Directive No. 05/2006/CT-NHNN on Strengthening the Work of Popularizing and Educating Law in the Banking Sector

DIRECTIVE

On strengthening the dissemination and education of laws in the banking sector

The dissemination and education of laws in recent years have always been given attention and leadership by the Party and State, considering it one of the key tasks in enhancing social management through the rule of law. The leadership of the State Bank of Vietnam has clearly identified the position, role, and impact of the dissemination and education of laws, viewing it as part of political and ideological education, and a regular directive task of the State Bank. Implementing Directive No. 32-CT/TW of the Politburo dated December 9, 2003 on strengthening the Party's leadership in the dissemination and education of laws to enhance the awareness of law observance among cadres and people (hereinafter referred to as Directive 32 of the Politburo), the dissemination and education of laws in the banking sector have achieved significant results and notable changes such as diversification of dissemination methods, rich content, and the dissemination and education of laws gradually reaching a large number of cadres, civil servants, and employees in the banking sector (hereinafter referred to as banking cadres). Dissemination and education of laws contribute to enhancing the legal awareness of banking cadres, serving better the management activities and enforcement of legal provisions.

However, the understanding of the dissemination and education of laws in the banking sector is still incomplete, implementation has not been placed at the same level as the requirements for social management through the rule of law, and has not been conducted regularly, continuously, and comprehensively.

To further promote the dissemination and education of laws, helping banking cadres grasp correctly and promptly the guidelines, policies of the Party and the laws of the State, legal provisions concerning the banking sector, contributing to enhancing their knowledge and respect for the law, ensuring the effectiveness of law enforcement in accordance with the spirit of Directive 32 of the Politburo, the Governor of the State Bank of Vietnam requests the heads of units under the State Bank of Vietnam, the Deposit Insurance Corporation of Vietnam, the permanent agencies of associations managed by the State Bank of Vietnam, and credit organizations (hereinafter referred to as units) to implement the following contents:

1. Strictly implement Directive No. 32 of the Politburo, combining the dissemination and education of laws with the promotion of the guidelines and policies of the Party and the laws of the State. Link the implementation of Directive No. 32 of the Politburo with the implementation of the Resolution of the 10th National Congress of the Communist Party of Vietnam, the program, and action plan of the banking sector in each period. Towards conducting a nationwide mid-term review of the implementation of Directive No. 32 of the Politburo in 2007, the Legal Department will advise the Ban Cán Sự Party and the leadership of the State Bank of Vietnam to direct the organization of a mid-term review of the implementation of Directive No. 32 on the dissemination and promotion of laws in the banking sector.

2. Continue to effectively implement the Law Dissemination and Education Program from 2003 to 2007 issued together with Decision No. 13/2003/QĐ-TTg dated January 17, 2003 of the Prime Minister. The dissemination and education of laws need to strengthen innovation in methods, diversify dissemination forms such as: Emphasizing the promotion and dissemination of newly issued regulatory legal documents; Strengthening the publication and distribution of legal question-and-answer materials; Regularly posting new documents on the website of the State Bank of Vietnam and the internal network of the State Bank of Vietnam; Organizing legal knowledge contests throughout the banking sector; Providing banking cadres with full access to legal knowledge about economic management, trade, civil matters, international treaties, and international practices related to Vietnam's international cooperation with countries and international organizations that Vietnam participates in, which are relevant to banking activities...

This work needs to be carried out regularly, continuously, widely, ensuring scientificity and up-to-dateness; Selecting and applying appropriate dissemination methods suitable for different types of subjects to meet the needs of law dissemination and education during the process of international integration.

Units must continue to recognize the dissemination and education of laws as part of political and ideological education, a regular task of the entire sector under the leadership of the Party. Each banking cadre must recognize the study and research of laws as their responsibility, set a good example in complying with the law, contributing to making the dissemination and education of laws in the banking sector effective.

4. The dissemination and education of laws must be placed under strict and direct leadership by party committees at all levels. Political organizations and political-social organizations in the banking sector must actively play their roles in mobilizing members to participate positively in law dissemination and promotion activities, adopting appropriate measures to enhance legal knowledge and create a habit of strictly abiding by the law; Timely organizing commendation and promotion of exemplary individuals and deeds; Supervising the enforcement of laws by units and banking cadres. At the same time, political organizations and political-social organizations in the banking sector must closely cooperate with units in organizing the implementation of law dissemination and education activities.

5. Information media agencies in the banking sector must continue to coordinate with units to promptly publish information on the issuance of regulatory legal documents; Publish the main content of newly issued regulatory legal documents; Provide information on conferences and training sessions on law dissemination and promotion in the banking sector... The press agency of the sector needs to increase special pages and columns on law dissemination and education with appropriate forms.

5. The agencies, information media outlets in the Banking sector shall continue to coordinate with relevant units to promptly publish information on the issuance of regulatory legal documents; Publish the essential contents of newly issued regulatory legal documents; Provide information on conferences and training sessions on the dissemination and promotion of laws within the banking sector... The press organs of the sector need to enhance specialized pages and sections on the dissemination and education of laws through appropriate forms.

6. Exploit effectively the system of consolidated legal texts that have been updated and stored on the government's, National Assembly's, and ministries' information networks. Continue to improve the database of legal texts on the website of the State Bank and the internal network of the State Bank to serve work requirements and use this database as a means to widely disseminate laws.

7. Strengthen the organization implementing tasks of law dissemination and education from the central level (establishing a Law Dissemination and Education Council for the banking sector) to the legal departments of various units. Each legal department of the units must allocate staff with expertise in law to oversee and carry out law dissemination and education activities within their units.

Consolidate and enhance the effectiveness of the team of legal report officers and propagandists in the banking sector. Intensify the organization of training sessions on law dissemination and education for the team of legal report officers and propagandists, creating favorable conditions for these teams to operate efficiently and effectively.

8. The Legal Department shall be responsible for leading the implementation of law dissemination and propaganda activities in the banking sector; monitor and inspect the implementation of this Directive. The Legal Department shall proactively develop outlines and guidelines for disseminating legal texts, including Laws and Ordinances. Coordinate with drafting units to disseminate legal regulatory texts issued by the State Bank. Coordinate with the Ministry of Justice to organize training sessions for the team of legal report officers and propagandists in the banking sector.

Heads of units are responsible for thoroughly implementing and enforcing this Directive, as well as supervising compliance with the law by staff within their units: Regularly report on the progress of law dissemination and education activities of their unit for the first six months of the year (before July 1st each year) and the annual summary (before December 1st each year) to the Legal Department for reporting to the Governor.

This Directive takes effect fifteen days after its publication in the Official Gazette./.
