CIRCULAR

Regulations on the reporting system for basic statistics on science and technology

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

Based on Decree No. 30/2006/NĐ-CP dated March 29, 2006 of the Government on statistics of science and technology;

Based on Circular No. 05/2009/TT-BKHCN dated March 30, 2009 of the Minister of Science and Technology stipulating the System of Indicators for Statistics in the Field of Science and Technology;

The Minister of Science and Technology hereby stipulates the regulations on the reporting system for basic statistics on science and technology as follows:

Article 1. Reporting System for Basic Statistics on Science and Technology

1. The reporting system for basic statistics on science and technology includes: entities responsible for reporting, scope of reporting, content of reports, forms, responsibilities of reporting units, recipients of reports, deadlines for submission, time limits for reporting, and responsibilities of receiving units.

2. Basic statistical reports on science and technology are reports prepared by entities responsible for basic statistical reporting from officially recorded data according to a unified set of forms and submitted to the receiving authority.

3. The scope of reporting includes statistical data within the domain of state management over science and technology, including: scientific and technological activities, development of scientific and technological potential (organizations, human resources, finance, international cooperation), industrial property.

Article 2. Entities Responsible for Reporting Basic Statistics on Science and Technology

1. Entities responsible for reporting basic statistics on science and technology (hereinafter referred to as reporting units) are agencies, units, or organizations with legal personality belonging to one of the following types:

a) Administrative agencies and public service units including:

- Units performing state management functions in science and technology under the Ministry of Science and Technology; public service units under the Ministry of Science and Technology;

- Science and Technology Departments under People's Committees of provinces and centrally-administered cities; public service units under Science and Technology Departments; Science and Technology Offices at districts and counties;

- Other administrative agencies and public service units using state budget funds for scientific and technological activities;

b) State scientific and technological organizations as stipulated in Article 9 of the Law on Science and Technology dated June 9, 2000, including:

- Scientific research organizations, scientific research and technological development organizations (hereinafter collectively referred to as research and development organizations);

- Universities and academies (hereinafter collectively referred to as universities);

- Organizations providing scientific and technological services;

c) State-owned corporations, holding companies, independent accounting companies using state budget funds for scientific and technological activities;

d) Science and technology enterprises; other enterprises using state budget funds for scientific and technological activities;

đ) Organizations: political, political-social, political-social-professional, social, social-professional, and units directly subordinate using state budget funds or sources considered as state budget funds for scientific and technological activities.

2. Administrative agencies, public service units, enterprises, and scientific and technological organizations operating in the field of national defense and security shall not implement the reporting system for basic statistics on science and technology stipulated in this Circular.

ARTICLE 3. CONTENT OF REPORTS AND REPORT FORMS

1. Content and forms of reports include:

a) General information about the reporting unit (Form 01CS-KHCN, Appendix I);

b) Number of employees of the reporting unit (Form 02CS-KHCN, Appendix II);

c) Number of scientific and technological civil servants (Form 03CS-KHCN, Appendix III);

d) Expenditure on science and technology (Form 04CS-KHCN, Appendix IV);

đ) Number of research and development projects (Form 05CS-KHCN, Appendix V);

e) International cooperation in science and technology (Form 06CS-KHCN, Appendix VI);

g) Industrial property (Form 07CS-KHCN, Appendix VII);

h) Science and technology awards (Form 08CS-KHCN, Appendix VIII).

2. The content of the report must be filled out in the forms according to the guidelines stipulated in Appendix IX of this Circular.

Article 4. Reporting Period and Submission Deadline

1. The reporting period is one year, from January 1 to December 31 of the reporting year.

2. Reporting units must send reports to receiving units no later than February 28 of the following year according to the postmark.

ARTICLE 5. FORM OF REPORTS

The report must be prepared in both a written document and an electronic data file formatted in Excel spreadsheet.

Written reports must bear the signature and confirmation stamp of the Head of the reporting unit for ease of verification, comparison, and data processing.

Article 6. Provisions on submission of reports

1. Reporting units under the management of a province or centrally governed municipality shall submit their reports to the Science and Technology Department of that province or centrally governed municipality;

2. Reporting units not covered by Clause 1 of this Article shall submit their reports to:

a) The National Science and Technology Information Agency under the Ministry of Science and Technology;

b) The supervising authority of the reporting unit.

Article 7. Responsibilities of Reporting Units and Receiving Units

1. Reporting units have the responsibility:

a) To report fully, truthfully, objectively, and in accordance with the information content prescribed in the Basic Statistical Reporting System on science and technology, and to bear legal responsibility for the reported contents;

b) To submit reports within the deadline;

c) To check, resubmit reports, and provide related information upon request from the receiving unit;

d) Other responsibilities as prescribed by law.

2. Receiving units specified in Clause 1 and Point a Clause 2 of Article 6 of this Circular have the responsibility:

a) To check, compare, process, and compile data from basic statistical reports into consolidated statistical reports;

b) To require reporting units to check, resubmit reports, and provide related information when necessary;

c) To submit consolidated statistical reports to the National Science and Technology Information Agency under the Ministry of Science and Technology;

d) To provide consolidated statistical information to reporting units;

đ) Providing data to higher-level state management agencies regarding science and technology as prescribed by law;

e) To ensure the publication, use, and confidentiality of statistical information in accordance with the provisions of the Law on Statistics;

g) Other responsibilities as prescribed by law.

Article 8. Effective Date

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. During the implementation process, if there are any difficulties, they should be reported to the Ministry of Science and Technology for consolidation and resolution./.
