Pursuant to the Education Law dated June 14, 2005;

Pursuant to the Ordinance on Preferential Treatment for Persons Contributing to the Revolution dated June 29, 2005;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of the Department of Higher Education and Postgraduate Studies,

Pursuant to …;

Article 1. The Minister of Education and Training amends and supplements certain provisions of the University Admissions Regulation for regular programs issued together with Decision No. 07/2005/QĐ-BGD&ĐT dated March 4, 2005 of the Minister of Education and Training, as follows:

1. Point b of Clause 1 of Article 5 is amended and supplemented as follows:

"b) Must have sufficient health to study according to the current regulations of the Ministry of Health and Ministry of Education and Training. Disabled persons; children of those affected by Agent Orange who are recognized by the provincial People's Committee as having deformities, disabilities, or reduced self-sufficiency in daily life and study due to the consequences of chemical toxins, depending on their health condition and the requirements of the major, the Rector shall consider and decide whether they can take the entrance examination."

2. Object 04 specified in point a of Clause 1 of Article 7 is amended and supplemented as follows:

"- Object 04:

+ Children of martyrs;

+ Children of war invalids with over 81% loss of working capacity;

+ Children of those holding certificates entitled to benefits equivalent to war invalids with over 81% loss of working capacity;

+ Children of Heroic Mothers, Heroes of the Armed Forces, and Heroes of Labor;

+ Children of those engaged in revolutionary activities before January 1, 1945 or children of those engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945;

+ Children of those affected by Agent Orange who are recognized by the provincial People's Committee as having deformities, disabilities, or reduced self-sufficiency in daily life and study due to the consequences of chemical toxins."

3. Point c of Clause 1 of Article 28 is amended and supplemented as follows:

"c) Graders must grade papers strictly according to the grading scale and official answers approved by the Chairman of the Examination Board (for schools that set their own exam questions) or by the Head of the Exam Question Board of the Ministry of Education and Training (for schools using common exam questions provided by the Ministry of Education and Training).

When grading, rounding off scores for each paper should not be done manually. Computer rounding off should follow the principle: If the total score of three subjects has a decimal part from 0.25 to less than 0.5, it should be rounded up to 0.5; if the decimal part is from 0.75 to less than 1.0, it should be rounded up to 1.0.

Papers with correct answers and creative solutions different from the official answers may be awarded bonus points. The level of bonus points proposed by the grader must be approved by the Head of the Grading Team but cannot exceed 1 point."

4. Point d of Clause 1 of Article 38 is amended and supplemented as follows:

"d) Termination of employment or legal punishment for those committing any of the following violations:

- Taking exam questions out of the examination area or bringing solutions from outside into the examination room during the exam.

- Leaking exam questions, buying or selling exam questions.

- Revealing the identification number of exam papers.

- Altering, adding to, or subtracting from candidates' answers.

- Tampering with scores on exam papers, on marking sheets, or in score books.

- Swapping candidates' examination papers, identification numbers, or scores;

- Deception in admission procedures and summoning admitted candidates (including altering school records or high school graduation test scores to qualify students for direct admission or admission).

- Admission officers who lose candidates' papers when collecting, transporting, storing, or grading them, or commit other violations in the admission process will be disciplined according to the provisions of this Article."

5. Point b of Clause 3 of Article 39 is amended and supplemented as follows:

"b) Bringing examination materials; technical devices for recording, transmitting, or receiving information, audio or video recording equipment, or devices containing information that could be used to answer exam questions; weapons, explosives, flammable substances, or other dangerous items into the examination room."

Article 2. The following provisions of the University Admissions Regulation for regular programs issued together with Decision No. 07/2005/QĐ-BGD&ĐT dated March 4, 2005 of the Minister of Education and Training are abolished:

1. Points h and g of Clause 2 of Article 7: Abolish the bonus point system for high school graduates classified as excellent.

2. Point b of Clause 1 of Article 38: Abolish the phrase: “Loss of exam papers during collection, transportation, or grading.”

3. Point c of Clause 1 of Article 38: Abolish the phrase: “Participation in negative actions such as taking exam questions out of the examination area or bringing solutions from outside into the examination room during the exam.”

4. Abolish point b of Clause 2 of Article 39.

Article 3. This Decision takes effect from March 25, 2006. All previous regulations contrary to this Decision are hereby abolished.

Article 4. Directors of the Office, Inspector General, Directors of the Department of Higher Education and Postgraduate Studies, Heads of the Testing and Quality Assurance Department, Heads of relevant units under the Ministry of Education and Training, Ministers of Ministries, Heads of agencies at the ministerial level with universities, Chairmen of Provincial People's Committees, Directors of Departments of Education and Training, Directors of Universities and Academies, Principals of universities and colleges are responsible for implementing this Decision./.
