Circular No. 05/2006/TT-BCA-C11 guiding the implementation of Decision No. 14/2000/QĐ-TTg dated January 27, 2000 of the Government on domestic delegations and foreign guests coming to Vietnam with traffic police escort vehicles.

CIRCULAR

Guidelines for implementing Decision No. 14/2000/QĐ-TTg dated January 27, 2000 of the Prime Minister regarding domestic delegations and foreign guests to Vietnam having traffic police escort vehicles

To continue strictly and effectively implementing Decision No. 14/2000/QĐ-TTg dated January 27, 2000 of the Prime Minister regarding domestic delegations and foreign guests to Vietnam having traffic police escort vehicles, the Ministry of Public Security issues this Circular to guide implementation as follows:

1. State agencies, organizations, People's Committees of provinces and centrally governed cities (hereinafter referred to as agencies and organizations) that have domestic delegations and foreign guests to Vietnam according to regulations requiring traffic police escort vehicles must assign staff to directly contact traffic police agencies to handle procedures and coordinate in organizing escort activities.

2. Traffic police forces, which are assigned by the Government and the Ministry of Public Security to escort domestic delegations and foreign guests to Vietnam (hereinafter referred to as escorting delegations), must comply with the provisions of Decision No. 14/2000/QĐ-TTg of the Prime Minister and this Circular, closely cooperate with agencies and organizations to ensure safe and smooth escort operations.

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

Any arbitrary organization of escort activities, actions hindering the escort operations of traffic police forces, or taking advantage of escort duties to cause inconvenience, harassment, or infringement upon the legitimate rights and interests of agencies, organizations, and individuals must be promptly detected and strictly dealt with according to the law.

3. Traffic police escort vehicles are specialized automobiles and motorcycles as prescribed by the Ministry of Public Security and managed and used directly by traffic police forces in accordance with regulations.

During the execution of escort duties, traffic police forces shall exercise priority rights and use signals of priority vehicles in compliance with the Road Traffic Law and other relevant laws, without abusing the use of priority vehicle signals (not using continuous priority horns) causing unnecessary noise. When there is a priority signal from a traffic police escort vehicle, drivers of motor vehicles must immediately reduce speed, avoid or stop close to the right curb, pedestrians must not run across the road, nor walk or stand on the road to yield way to the priority convoy as stipulated by law.

II. OBJECTS WITH TRAFFIC POLICE ESCORT VEHICLES

1. The objects specified in Clause 1 and Clause 2, Article 1 of Decision No. 14/2000/QĐ-TTg of the Prime Minister;

2. Other objects as specified in Clause 3, Article 1 of Decision No. 14/2000/QĐ-TTg of the Prime Minister, including:

a. For domestic delegations:

- Delegations during the time attending the Central Committee Congress of the Communist Party of Vietnam;

- Delegations during the time attending the National Congress of the Vietnam Fatherland Front;

- Delegations during the time attending the National Congress of the Vietnam General Confederation of Labor;

- Delegations during the time attending the National Congress of the Vietnam Youth Federation;

- Delegations during the time attending the National Congress of the Vietnam Women's Union;

- Delegations during the time attending the National Congress of the Vietnam Farmers' Association;

- Delegations during the time attending the National Congress of the Vietnam Veterans' Association;

- Delegations during the time attending the National Patriotic Exemplary Congress;

- Domestic, regional, and international sports events organized or hosted by the state.

b. For foreign delegations:

- Heads of provincial or centrally governed city party committees, people's councils, or equivalent positions: Secretaries, Chairmen, Provincial Governors, State Governors, Special Zone Chiefs, or equivalent;

- Military delegations led by the Chief of Staff or equivalent;

- Police delegations led by the Police Commander or equivalent.

c. In other cases requiring traffic police escort vehicles, agencies and organizations must submit a written request to the Minister of Public Security for consideration and decision.

III. PROCEDURES AND REGIME FOR ESCORTING DELEGATIONS

1. Procedures include:

a. A letter requesting traffic police escort vehicles and the delegation's program signed by the head of the agency or organization or authorized representative, stamped (according to the model attached to this Circular).

b. For cases specified in Clause 3, Article 1 of Decision No. 14/2000/QĐ-TTg of the Prime Minister and Point 2, Section II of this Circular, a copy of the approval document from the competent authority is required.

2. Time to complete the procedure for requesting escort services is specified as follows:

a. Five working days prior to the start of the escort service for delegations as specified in Clause 1 and Clause 2, Article 1 of Decision No. 14/2000/QĐ-TTg of the Prime Minister (except for urgent cases under security escort); b. Ten working days prior to the start of the escort service for other cases as specified in Clause 3, Article 1 of Decision No. 14/2000/QĐ-TTg of the Prime Minister (as stipulated in Point 2, Section II of this Circular).

3. Responsibilities for escorting delegations:

a. The Highway and Railway Traffic Police Corps is responsible for directing escort activities nationwide; organizing the receipt of requests for escorting delegations operating in three or more provinces or centrally governed cities to direct, assign tasks, and guide the Traffic Police Departments of provinces and centrally governed cities to carry out escorting delegations or directly escort delegations; organizing the escorting of delegations assigned by the Ministry of Public Security. b. The Traffic Police Departments of provinces and centrally governed cities organize the receipt of requests and carry out escorting delegations operating within their province or city and when delegations arrive at adjacent provinces or cities; organizing the escorting of delegations according to the directives and guidance of the Highway and Railway Traffic Police Corps.

b. Before 10 (ten) working days when the organization implements escort duties for other cases as stipulated in Clause 3, Article 1 of Decision 14/2000/QĐ-TTg of the Prime Minister (as provided in Point 2, Section II of this Circular). 3. Responsibilities for escort duties:

a. The Highway and Railway Traffic Police Corps shall be responsible for directing escort operations nationwide; organizing the receipt of requests to escort delegations with activities spanning three (three) provinces or centrally governed cities or more, to direct, assign tasks, and guide the Provincial and Municipally Affiliated Public Security Traffic Police Departments to perform escort duties or directly escort delegations; organizing the escort of delegations assigned by the Ministry of Public Security.

b. The Provincial and Municipally Affiliated Public Security Traffic Police Departments shall organize the receipt of requests and perform escort duties for delegations with activities within their province or city and when delegations arrive at adjacent provinces or cities and vice versa; organizing the escort of delegations according to the direction and guidance of the Highway and Railway Traffic Police Corps.

b. The Traffic Police Department of the Provincial Public Security Force, directly under the Central Government, organizes the reception of requests and leads delegations with operational scope within the province or city; when delegations arrive at adjacent provinces or cities, it leads such delegations in accordance with the directives and guidance of the Highway-Railway Traffic Police Corps.

c. The Command of Security Escort shall receive requests for escorting delegations falling under the scope of Security Escort and immediately notify the Highway Police Corps under the Ministry of Public Security for delegations operating in three (3) provinces or centrally governed cities or more; immediately notify the Traffic Police Department of the provincial or centrally governed city police force for delegations operating within one province or centrally governed city and when such delegations arrive at neighboring provinces or centrally governed cities and vice versa to organize escort services according to regulations.

4. Coordination relations in escort service work:

a. Agencies and organizations requesting escort services shall be responsible for closely coordinating with traffic police forces throughout the entire process of escort services: When there are changes in the program, time, location, pick-up, drop-off, or escort services, they must promptly inform; create favorable conditions for traffic police forces to quickly resolve issues related to the activities of the delegation in accordance with the provisions of the law.

b. The Highway Police Corps shall coordinate with the Command of Security Escort to uniformly issue regulations on directing and organizing escort services for delegations falling under the scope of Security Escort.

c. The Highway Police Corps and the provincial or centrally governed city police forces shall closely coordinate in directing and organizing escort services:

- The Highway Police Corps: When directing or guiding the Traffic Police Departments or directly escorting delegations, it shall simultaneously inform the relevant provincial or centrally governed city police forces to coordinate in directing.

- The provincial or centrally governed city police forces: When directing the Traffic Police Departments to organize escort services, it shall simultaneously inform the Highway Police Corps and the relevant local police forces to monitor and coordinate in directing.

d. The Traffic Police Departments of the provincial or centrally governed city police forces shall be responsible for promptly informing and coordinating with the relevant Traffic Police Departments of other provincial or centrally governed city police forces to organize escort services ensuring safety and smooth traffic flow. Units under the provincial or centrally governed city police forces, based on their functions and responsibilities, shall be responsible for closely coordinating with the Traffic Police Departments to organize escort services, ensuring public security and traffic safety.

The Traffic Police Departments shall implement information reporting systems as prescribed; plans, schemes, results of coordination and organization of escort services must be reported to the provincial or centrally governed city police forces and the Highway Police Corps for monitoring, directing, and timely guidance.

IV. IMPLEMENTATION

1. Agencies, organizations, and People's Committees of provinces or centrally governed cities requesting escort vehicles shall be responsible for implementing Decision No. 14/2000/QĐ-TTg of the Prime Minister and the guidelines set out in this Circular.

2. Heads of units subordinate to the Minister within the scope of their functions and duties shall be responsible for directing and implementing in accordance with the guidelines set out in this Circular.

3. The Highway Police Corps shall guide and inspect escort services to ensure compliance with Decision No. 14/2000/QĐ-TTg of the Prime Minister and the guidelines set out in this Circular as well as other regulations of the Government and the Ministry of Public Security related to escort services; organize research and propose projects to the Minister regarding organization, equipment, and construction of other documents related to escort services.

4. Directors of provincial or centrally governed city police forces shall direct Traffic Police and related units to implement escort services in accordance with the provisions of this Circular and the directives and guidance of the Highway Police Corps.

5. This Circular shall take effect fifteen days from the date of publication in the Official Gazette and replace Circular No. 10/2000/TT-BCA(C11) dated July 4, 2000 of the Ministry of Public Security.

During implementation, if there are difficulties, agencies, organizations, and local police units shall report and reflect to the Ministry of Public Security (through the Highway Police Corps) for timely guidance and resolution.
