Pursuant to Decree No. 13/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the central government;
Pursuant to Decree No. 14/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under district, town, and provincial city People's Committees;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Ministry of Planning and Investment and the Ministry of Home Affairs issue guidelines on the functions, tasks, powers, and organizational structure of specialized agencies in the field of planning and investment under provincial and district People's Committees as follows:
PART I
2. The Department of Planning and Investment has legal personality, its own seal and separate account; it is subject to the direction and management of the provincial People's Committee regarding organization, staffing, and personnel work; at the same time, it is subject to the direction, guidance, inspection, and supervision of the Ministry of Planning and Investment in terms of professional and technical matters.
Article 1. Position and Functions
1. The Department of Planning and Investment is a specialized agency under provincial People's Committees and municipal People's Committees directly under the central government (hereinafter referred to collectively as provincial People's Committees) with the function of advising and assisting provincial People's Committees in performing state management functions in the fields of planning and investment, including: comprehensive planning and development plans for economic and social affairs; organizing implementation and proposing mechanisms and policies for economic and social management within the province; domestic investment, foreign investment at the local level; managing official development assistance (ODA) sources and non-governmental aid sources; bidding; business registration within the local area; consolidating and uniformly managing issues related to enterprises, collective economic entities, and private economic entities; organizing the provision of public services within the scope of management by the Department according to the provisions of the law.
2. The Department of Planning and Investment has legal personality, its own seal and separate account; it is subject to the direction and management of organizational structure, staffing, and activities by the provincial People's Committee; at the same time, it is subject to the direction, guidance, inspection, and supervision of the Ministry of Planning and Investment in terms of professional and technical matters.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Department of Planning and Investment performs tasks and powers as prescribed by law in the field of planning and investment and the following specific tasks and powers:
1. Submit to the provincial People's Committee:
a) Drafting overall master plans, strategies, five-year and annual socio-economic development plans of the province, allocating provincial budget capital investment plans; investment promotion plans of the province; major economic and social balances of the province, including accumulation and consumption balances, investment development capital balances, financial balances;
b) Drafting action programs to implement socio-economic development plans according to the resolutions of the provincial People's Council and being responsible for monitoring and summarizing the implementation situation of monthly, quarterly, six-monthly, and annual plans to report to the provincial People's Committee for management and coordination in implementing major economic and social balances of the province;
c) Drafting programs and plans for restructuring, reform, and development of state-owned enterprises managed by the locality; management mechanisms and support policies for the restructuring of state-owned enterprises and the development of small and medium-sized enterprises belonging to various economic sectors within the province;
d) Drafting decisions, directives; programs, and measures to organize the implementation of administrative reforms in the field of planning and investment within the scope of management of the Department according to the provisions of the law and the delegation of the Ministry of Planning and Investment;
đ) Drafting legal documents specifying standards for positions at the head and deputy levels of units under the Department; heads and deputies of finance and planning departments under district People's Committees after coordinating opinions with the Department of Finance according to the division of responsibilities of the provincial People's Committee;
e) Drafting legal documents regarding the list of domestic and foreign investment projects for each planning period and adjustments when necessary;
2. Submitting to the Chairman of the Provincial People's Committee:
a) Drafting Decisions, directives, and other documents within the authority to promulish of the Chairman of the provincial People's Committee in the field of state management of the Department;
b) Drafting decisions on the establishment, merger, division, reorganization, and dissolution of organizations and units under the Department according to the provisions of the law;
c) Issuing, adjusting, and revoking Investment Certificates within the authority of the provincial People's Committee according to the delegation.
3. Assist the Chairman of the provincial People's Committee in directing, guiding, inspecting, informing, propagandizing, and educating the law in the field of planning and investment; organizing the implementation of regulatory legal documents, policies, plans, programs, projects, and proposals within the scope of state management of the Department after they have been issued or approved by competent authorities.
4. On planning and planning
a) Announcing and being responsible for organizing the implementation of the overall socio-economic development plan of the province after approval according to regulations;
b) Managing and directing certain areas of plan implementation assigned by the provincial People's Committee;
c) Guiding departments, committees, and district, town, and provincial city People's Committees in building plans and programs consistent with the overall socio-economic development plans of the province that have been approved;
d) Cooperating with the Department of Finance to prepare the provincial budget and allocate the budget to agencies, organizations, and units in the province.
5. On domestic and foreign investment:
a) Taking the lead and coordinating with the Department of Finance in drafting plans and allocating development investment funds for each program and project under the national budget managed by the province in accordance with the total investment amount and investment structure by industry and sector;
b) Taking the lead and coordinating with the Department of Finance and relevant departments in inspecting, supervising, and evaluating the effectiveness of the use of development investment funds for programs and projects in the locality; supervising community investment according to the provisions of the law;
c) Serve as the focal point for receiving, inspecting, supervising, appraising, and reviewing investment projects within the jurisdiction of the provincial People's Committee;
d) Managing domestic and foreign direct investment activities in the province according to the law; organizing investment promotion activities according to the plan approved by the provincial People's Committee; guiding investment procedures according to authority;
6. Regarding ODA and non-governmental aid management:
a) Mobilizing, attracting, and coordinating the management of ODA and non-governmental aid sources of the province; guiding departments and committees in compiling lists and contents of programs using ODA and non-governmental aid sources; consolidating lists of programs and projects using ODA and non-governmental aid sources to submit to the provincial People's Committee for approval and reporting to the Ministry of Planning and Investment;
b) Evaluate the implementation of ODA programs and projects and non-governmental aid sources; handle within authority or recommend the Chairman of the Provincial People's Committee to resolve issues arising from the allocation of counterpart funds and disbursement for the implementation of ODA projects and non-governmental aid sources involving multiple departments, districts, and communes; periodically compile and report on the situation and effectiveness of attracting and utilizing ODA funds and non-governmental aid sources.
7. Regarding tender management:
a) Examine and be responsible for the content of documents submitted to the Chairman of the Provincial People's Committee regarding bidding plans, tender documents, and the results of contractor selection for projects or packages within the Chairman's decision-making authority; examine and approve bidding plans and the results of contractor selection for projects or packages authorized by the Chairman of the Provincial People's Committee.
b) Guide, monitor, inspect, and audit the implementation of laws on bidding; periodically compile and report on the implementation status of approved bidding projects and the bidding process according to regulations.
8. Regarding enterprises and business registration:
a) Examine and be responsible for proposals to establish, reorganize, and restructure state-owned enterprises managed by localities; compile the situation of restructuring, modernizing, and developing state-owned enterprises and the development of other types of enterprises.
b) Implement and be responsible for business registration procedures; temporary suspension of business registration; issuance, supplementation, change, replacement, and revocation of Business Registration Certificates and Certificates of Branch and Representative Office Registration within the Department's jurisdiction; coordinate with relevant sectors to inspect, track, compile the situation, and handle violations related to business registration of enterprises in the locality according to authority; collect, store, and manage information on business registration in accordance with the law.
9. Regarding collective economy and private sector:
a) Serve as the focal point for compiling models, policies, mechanisms, and plans for developing the collective economy and the private sector; guide, monitor, compile, and evaluate the implementation of programs, plans, mechanisms, and policies for developing the collective economy and the private sector and the activities of economic organizations in these sectors within the province.
b) Lead and coordinate with relevant agencies to resolve issues related to policies and mechanisms for developing the collective economy and the private sector that involve inter-departmental matters.
c) Serve as the focal point for coordinating with domestic and international organizations to research, summarize experiences, develop assistance programs, attract capital, and resources to serve the development of the collective economy and the private sector within the province.
d) Regularly prepare reports in accordance with the guidelines of the Ministry of Planning and Investment to submit to the Provincial People's Committee, the Ministry of Planning and Investment, and relevant ministries and agencies about the development of the collective economy and the private sector within the province.
10. Implement international cooperation in planning and investment fields in accordance with the law and the division of labor or delegation of authority by the Provincial People's Committee.
11. Be responsible for providing professional guidance and business operations in the planning and investment field under the management of the planning and investment sector to the Finance and Planning Departments of the District People's Committees.
12. Organize research and application of scientific and technological progress; establish information systems and archives to serve state management and professional activities in assigned fields.
13. Conduct inspections, audits, complaints, and denunciations in accordance with the law; handle within authority or recommend competent authorities to handle violations of the law in areas under the management of the Department; prevent corruption, waste, and promote thrift and combat wastefulness.
14. Define the functions, tasks, powers, and working relationships of subordinate organizations and units; manage staffing, implement salary systems, and policies and benefits, training, rewards, and disciplinary measures for cadres, civil servants, and employees under the Department's management in accordance with the law and provincial government delegation.
15. Manage finances and assets assigned in accordance with the law and provincial government delegation.
16. Carry out regular and ad hoc reporting on the implementation of tasks as stipulated by the Provincial People's Committee and the Ministry of Planning and Investment.
17. Perform other tasks assigned by the Provincial People's Committee in accordance with the law.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Leadership of the Department:
a) The Department of Planning and Investment shall have a Director and not more than three Deputy Directors; for Hanoi and Ho Chi Minh City, not more than four Deputy Directors.
b) The Director of the Department is the head of the Department, accountable to the People's Committee, the Chairman of the Provincial People's Committee, and the law for all activities of the Department; accountable for reporting work to the Provincial People's Council, the Provincial People's Committee, and the Ministry of Planning and Investment as prescribed.
c) The Deputy Director of the Department assists the Director, accountable to the Director and the law for assigned tasks; when the Director is absent, a Deputy Director appointed by the Director may oversee the Department's activities.
d) The appointment and reappointment of the Director and Deputy Directors of the Department of Planning and Investment shall be decided by the Provincial People's Committee based on professional standards issued by competent authorities and national regulations on cadre management.
The transfer, rotation, commendation, punishment, removal, resignation, retirement, and implementation of other policies for the Director and Deputy Directors of the Department of Planning and Investment shall be carried out in accordance with the law.
2. Organizational Structure:
a) Specialized and professional departments;
b) Business Registration Department;
c) Office spaces;
d) Inspection Department;
đ) Subordinate service units.
BASED ON THE NATURE, CHARACTERISTICS AND MANAGEMENT REQUIREMENTS OF THE STATE ADMINISTRATION IN THE LOCAL AREA, THE DIRECTOR OF THE DEPARTMENT OF PLANNING AND INVESTMENT SHALL TAKE THE LEAD AND COORDINATE WITH THE DIRECTOR OF THE DEPARTMENT OF ADMINISTRATIVE AFFAIRS TO SUBMIT TO THE CHAIRMAN OF THE PROVINCE PEOPLE'S COMMITTEE FOR DECISION ON THE SPECIFIC NUMBER AND NAMES OF THE SPECIALIZED AND BUSINESS DIVISIONS UNDER THE DEPARTMENT OF PLANNING AND INVESTMENT, BUT THE MAXIMUM NUMBER OF SUCH DIVISIONS SHALL NOT EXCEED SIX (6); FOR HA NOI CITY AND HO CHI MINH CITY, THIS NUMBER SHALL NOT EXCEED SEVEN (7).
IT IS NOT NECESSARY FOR ALL DEPARTMENTS OF PLANNING AND INVESTMENT TO HAVE THE ORGANIZATIONS AS PROVIDED FOR IN POINT D, CLAUSE 2 OF THIS ARTICLE. THE ESTABLISHMENT OF PUBLIC SERVICE UNITS UNDER THE DEPARTMENT OF PLANNING AND INVESTMENT SHALL BE DECIDED BY THE PROVINCE PEOPLE'S COMMITTEE IN ACCORDANCE WITH THE LAWS.
3. Staffing:
a) THE ADMINISTRATIVE STAFF COMPLEMENT OF THE DEPARTMENT OF PLANNING AND INVESTMENT SHALL BE DECIDED BY THE PROVINCE PEOPLE'S COMMITTEE WITHIN THE TOTAL ADMINISTRATIVE STAFF COMPLEMENT OF THE PROVINCE ALLOCATED BY THE CENTRAL AUTHORITIES.
b) THE PUBLIC SERVICE STAFF COMPLEMENT OF THE PUBLIC SERVICE UNITS DIRECTLY UNDER THE DEPARTMENT OF PLANNING AND INVESTMENT SHALL BE DECIDED BY THE PROVINCE PEOPLE'S COMMITTEE IN ACCORDANCE WITH THE STAFF COMPLEMENT STANDARDS AND THE LAWS.
Chapter II
FINANCE AND PLANNING DEPARTMENT
1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.
1. THE FINANCE AND PLANNING DEPARTMENT IS A SPECIALIZED UNIT UNDER THE DISTRICT PEOPLE'S COMMITTEE (HEREINAFTER REFERRED TO AS THE DISTRICT PEOPLE'S COMMITTEE) WITH THE FUNCTION OF ADVISING AND ASSISTING THE DISTRICT PEOPLE'S COMMITTEE IN EXERCISING THE STATE ADMINISTRATION FUNCTIONS IN THE AREAS OF PLANNING AND INVESTMENT; BUSINESS REGISTRATION; COLLECTING, SYNTHESIZING AND UNIFIED MANAGEMENT OF COOPERATIVE ECONOMY AND PRIVATE ECONOMY IN ACCORDANCE WITH THE LAWS.
THE IMPLEMENTATION OF THE ADVISING AND ASSISTING FUNCTIONS IN THE FIELD OF FINANCE AND ASSETS OF THE FINANCE AND PLANNING DEPARTMENT SHALL BE GUIDED BY THE MINISTRY OF FINANCE AND THE MINISTRY OF HOME AFFAIRS.
2. THE FINANCE AND PLANNING DEPARTMENT SHALL HAVE ITS OWN SEAL AND ACCOUNT; IT SHALL BE SUBJECT TO THE DIRECTIVES AND MANAGEMENT OF THE DISTRICT PEOPLE'S COMMITTEE REGARDING ORGANIZATION, STAFF COMPLEMENT AND OPERATIONS; AT THE SAME TIME, IT SHALL BE SUBJECT TO THE DIRECTIVES, INSPECTION AND GUIDANCE OF THE DEPARTMENT OF PLANNING AND INVESTMENT REGARDING THE SPECIALIZED AND BUSINESS FUNCTIONS IN THE AREAS OF PLANNING AND INVESTMENT.
Article 5. Tasks and Powers
THE FINANCE AND PLANNING DEPARTMENT SHALL PERFORM TASKS AND POWERS IN ACCORDANCE WITH THE LAWS ON PLANNING AND INVESTMENT AND THE FOLLOWING SPECIFIC TASKS AND POWERS:
1. Submit to the People's Committee at the district level:
a) DRAFTING THE FIVE-YEAR AND ANNUAL PLANS OF THE DISTRICT; DEVELOPMENT PROGRAMMES AND PROJECTS, ADMINISTRATIVE REFORM PROGRAMMES IN THE AREAS OF PLANNING AND INVESTMENT IN THE DISTRICT;
b) DRAFTING DECISIONS, DIRECTIVES AND GUIDELINES FOR IMPLEMENTING MECHANISMS, POLICIES AND LAWS AND THE RESOLUTIONS OF THE DISTRICT PEOPLE'S COMMITTEE AND THE DEPARTMENT OF PLANNING AND INVESTMENT REGARDING PLANNING AND INVESTMENT WORK IN THE DISTRICT.
2. SUBMITTING TO THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE THE PROGRAMMES, LISTS AND INVESTMENT PROJECTS IN THE DISTRICT; REVIEWING AND BEING RESPONSIBLE FOR THE PROJECTS AND PLANS OF INVESTMENT IN THE DISTRICT WITHIN THE AUTHORITY OF THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE; REVIEWING AND BEING RESPONSIBLE FOR THE PROCUREMENT PLANS AND THE RESULTS OF CONTRACTORS SELECTION FOR PROJECTS OR BIDS WITHIN THE AUTHORITY OF THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE.
3. IMPLEMENTING LEGAL REGULATIONS, MECHANISMS, POLICIES, PLANS, PROGRAMMES, PROJECTS AND PROPOSALS THAT HAVE BEEN APPROVED BY THE AUTHORIZED AUTHORITIES; DISSEMINATING INFORMATION, PROMOTING AND EDUCATING THE LAWS ON PLANNING AND INVESTMENT IN THE DISTRICT.
4. PROVIDING INFORMATION, PROMOTING INVESTMENT, COORDINATING WITH RELATED SPECIALIZED AND BUSINESS DIVISIONS TO ORGANIZE THE INVITATION OF DOMESTIC AND FOREIGN INVESTORS TO INVEST IN THE DISTRICT; PROVIDING SPECIALIZED AND BUSINESS GUIDANCE TO RURAL OFFICIALS AND CIVIL SERVANTS IN PLANNING AND INVESTMENT WORK.
5. LEADING AND COORDINATING WITH RELATED AUTHORITIES TO MONITOR AND EVALUATE INVESTMENTS; INSPECTING THE IMPLEMENTATION OF LAWS ON PLANNING AND INVESTMENT IN THE DISTRICT; HANDLING COMPLAINTS AND REPORTS AND DEALING WITH VIOLATIONS WITHIN THE AUTHORITY.
6. REGARDING COOPERATIVE ECONOMY AND PRIVATE ECONOMY:
a) ISSUING BUSINESS REGISTRATION CERTIFICATES FOR COOPERATIVE ECONOMIC ORGANIZATIONS AND INDIVIDUAL HOUSEHOLD BUSINESSES IN THE DISTRICT IN ACCORDANCE WITH THE LAWS;
b) COLLECTING, MONITORING AND EVALUATING THE IMPLEMENTATION OF PROGRAMMES, PLANS, MECHANISMS, POLICIES FOR DEVELOPING COOPERATIVE ECONOMY AND PRIVATE ECONOMY AND THE ACTIVITIES OF COOPERATIVE ECONOMIC ORGANIZATIONS AND PRIVATE ECONOMIC ORGANIZATIONS IN THE DISTRICT;
c) REGULARLY PREPARING REPORTS IN ACCORDANCE WITH THE GUIDELINES OF THE MINISTRY OF PLANNING AND INVESTMENT AND SUBMITTING THEM TO RELATED DEPARTMENTS AND THE DEPARTMENT OF PLANNING AND INVESTMENT FOR COMBINED REPORTING TO THE PROVINCE PEOPLE'S COMMITTEE AND THE MINISTRY OF PLANNING AND INVESTMENT.
7. Summarize and report on the implementation of assigned tasks to the People's Committee at the district level and the Provincial Department of Planning and Investment.
8. Organize research and application of scientific and technological progress; build information systems and archives to serve professional management tasks.
9. MANAGING STAFF AND FINANCES AND ASSETS ACCORDING TO THE LAWS AND THE ASSIGNMENTS OF THE DISTRICT PEOPLE'S COMMITTEE.
10. Carry out regular and urgent information and reporting tasks on the implementation of assigned tasks according to regulations.
11. Perform other state management tasks in the field of planning and investment according to assignments, decentralization, or delegations from the People's Committee at the district level and according to the law.
Article 6. Organization and Staffing
1. THE FINANCE AND PLANNING DEPARTMENT SHALL HAVE A DEPARTMENT HEAD AND NO MORE THAN THREE ASSISTANT DEPARTMENT HEADS.
a) THE DEPARTMENT HEAD IS THE HEAD OF THE DEPARTMENT, RESPONSIBLE TO THE DISTRICT PEOPLE'S COMMITTEE, THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE AND THE LAWS FOR ALL ACTIVITIES OF THE DEPARTMENT;
b) THE ASSISTANT DEPARTMENT HEADS ARE ASSISTANTS TO THE DEPARTMENT HEAD, RESPONSIBLE TO THE DEPARTMENT HEAD AND THE LAWS FOR THE TASKS ASSIGNED BY THE DEPARTMENT HEAD; WHEN THE DEPARTMENT HEAD IS ABSENT, ONE ASSISTANT DEPARTMENT HEAD SHALL BE DEPUTIZED BY THE DEPARTMENT HEAD TO MANAGE THE DEPARTMENT'S ACTIVITIES.
c) Among the Office leaders (Director and Deputy Directors), there must be at least one person assigned to oversee planning and investment;
d) THE APPOINTMENT AND REMOVAL OF THE DEPARTMENT HEAD AND ASSISTANT DEPARTMENT HEADS SHALL BE DECIDED BY THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE IN ACCORDANCE WITH THE SPECIALIZED AND BUSINESS STANDARDS ISSUED BY THE PROVINCE PEOPLE'S COMMITTEE.
THE TRANSFER, ROTATION, AWARDS, DISCIPLINARY ACTIONS, REMOVAL, RESIGNATION, RETIREMENT AND IMPLEMENTATION OF OTHER POLICIES FOR THE DEPARTMENT HEAD AND ASSISTANT DEPARTMENT HEADS SHALL BE CONDUCTED IN ACCORDANCE WITH THE LAWS.
2. THE ADMINISTRATIVE STAFF COMPLEMENT OF THE FINANCE AND PLANNING DEPARTMENT SHALL BE DECIDED BY THE CHAIRMAN OF THE DISTRICT PEOPLE'S COMMITTEE WITHIN THE TOTAL ADMINISTRATIVE STAFF COMPLEMENT OF THE DISTRICT ALLOCATED BY THE PROVINCE PEOPLE'S COMMITTEE.

IMPLEMENTING PROVISIONS
Article 7. Effective Date
THIS CIRCULAR SHALL TAKE EFFECT 45 DAYS FROM THE DATE OF SIGNATURE AND REPLACE CIRCULAR JOINTLY ISSUED NUMBER 02/2004/TTLT/BKHĐT-BNV ON JUNE 1, 2004 OF THE MINISTRY OF PLANNING AND INVESTMENT AND THE MINISTRY OF HOME AFFAIRS GUIDING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE SPECIALIZED UNITS ASSISTING THE PEOPLE'S COMMITTEES IN EXERCISING THE STATE ADMINISTRATION FUNCTIONS IN THE AREAS OF PLANNING AND INVESTMENT AT THE LOCAL LEVEL.
Article 8. Responsibility for Implementation
1. THE PROVINCE PEOPLE'S COMMITTEE SHALL SPECIFY THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE DEPARTMENT OF PLANNING AND INVESTMENT; GUIDING THE DISTRICT PEOPLE'S COMMITTEE TO SPECIFY THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE DISTRICT FINANCE AND PLANNING DEPARTMENT.
2. The Chairpersons of Provincial People's Committees shall be responsible for organizing and implementing this Joint Circular.
3. During the implementation process, if any issues arise or difficulties occur, the People's Committees at all levels and relevant units shall promptly reflect them to the Ministry of Planning and Investment and the Ministry of Home Affairs for consideration and resolution within their respective jurisdictions./.
