MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to the Post and Telecommunications Ordinance dated May 25, 2002;

Pursuant to Decree No. 157/2004/NĐ-CP dated August 18, 2004 of the Government detailing the implementation of certain provisions of the Post and Telecommunications Ordinance;

Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications,

c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B

Article 1. Amending and supplementing Circular No. 01/2005/TT-BBCVT dated May 6, 2005 of the Ministry of Posts and Telecommunications guiding the issuance of business licenses for postal service delivery services and registration as agents for international postal service delivery for foreign postal organizations as follows:

1. Replace the phrase "Ministry of Posts and Telecommunications" with the phrase "Ministry of Information and Communications".

2. Amend and supplement Clause I, Section III as follows:

"1. An enterprise operating international postal service delivery may carry out the activity of acting as an agent for international postal service delivery for foreign postal organizations from the date of confirmation by the Ministry of Information and Communications regarding the registration as an agent for international postal service delivery for foreign postal organizations."

3. Amend and supplement Point 2.1, Clause 2, Section III as follows:

"2.1. The application for registration as an agent shall be prepared in one set and include the following documents:

a) A request for registration as an agent for international postal service delivery for foreign organizations, prepared in two copies according to the form prescribed in Appendix 5 of this Circular.

b) A copy of the business license for international postal service delivery (for domestic enterprises) or a notarized copy of the investment permit (for foreign-invested enterprises) of the enterprise accepting the agency;

c) Documents proving the legal status of the foreign postal organization;

d) A copy of the agency agreement signed and stamped by both parties, certified by the enterprise accepting the agency from the original; e) Samples of service provision and usage contracts (mailing slips or waybills); tariff schedules and service quality standards; rules and levels of compensation for the services provided by the enterprise accepting the agency."

Article 2. This Circular shall take effect forty-five days from the date of signature.

Article 3. Director of the Postal Affairs Department, Heads of units under the Ministry of Information and Communications, domestic and foreign enterprises operating postal service delivery services participating in activities in the postal and delivery sector in Vietnam are responsible for implementing this Circular./.
