regarding the method for determining the level of localization for automobiles

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to the Goods Quality Ordinance 1999;

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP dated May 19, 2003

Pursuant to Decision No. 175/2002/QĐ-TTg dated December 3, 2002 of the Prime Minister approving the strategy for the development of the automobile industry in Vietnam until 2010 with a vision to 2020;

Pursuant to the guidance of the Prime Minister in Notification No. 82/TB-VPCP dated June 16, 2003, Official Letter No. 4659/VPCP-KG dated September 24, 2003, Notification No. 63/TB-VPCP dated April 2, 2004, and Official Letter No. 2943/VPCP-KG dated June 11, 2004 of the Government Office;

Pursuant to Decision No. 177/2004/QĐ-TTg dated October 5, 2004 of the Prime Minister approving the planning for the development of the automobile industry in Vietnam until 2010 with a vision to 2020;

At the proposal of the Director General of the Standardization, Measurement, and Quality Control General Department and the Director of the Legal Affairs Department,

DECISION:

Article 1. Amend and supplement Clause 4, Article 5 of Decision No. 28/2004/QĐ-BKHCN dated October 1, 2004 of the Minister of Science and Technology on the method for determining the localization rate for automobiles as follows:

"4. Automotive parts directly imported by enterprises or purchased from trading enterprises importing such parts shall not be counted as localization.

The degree of disaggregation of imported parts is specified as follows:

- Body of the automobile: Disassembled into separate panels, not welded, riveted, nor electrostatically painted. Special cases must be approved by the Ministry of Science and Technology.

- Frame of the automobile: Already connected but not electrostatically painted. For frames with a length of 3.7 meters or more, electrostatic painting before importation is permitted.

- Engine: Complete and capable of being directly installed with the clutch and transmission.

- Drive train: Either assembled or unassembled together with the braking system.

- Electrical system, lights, and amenities: Wiring harnesses, electrical panels, lights, and amenities within the automobile are disassembled.

Appendices 5, 6, 7, and 8 issued together with this Decision illustrate the structural level of disaggregation of parts for various types of automobiles."

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Director General of the Standardization, Measurement, and Quality Control General Department, the Director of the Evaluation, Review, and Technical Inspection Department, the Director of the Science and Technology Department for Economic and Engineering Industries, the Director of the Legal Affairs Department, the Head of the Office, and other relevant organizations and individuals are responsible for implementing this Decision./.
