Regarding the issuance of regulations on announcing product quality standards,

agricultural goods

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Quality of Goods Ordinance No. 18/1999/PL-UBTVQH10 dated December 24, 1999;

Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on State Management of Product and Goods Quality;

At the proposal of the Director of the Department of Agriculture, the Director of the Science and Technology Department,

DECISION:

Article 1. Annexed hereto is the "Regulation on Announcing Product Quality Standards for Agricultural Goods."

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

This Decision replaces Decision No. 86/2001/QĐ-BNN-KHCN dated August 23, 2001 of the Minister of Agriculture and Rural Development on the issuance of the "Provisional Regulation on Announcing Product Quality Standards for Agricultural Goods."

Article 3. The Head of the Ministry's Office, the Director of the Department of Agriculture, the Director of the Science and Technology Department, the Director of the Forestry Department, the Director of the Plant Protection Department, the Director of the Animal Health Department, the Director of the Processing and Salt Industry Department, the Directors of Provincial Departments of Agriculture and Rural Development under central cities and heads of units, organizations, and individuals related to this matter shall be responsible for implementing this Decision.

REGULATIONS

On announcing product quality standards for agricultural goods

(annexed to Decision No. 05/2005/QĐ-BNN dated January 20, 2005)

of the Minister of Agriculture and Rural Development)

Article 1. Scope of regulation and applicable subjects

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

a) These regulations stipulate the announcement of quality standards for products and goods permitted for production and business in Vietnam under the management of the Ministry of Agriculture and Rural Development, including: plant seeds; animal breeds; pesticides and raw materials for pesticides; veterinary drugs; livestock feed; raw materials for livestock feed, fertilizers and raw materials for fertilizer production; biological preparations serving crop cultivation and animal husbandry included in the mandatory list for announcing quality standards; forestry and salt industry materials, agricultural and forest product preservatives.

b) For products and goods specified in point a of this Article that are produced and processed manually, raw materials, and semi-finished products within the production process but intended for internal use in enterprises, it is not mandatory to announce quality standards, but they are encouraged to do so.

Organizations and individuals (hereinafter referred to as enterprises) producing and trading in products and goods under the management of the Ministry of Agriculture and Rural Development as specified in point a, Clause 1 of this Article.

Article 2. System of product and goods quality standards

The system of announced product and goods quality standards includes:

1. Vietnamese Technical Standards (VNTC);

2. Sectoral Technical Standards (STC);

3. Enterprise Standards;

4. International, regional, and foreign technical standards applied in Vietnam.

Article 3. Procedures for announcing quality standards

The procedures for announcing quality standards for goods are carried out according to Decision No. 2425/2000/QĐ-BKHCNMT dated December 12, 2000 of the Minister of Science, Technology, and Environment (now the Ministry of Science and Technology) on the issuance of the "Provisional Regulation on Announcing Quality Standards for Goods."

Article 4. Allocation of responsibilities for state management of announcing product and goods quality standards

1. Sectoral management departments in coordination with the Science and Technology Department:

a) Annually compile the "List of Products and Goods Required to Announce Quality Standards" within their management scope and submit to the Minister of Agriculture and Rural Development for promulgation;

b) Organize, direct implementation, guide, and inspect the announcement of quality standards for specialized products and goods nationwide; directly guide and manage the announcement of quality standards for products and goods of wholly foreign-owned enterprises in Vietnam according to specific fields assigned as follows:

- Department of Agriculture: plant seeds; animal breeds; livestock feed and raw materials for livestock feed; fertilizers (as assigned in Decree No. 113/2003/NĐ-CP dated October 7, 2003 on managing the production and business of fertilizers); preservatives used in livestock feed; biological preparations serving crop cultivation and animal husbandry;

- Forestry Department: forestry plant seeds, forestry products and goods;

- Plant Protection Department: pesticides and raw materials for pesticides, crop product preservatives;

- Animal Health Department: veterinary drugs;

- Processing and Salt Industry Department: salt and salt industry products.

2. Provincial Departments of Agriculture and Rural Development under central cities are responsible for organizing, directing implementation, and inspecting the announcement of quality standards for specialized products and goods in the fields specified in point b, Clause 1 of this Article by other organizations and individuals operating in their respective areas.

3. Departments assigned in point b, Clause 1, and Clause 2 of this Article shall be responsible for:

a) Guiding enterprises under their management on the procedures for announcing product and goods quality standards;

b) Receiving copies of the announcement along with copies of the standards;

c) Checking the compliance of announced standards with national regulations;

d) Within fifteen days from the date of receipt of the announcement, if the specialized management department does not provide comments on the contents of the announced standards, the announcement of product and goods quality standards by organizations and individuals is considered valid;

Article 5. Obligations of enterprises

1. Enterprises announce product and goods quality standards through the Announcement and send a copy of the standard to the specialized management department according to the classification in Clause 1, Clause 2 of Article 4 of these Regulations.

2. Must ensure production and business conditions so that the quality of products and goods conforms to the announced standards.

3. Self-inspect the quality and bear responsibility for the quality of products and goods produced and traded according to the announced quality standards.

4. Retain files of products and goods that have announced quality standards and submit them to the competent authority when required.

Article 6. Inspection, audit, and handling violations

1. The competent authorities mentioned in Clause 1 and Clause 2 of Article 4 of this Regulation shall inspect, audit, and handle violations related to the publication of standards in accordance with this Regulation and other relevant regulations.

2. Organizations and individuals who violate the provisions on the publication of quality standards shall be subject to handling according to the nature and degree of violation as prescribed by law.

During implementation, if any issues or recommendations arise, they shall be referred to the Ministry of Agriculture and Rural Development for consideration and resolution./.
