, and localities:

a) Inspect the implementation, evaluate, and accept the results of scientific research and technological development.

b) Recommend lists of research results that can be applied in production and daily life.

c) Develop and organize the trial application of evaluated research results.

d) Develop the technology market and be responsible for the content of the State's technology and equipment market.

Coordinate with other Ministries, sectors, and units within the Ministry:

a) Monitor and manage key laboratories assigned.

b) Examine economic and technical norms in the assigned fields.

c) Participate in discussions with units within the Ministry regarding issues related to the Ministry's general functions.

d) Participate in statistical and information work on science and technology.

6. Serve as the permanent member of the Hòa Bình Dam Safety Council and the Technology Team of the Sơn La Hydropower Project.

7. Coordinate with units within the Ministry to resolve specialized matters when required.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 3. The Department of Science and Technology for Economic and Engineering Industries shall operate under a head-of-department system combined with collective deliberation.

The Head of the Department of Science and Technology for Economic and Engineering Industries directs all activities of the Department based on the Rules on the Organization and Operation approved by the Minister and is responsible to the Minister for the entire organization and operation of the Department.

Deputy Heads of the Department of Science and Technology for Economic and Engineering Industries have the responsibility to assist the Head in leading the Department's work, have the authority to decide on matters within their assigned tasks, and are accountable to the Head for the tasks assigned to them.

In the absence of the Head, a Deputy Head may be authorized to lead and direct the Department's activities.

Article 4The Department of Science and Technology for Economic and Engineering Industries implements a system where staff work directly under the leadership of the Department's leadership. When necessary, the Head of the Department of Science and Technology for Economic and Engineering Industries may establish working groups or teams according to the nature and requirements of the work and specify the specific tasks of these groups or teams.

Chapter III

WORK RELATIONSHIPS

Article 5The Department of Science and Technology for Economic and Engineering Industries directs all activities of the Department based on the Rules on the Organization and Operation of the Department of Science and Technology for Economic and Engineering Industries.

Article 6The Head of the Department of Science and Technology for Economic and Engineering Industries implements the working system and relationships with heads of subordinate units according to the Ministry's working rules and other regulations issued by the Minister.

Article 7. The Department of Science and Technology for Economic and Engineering Industries is responsible for closely collaborating with relevant Departments of Science and Technology, functional Departments of related Ministries and Sectors, Provincial Departments of Science and Technology, and grassroots units in carrying out assigned tasks.

Chapter IV

IMPLEMENTING PROVISIONS

Article 8. The Head of the Department of Science and Technology for Economic and Engineering Industries coordinates with the Head of the Department of Organization and Cadres to implement these Rules.

Article 9The amendment and supplementation of this Regulation shall be proposed by the Director of the Department of Science and Technology for Economic and Engineering Industries in coordination with the Director of the Department of Organization and Cadres for consideration and decision by the Minister of Science and Technology./.
