Issuing statistical forms and guidelines for collecting information on drug rehabilitation work

and post-rehabilitation management pursuant to Decision No. 127/2009/QD-TTg dated October 26, 2009

Issuing the Reporting System on Statistics for Drug Prevention and Controlof the Prime Minister

Pursuant to the Law on Prevention and Control of Narcotics dated December 9, 2000 and the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics dated June 3, 2008;

Pursuant to Decree No. 186/2007/ND-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Based on the Statistics Law dated June 17, 2003;

Pursuant to Decree No. 40/2004/ND-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

Pursuant to Decision No. 127/2009/QD-TTg dated October 26, 2009 of the Prime Minister issuing the Reporting System on Statistics for Drug Prevention and Control;

Pursuant to Decision No. 43/2010/QD-TTg dated June 2, 2010 of the Prime Minister on issuing national indicators;

After receiving comments from the General Statistics Office under the Ministry of Planning and Investment at Circular No. 13/TCTK-PPC dated January 5, 2011 and the agreement from the Ministry of Public Security at Circular No. 454/BCA-C41 dated March 2, 2010, the Ministry of Labor, Invalids, and Social Affairs issues the statistical forms and guidelines for collecting information on drug rehabilitation work and post-rehabilitation management as follows:

This Circular issues the statistical forms on drug rehabilitation work and post-rehabilitation management, including:

Article 1. Scope of Regulation

1. Basic statistical reports on drug rehabilitation work and post-rehabilitation management;

2. Comprehensive statistical reports on drug rehabilitation work and post-rehabilitation management;

3. Initial record books on drug rehabilitation work and post-rehabilitation management, which serve as the basis for compiling data into basic statistical reports and comprehensive statistical reports.

This Circular applies to organizations and individuals related to the reporting and statistical information on drug rehabilitation work and post-rehabilitation management, including:

Article 2. Applicability

1. People's Committees of communes, wards, and towns (referred to as Commune-level People's Committees);

2. Centers for Treatment-Education-Social Work operating in accordance with Decree No. 135/2004/ND-CP dated June 10, 2004 of the Government stipulating the application of measures for admission to treatment facilities, the operation of such facilities under the Administrative Violation Handling Ordinance, and the application to minors and voluntary patients; private drug rehabilitation centers operating in accordance with Decree No. 147/2003/ND-CP dated December 2, 2003 of the Government stipulating conditions, procedures for licensing, and management of voluntary drug rehabilitation centers (collectively referred to as drug rehabilitation centers);

3. Post-rehabilitation management facilities operating in accordance with Decree No. 94/2009/ND-CP dated October 26, 2009 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics regarding post-drug rehabilitation management;

4. Departments of Labor, Invalids, and Social Affairs of districts, cities, and provincial municipalities (referred to as District-level Departments of Labor, Invalids, and Social Affairs);

5. Departments of Labor, Invalids, and Social Affairs of provinces and centrally-administered cities (referred to as Provincial-level Departments of Labor, Invalids, and Social Affairs);

5. The Department of Labor, Invalids and Social Affairs of the provinces and centrally governed cities (referred to as the Provincial Department of Labor, Invalids and Social Affairs);

6. Other Relevant Organizations and Individuals.

Article 3. Basic statistical reports on drug rehabilitation work and post-rehabilitation management

1. Drug rehabilitation and post-rehabilitation management report at the commune level.

Code: Form 01-BCN.

a) Basic indicators groups:

- Voluntary rehabilitation at home;

- Voluntary rehabilitation in the community;

- Compulsory rehabilitation in the community;

- Post-rehabilitation management at place of residence;

- Social problem resolution support;

- Relapse;

- Staff;

- Operating expenses.

b) Reporting unit: Commune People's Committee.

c) Receiving unit:Department of Labor, Invalids and Social Affairs at the district level.

d) Reporting period: Monthly report. Data is compiled from the 1st to the last day of the reporting month.

đ) Reporting deadline: Before the 3rd day of the following month.

e) Data sources:

- Data on the group of voluntary rehabilitation at home indicators is compiled from the Drug Rehabilitation Management Book for Individuals Voluntarily Rehabilitating at Home (code: Book 01-SCN);

- Data on the group of voluntary rehabilitation in the community indicators is compiled from the Drug Rehabilitation Management Book for Individuals Voluntarily Rehabilitating in the Community (code: Book 02-SCN);

- Data on the group of compulsory rehabilitation in the community indicators is compiled from the Drug Rehabilitation Management Book for Individuals Compulsorily Rehabilitating in the Community (code: Book 03-SCN);

- Data on the group of post-rehabilitation management at place of residence indicators is compiled from the Drug Rehabilitation Management Book for Individuals Post-Rehabilitating at Place of Residence (code: Book 04-SCN);

- Data on the group of social problem resolution support indicators is compiled from Books 01-SCN, 02-SCN, 03-SCN, 04-SCN;

- Data on the group of relapse indicators is compiled from the Drug Rehabilitation Completion Management Book (code: Book 05-SCN);

- Data on the group of staff indicators is only implemented with the December monthly report, representing the final period report and is compiled from the local staff management book;

- Data on the group of operating expense indicators is annual data, only implemented with the December monthly report and is compiled from the local financial management book;

2. Drug rehabilitation and post-rehabilitation management report at rehabilitation facilities and post-rehabilitation management facilities.

Code: Form 02-BCN.

a) Basic indicators groups:

- Voluntary rehabilitation at facility;

- Compulsory rehabilitation at facility;

- Post-rehabilitation management at facility;

- Social problem resolution support at facility;

- Staff;

- Operating expenses.

b) Reporting unit: Rehabilitation facility, post-rehabilitation management facility.

c) Receiving unit: Department of Labor, Invalids and Social Affairs.

d) Reporting period: Monthly report. Data is compiled from the 1st to the last day of the reporting month.

đ) Reporting deadline: Before the 3rd day of the following month.

e) Data sources:

- Data on the group of voluntary rehabilitation at facility indicators is compiled from the Drug Rehabilitation Management Book for Individuals Voluntarily Rehabilitating at Rehabilitation Facility (code: Book 06-SCN);

- Data on the group of compulsory rehabilitation at facility indicators is compiled from the Drug Rehabilitation Management Book for Individuals Compulsorily Rehabilitating at Rehabilitation Facility (code: Book 07-SCN);

- Data on the group of post-rehabilitation management at facility indicators is compiled from the Drug Rehabilitation Management Book for Individuals Post-Rehabilitating at Post-Rehabilitation Management Facility (code: Book 08-SCN);

- Data on the group of social problem resolution support at facility indicators is compiled from Books 06-SCN, 07-SCN, 08-SCN;

- Data on the group of staff indicators is only implemented with the December monthly report, representing the final period report and is compiled from the facility staff management book;

- Data on the group of operating expense indicators is annual data, only implemented with the December monthly report and is compiled from the facility financial management book.

Article 4. Comprehensive statistical reports on drug rehabilitation work and post-rehabilitation management.

1. Drug rehabilitation and post-rehabilitation management report at the district level.

Code: Form 03-BCN.

a) Basic indicators groups:

- Voluntary rehabilitation at home;

- Voluntary rehabilitation in the community;

- Compulsory rehabilitation in the community;

- Post-rehabilitation management at place of residence;

- Social problem resolution support;

- Relapse situation;

- Staff;

- Operating expenses;

- Communes/towns/villages without drug users.

b) Reporting unit: Department of Labor, Invalids and Social Affairs at the district level.

c) Receiving unit: Department of Labor, Invalids and Social Affairs.

d) Reporting period: Report every six months (data compiled from January 1 to June 30); annual report (data compiled from January 1 to December 31).

đ) Reporting deadline:

+ Before July 7 for the six-month report;

+ Before January 7 of the following year for the annual report.

e) Data sources:

- Data on voluntary family-based rehabilitation, voluntary community-based rehabilitation, compulsory community-based rehabilitation, post-rehabilitation management at place of residence, and support for resolving social issues compiled from periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the commune level;

- Data on staff indicators compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the commune level and the staff management ledger of the Department of Labor, Invalids and Social Affairs at the district level.

- Data on operating expense indicators compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the commune level and the financial management ledger of the Department of Labor, Invalids and Social Affairs.

- Data on indicators for communes/towns without drug users compiled from management area reports at the commune level and coordinated with the police station at the same level.

2. Drug rehabilitation and post-rehabilitation management report at the provincial level.

Code: Form 04-BCN.

a) Basic indicators groups:

- Community-based drug rehabilitation, post-rehabilitation management, and support for resolving social issues;

- Drug rehabilitation, post-rehabilitation management, and support for resolving social issues at rehabilitation facilities and post-rehabilitation management facilities;

- Staff;

- Operating expenses.

b) Reporting unit: Department of Labor, Invalids and Social Affairs.

c) Receiving unit: Ministry of Labor, Invalids and Social Affairs (Prevention and Control of Social Evils Department).

d) Reporting period: Report every six months (data compiled from January 1 to June 30); annual report (data compiled from January 1 to December 31).

đ) Reporting deadline:

+ Before July 15 for the six-month report;

+ Before January 15 of the following year for the annual report.

e) Data sources:

- Data on indicators for community-based drug rehabilitation, post-rehabilitation management, and support for resolving social issues compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the district level;

- Data on indicators for drug rehabilitation, post-rehabilitation management, and support for resolving social issues at rehabilitation facilities and post-rehabilitation management facilities compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at rehabilitation facilities and post-rehabilitation management facilities;

- Data on staff indicators compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the district level, periodic statistical reports on drug rehabilitation work and post-rehabilitation management at rehabilitation facilities and post-rehabilitation management facilities, and the staff management ledger of the Provincial Department of Labor, Invalids and Social Affairs;

- Data on operating expense indicators compiled from corresponding indicators in periodic statistical reports on drug rehabilitation work and post-rehabilitation management at the district level and the financial management ledger of the Provincial Department of Labor, Invalids and Social Affairs.

Article 5. Registers for initial recording on drug rehabilitation work and post-rehabilitation management

1. Register for managing voluntary drug rehabilitation at home.

Code: Register 01-SCN

a) Entity establishing the register: Commune People's Committee.

b) Subjects recorded in the register: persons implementing the decision on voluntary rehabilitation management at home made by the Chairman of the People's Committee of the commune in accordance with Decree No. 94/2010/NĐ-CP dated September 9, 2010 of the Government on organizing drug rehabilitation at home and in the community.

d) Time to open the register: annually.

đ) Date to open the register: January 1 each year.

e) Date to close the register: December 31 each year.

2. Register for managing voluntary drug rehabilitation in the community.

Code: Register 02-SCN

a) Entity establishing the register: Commune People's Committee.

b) Subjects recorded in the register: persons implementing the decision on voluntary rehabilitation in the community made by the Chairman of the People's Committee of the commune in accordance with Decree No. 94/2010/NĐ-CP dated September 9, 2010 of the Government on organizing drug rehabilitation at home and in the community.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

3. Register for managing compulsory drug rehabilitation in the community.

Code: Register 03-SCN

a) Entity establishing the register: Commune People's Committee.

b) Subjects recorded in the register: persons implementing the decision on applying compulsory rehabilitation measures in the community made by the Chairman of the People's Committee of the commune in accordance with Decree No. 94/2010/NĐ-CP dated September 9, 2010 of the Government on organizing drug rehabilitation at home and in the community.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

4. Register for managing persons after drug rehabilitation at their place of residence.

Code: Register 04-SCN

a) Entity establishing the register: Commune People's Committee.

b) Subjects recorded in the register: persons implementing the decision on applying post-rehabilitation management measures at their place of residence made by the Chairman of the District People's Committee (referred to as the District People's Committee) in accordance with Decree No. 94/2009/NĐ-CP dated October 26, 2009 of the Government detailing the implementation of the Law amending and supplementing certain articles of the Drug Prevention and Control Law regarding post-rehabilitation management.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

5. Register for managing persons who have completed drug rehabilitation.

Code: Register 05-SCN

a) Entity establishing the register: Commune People's Committee.

b) Subjects recorded in the register:

- Persons issued a Certificate of Completion of Drug Rehabilitation Period at home or in the community by the Chairman of the Commune People's Committee in accordance with Decree No. 94/2010/NĐ-CP dated September 9, 2010 of the Government on organizing drug rehabilitation at home and in the community;

- Persons issued a certificate of completion of voluntary rehabilitation at a rehabilitation facility; persons issued a certificate of completion of compulsory rehabilitation at a rehabilitation facility by the director of the facility in accordance with Decree No. 135/2004/NĐ-CP dated June 10, 2004 of the Government on the regime of applying measures to be admitted to a treatment facility, organization of activities of a treatment facility under the Administrative Violation Handling Ordinance and the regime applied to minors and voluntary patients.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

6. Register for managing voluntary drug rehabilitation at a rehabilitation facility.

Code: Register 06-SCN

a) Entity establishing the register: Drug rehabilitation facility.

b) Subjects recorded in the register: Persons with a decision to voluntarily enter a drug rehabilitation facility by the director of the facility in accordance with Decree No. 135/2004/NĐ-CP dated June 10, 2004 of the Government on the regime of applying measures to be admitted to a treatment facility, organization of activities of a treatment facility under the Administrative Violation Handling Ordinance and the regime applied to minors and voluntary patients.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

7. Register for managing compulsory drug rehabilitation at a rehabilitation facility.

Code: Register 06-SCN

a) Entity establishing the register: Drug rehabilitation facility.

b) Subjects recorded in the register: Persons implementing the decision on applying compulsory rehabilitation measures at a rehabilitation facility according to the decision of the Chairman of the District People's Committee in accordance with Decree No. 135/2004/NĐ-CP dated June 10, 2004 of the Government on the regime of applying measures to be admitted to a treatment facility, organization of activities of a treatment facility under the Administrative Violation Handling Ordinance and the regime applied to minors and voluntary patients.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

8. Register for managing persons after drug rehabilitation at a post-rehabilitation management facility.

Code: Register 07-SCN

a) Entity establishing the register: facility for post-rehabilitation management.

b) Subjects recorded in the register: persons implementing the decision on applying post-rehabilitation management measures at a post-rehabilitation management center by the Chairman of the District People's Committee in accordance with Decree No. 94/2009/NĐ-CP dated October 26, 2009 of the Government detailing the implementation of the Law amending and supplementing certain articles of the Drug Prevention and Control Law regarding post-rehabilitation management.

c) Time to open the register: annually.

d) Date to open the register: January 1 each year.

đ) Date to close the register: December 31 each year.

Article 6. Effectiveness

1. This Circular takes effect from June 1, 2011.

2. Abolish the provisions on periodic reporting and statistical records and initial recording on rehabilitation recovery work issued together with Decision No. 1160/2004/QĐ-BLĐTBXH dated August 11, 2004 of the Minister of Labor, Invalids and Social Affairs.

Article 7. Implementation Organization

1. The People's Committees of communes, wards, and towns are responsible for opening initial recording registers on drug rehabilitation and post-rehabilitation management at home, in the community, and at places of residence in accordance with Clauses 1 to 5 of Article 5 and implementing the basic statistics report prescribed in Clause 1 of Article 3 of this Circular.

2. Drug rehabilitation facilities are responsible for opening initial recording registers in accordance with Clauses 6 and 7 of Article 5 and implementing the basic statistics report prescribed in Clause 2 of Article 3 of this Circular.

3. Post-rehabilitation management facilities are responsible for opening initial recording registers in accordance with Clause 8 of Article 5 and implementing the basic statistics report prescribed in Clause 2 of Article 3 of this Circular.

4. Departments of Labor, Invalids, and Social Affairs of districts, cities, and provincial towns are responsible for implementing the consolidated statistics report prescribed in Clause 1 of Article 4 of this Circular.

5. Departments of Labor, Invalids, and Social Affairs of provinces and centrally-administered cities are responsible for implementing the consolidated statistics report prescribed in Clause 2 of Article 4 of this Circular and guiding, urging, and inspecting the implementation of the reporting and statistical system on drug rehabilitation and post-rehabilitation management at the commune level, district level, and at drug rehabilitation facilities and post-rehabilitation management facilities within their locality; printing and distributing initial recording registers and statistical forms issued together with this Circular to the People's Committees of communes, Departments of Labor, Invalids, and Social Affairs of districts, and drug rehabilitation facilities and post-rehabilitation management facilities within their locality.

6. The Head of the Ministry's Office, the Director of the National Anti-Social Evils Department, the Directors of the Provincial Departments of Labor, Invalids, and Social Affairs under centrally governed cities; the Heads of the District Labor, Invalids, and Social Affairs Departments, the Directors of detoxification facilities and post-detoxification management facilities, the Chairpersons of the People's Committees of communes, wards, and towns, and other related organizations and individuals are responsible for implementing this Circular. In the course of implementation, if there are difficulties or obstacles, they are requested to promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs for study, guidance, and supplementation.
