Based on the Road Traffic Law dated June 29, 2001;

Based on Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Based on Circular No. 1992/TTg-CN dated December 21, 2007 of the Prime Minister regarding the production, assembly, import, and circulation of three-wheeled vehicles and motorized vehicles for persons with disabilities;

At the proposal of the Director of the Cadre and Civil Service Department, the Director of the Vietnam Highway Administration,

DECISION:

Article 1. Now promulgates to supplement certain contents in training, examination, and issuing driving licenses for persons with disabilities as follows:

1. On Training

a) Students may self-study theory and practice according to the content, program, and procedures prescribed in Decision No. 56/2007/QĐ-BGTVT and Decision No. 55/2007/QĐ-BGTVT dated November 7, 2007 of the Minister of Transport. Before the examination, if students wish to review and have questions answered, they shall register with the training institution to receive guidance;

b) In case students wish to attend concentrated study, they shall register with the training institution to study according to the prescribed content and program;

Training institutions shall exempt or reduce tuition fees for students according to current policies.

2. Regarding Examination

a) Theoretical examination shall be conducted according to the current motorcycle category A1 examination content using multiple-choice methods;

b) Practical driving examination in simulated conditions shall be carried out according to the guidelines of the Vietnam Highway Administration;

Motorcycles used for examination shall be those owned by the examinees and registered with license plates by authorized agencies as prescribed;

The organization of examinations to issue driving licenses for persons with disabilities shall be implemented according to the Examination Management Regulations and Driving License Issuance Regulations issued together with Decision No. 54/2007/QĐ-BGTVT dated November 7, 2007 of the Minister of Transport.

3. Regarding Issuing Driving Licenses

a) The driving license issued to persons with disabilities to operate motorcycles for persons with disabilities participating in road traffic is a Class A1 motor vehicle driving license, which is part of the system of motor vehicle driving licenses in Vietnam;

b) The management of issuance, renewal, and reissuance of motor vehicle driving licenses for persons with disabilities shall be carried out according to the Examination Management Regulations and Driving License Issuance Regulations issued together with Decision No. 54/2007/QĐ-BGTVT dated November 7, 2007 of the Minister of Transport.

Article 2. Responsibilities of management agencies

manages the unified issuance of IDPs nationwide and has the following responsibilities:

a) Guide the implementation of this Decision;

b) Inspect, supervise, and compile reports on the training, examination, and issuance of driving licenses for persons with disabilities nationwide and report to the Ministry of Transport as prescribed.

2. Departments of Transport, Departments of Transport and Public Works

a) Direct and guide training institutions within their respective provinces and centrally-administered cities to prepare sufficient conditions for training and examining driving licenses for persons with disabilities;

b) Manage the training, examination, issuance, renewal, and reissuance of driving licenses for persons with disabilities according to this Decision and current regulations;

c) Regularly report to the Ministry of Transport (through the Vietnam Highway Administration) as prescribed.

Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette.

Article 4. The Head of the Ministry's Office, the Inspector General of the Ministry, the Director of the Cadre and Civil Service Department, the Director of the Vietnam Highway Administration, the Directors of Provincial Departments of Transport, Departments of Transport and Public Works, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
