CIRCULAR
Guidelines for implementing salary systems for military personnel and defense employees receiving salaries or living expenses from state budget funds
personnel of national defense holding salaries or living expenses
from funds belonging to the state budget
Implementing Clause 5, Article 11 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, employees, and armed forces personnel;
After consultation with the Ministry of Home Affairs and the Ministry of Finance, the Ministry of National Defense provides guidelines for implementing salary systems for military personnel and defense employees as follows:
I. OBJECTS AND SCOPE OF APPLICATION
Officers, professional soldiers, non-commissioned officers, privates, defense employees, and contractual workers with decisions from the General Staff who are working, studying, interning, or being treated domestically or abroad, waiting to resolve policies within agencies and units under the People's Army of Vietnam receiving salaries or living expenses from state budget funds.
II. PRINCIPLES FOR SALARY GRADINGS
The person currently working in which category and performing what job shall be graded according to the regulations for that category and job, specifically as follows:
1. Officers receive salaries and non-commissioned officers and privates receive allowances: implement salary grading or allowances based on rank.
2. Professional soldiers are graded according to their level of education (university, college, basic) and the group of work they perform, and are graded according to that level and group.
3. Defense civil servants and employees appointed to a civil servant or employee grade shall be graded according to that grade.
4. Defense workers employed in agencies and units under the People's Army of Vietnam shall be graded according to the wage scale and pay table specified in state-owned companies.

In cases where an officer has received a promotion but later receives a higher rank with a lower salary level than before, the difference will be retained until the officer receives another promotion or a higher rank.
Example: Comrade Colonel Nguyen Van A, who received the second promotion with a new pay factor of 7.40, was promoted to Major in September 2005 with a pay factor of 7.3. Comrade A retains the difference of 0.1 until he receives another promotion or a higher rank.
2. For professional soldiers.

b) Based on Decision No. 176/2004/QĐ-BQP dated December 30, 2004 of the Minister of National Defense regarding the issuance of regulations on classification and grouping for professional soldiers and grouping for defense employees, and the professional standards specified for each position of professional soldiers, the decision to grade salaries for each subject according to the provisions of this Circular.
c) Professional soldiers who have reached the highest pay grade in their group and meet the criteria, upon reaching the time limit for pay grade promotion, may be granted seniority allowance beyond the range as stipulated in Point 4, Section IV of this Circular.
3. For defense workers and employees
a) Defense civil servants and employees receiving salaries from state budget funds shall enjoy salary benefits as prescribed for state officials, civil servants, and employees under Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, employees, and armed forces personnel.
b) Workers employed in agencies and units receiving salaries from state budget funds shall enjoy salary benefits as prescribed for workers in state-owned companies under Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government on the wage scale system and salary allowance system in state-owned companies.
4. For non-commissioned officers and privates
a) Non-commissioned officers and privates serving under the Law on Military Service (including military students studying at academies, schools, and training institutions both within and outside the military) shall receive rank allowances according to their rank during the first two years as shown in the following table:

b) Non-commissioned officers and privates serving for three years and those serving for two years whose service period is extended by the Minister of National Defense according to the Law on Military Service shall receive an additional 200% of the rank allowance for the first two years of each rank from the 25th month onwards;
Specifically, non-commissioned officers and privates serving for three years whose service period is extended by the Minister of National Defense according to the Law on Military Service shall receive an additional 50% of the rank allowance for the first two years of each rank from the 37th month onwards.
The allowances from the 25th and 37th months onwards stipulated in point b above do not apply to non-commissioned officers and privates studying at academies and schools both within and outside the military (including military personnel called for concentrated review and preparation for exams, awaiting exam results).
IV. SALARY ALLOWANCE SYSTEMS
1. Position Allowances
a) Applicable Objects
Officers, professional soldiers, non-commissioned officers, and defense civil servants and employees appointed to leadership positions by competent authorities.
b) Principles
b.1) Military personnel and defense civil servants and employees appointed to a leadership position shall receive the position allowance corresponding to that position. If a person holds multiple leadership positions, only the highest position allowance shall be applied. Persons entrusted with leadership responsibilities shall also receive the position allowance equivalent to the corresponding position holder.
b.2) In cases where they are assigned a lower position for special tasks, military personnel, defense civil servants, and defense officials shall continue to receive the position allowance of their previous position before being reassigned.
b.3) In cases where they are assigned a lower position due to adjustments made by competent authorities to match their capabilities and health conditions, they shall retain the previous position allowance for six months, starting from the seventh month, they shall receive the new position allowance.
b.4) In cases where they are relieved of leadership positions to engage in specialized work or other tasks, they shall retain the leadership position allowance of their previous leadership position for six months, starting from the seventh month, they shall cease receiving the leadership position allowance.
b.5) In cases where they are relieved of leadership positions due to dismissal, they shall cease receiving the leadership position allowance from the date the dismissal decision becomes effective.

d) Calculation Method.
The leadership position allowance is paid together with the monthly salary and is used to calculate contributions and benefits under the social insurance scheme.
2. Seniority Allowance.
a) Applicability.
Officers and professional military personnel on active duty.
b) Level of Allowance.
After five years (sixty months) of service, they shall receive an allowance equal to 5% of their current salary plus the position allowance and seniority allowance exceeding the framework (if applicable); from the sixth year onwards, for each additional year of service (twelve months), an additional 1% shall be calculated without a maximum limit.
3. National Defense and Security Service Allowance.
a) Applicability and Scope.
Defense civil servants and contractual workers with a decision from the General Staff who work in agencies and units under the People's Army.
b) Level of Allowance, including two levels:
b.1) A level of 50% applies to defense civil servants classified in Group 1 as stipulated in Decision No. 176/2004/QĐ-BQP dated December 30, 2004, issued by the Minister of National Defense.
b.2) A level of 30% applies to defense civil servants classified in Group 2 as stipulated in Decision No. 176/2004/QĐ-BQP dated December 30, 2004, issued by the Minister of National Defense.
c) Calculation Method for Allowance Payment.
The national defense and security service allowance is calculated based on the current salary plus the position allowance and seniority allowance exceeding the framework (if applicable), and is paid together with the monthly salary.
When defense civil servants are transferred from one unit to another or from one profession to another; from a place with a 50% national defense and security service allowance to a place with an 80% allowance (or vice versa), they shall receive the allowance according to the new location starting from the following month.
4. Seniority Allowance Exceeding the Framework.
a) Applicability and Scope.
Professional military personnel are ranked according to the professional military personnel salary scale (scale 7) as stipulated in Clause 1, Article 5 of Decree No. 204/2004/NĐ-CP dated December 14, 2004, issued by the Government regarding the salary system for cadres, civil servants, officials, and armed forces.
Defense civil servants enjoy the seniority allowance exceeding the framework as state cadres, civil servants, and officials.
b) Conditions and Standards for Receiving the Allowance.
Professional military personnel who have held the final grade within the "group" and meet the time and standard requirements as specified in Circular No. 07/2005/TT-BQP dated January 5, 2005, issued by the Ministry of National Defense throughout the period of holding the final grade within the "group" or during the year for additional seniority allowance exceeding the framework.
c) Level of Allowance and Payment Method.
c.1) Level of Allowance.
After three years (thirty-six months), professional military personnel who have been ranked at the final grade within the "group" shall be eligible for a seniority allowance exceeding the framework equal to 5% of the salary of the final grade within the "group"; from the fourth year onwards, for each year meeting the standards for the seniority allowance exceeding the framework, an additional 1% shall be calculated.
c.2) Calculation Method.
The seniority allowance exceeding the framework is paid together with the monthly salary and is used to calculate contributions and benefits under the social insurance scheme.
5. For military personnel and defense civil servants belonging to special arms or performing special jobs, they shall enjoy special allowances as prescribed by the Government and the Ministry of National Defense.
6. Other Allowances:
In addition to the allowances mentioned above, different types of allowances may be applied depending on the specific category: Concurrent Position Allowance; Special Allowance; Attraction Allowance; Regional Allowance; Mobility Allowance; Hazardous and Dangerous Work Allowance; Occupational Preference Allowance; Responsibility Allowance by Profession; Responsibility Allowance for Work; ... in accordance with the general guidelines of the State.
V. COMPENSATORY ALLOWANCE SYSTEM
l. Sub-officers and soldiers serving under the Law on Military Service shall be provided with food allowances as prescribed.
2. Continue implementing the system of compensatory food allowances based on the nature and mission for officers, professional military personnel, and defense civil servants in special arms.
VI. IMPLEMENTATION
1. Military personnel and defense civil servants must deduct a portion of their salary to contribute to social insurance and medical insurance as prescribed.
2. This Circular takes effect fifteen days after its publication in the Official Gazette. The salary regulations stipulated in this Circular shall be implemented from October 1, 2004.
This Circular replaces Circular No. 715/TT-QP dated May 24, 1993, issued by the Ministry of National Defense, guiding the temporary regulations on the new salary system for officers, professional military personnel, sub-officers, soldiers, and defense civil servants in the People's Army, and all provisions contrary to this Circular are abolished.
3. The Heads of the General Staff, the Political General Department, and the Director of the Finance Department - Ministry of National Defense are responsible for guiding and supervising the implementation of this Circular.
During the implementation process, if there are any difficulties, units shall report to the Ministry of National Defense (through the Financial Department of the Ministry of National Defense) for consideration and resolution./.
