PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

5. Individuals engaged in planning work in Bureaus, Departments, and Committees (Planning-Investment; Planning-Finance), (Finance-Planning) under central ministries, agencies, mass organizations, state-owned corporations, and economic groups established by the Prime Minister of the Government;

6. Foreign nationals and overseas Vietnamese with outstanding achievements in the cause of building and developing the Planning and Investment Sector;7. Other special cases decided upon by the Minister of Planning and Investment.Article 3. Principles for awarding the "Commendation Medal"

Article 2. Applicability

1. The "Commendation Medal" shall be awarded only once to each individual.

2. The awarding of the "Commendation Medal" must comply with regulations, the correct recipients, criteria, and procedures stipulated in this Circular, ensuring transparency, fairness, democracy, and timeliness.Chair, Vice Chair of the provincial People's Committee; Secretary, Deputy Secretary of the Provincial Party Committee; Chair, Vice Chair of the Provincial People's Council) and Leaders of State-owned Corporations and Groups (General Director, Deputy General Director) established by the Prime Minister;

2. Individuals working at units under the Ministry of Planning and Investment (including those who have retired or passed away);

3. Individuals working at Provincial Departments of Planning and Investment, Industrial Park Management Boards, Export Processing Zones, and Economic Zones of provinces and centrally governed cities;

4. Individuals engaged in planning and investment work at District and County Financial-Planning Departments subordinate to provinces and centrally governed cities;

5. Individuals engaged in planning work at Bureaus, Departments, and Committees (Planning-Investment; Planning-Finance), (Finance-Planning) under central Ministries, agencies, mass organizations, State-owned Corporations, and Groups established by the Prime Minister;

6. Foreign individuals and overseas Vietnamese with significant contributions to the construction and development of the Planning and Investment sector;

7. Special cases to be considered and decided by the Minister of Planning and Investment.

Article 3. Principles for awarding the "Memorial Plaque"

1. The "Memorial Plaque" shall be awarded once to each individual.

2. The awarding of the "Memorial Plaque" must be carried out in accordance with regulations; the correct recipients, criteria, and procedures set forth in this Circular must be ensured, guaranteeing transparency, fairness, democracy, and timeliness.

Article 4. Rights and responsibilities of individuals awarded the "Memorial Badge"

1. Individuals specified in Clause 2 of Article 2 who are awarded the "Memorial Badge" shall receive the Decision awarding the "Memorial Badge", monetary awards, and tangible items as prescribed.

2. Individuals specified in Clauses 1, 3, 4, 5, 6, and 7 of Article 2 who are awarded the "Memorial Badge" shall receive the Decision awarding the "Memorial Badge" and tangible items as prescribed.

3. Individuals awarded the "Memorial Badge" shall be responsible for preserving and promoting the traditions of the Planning and Investment sector, serving as role models in implementing policies, regulations, and laws of the Party and State.

Chapter II

CRITERIA AND CONDITIONS FOR AWARDING THE "MEMORIAL BADGE"

Article 5. Criteria for awarding the Memorial Badge

1. Individuals falling under the categories specified in Clauses 2, 3, 4, and 5 of Article 2 must consistently fulfill their duties and have good qualities:

a) Heads of units under the Ministry, Directors of Provincial Planning and Investment Departments, Chiefs of Management Boards of Industrial Zones, Export Processing Zones, and Economic Zones must have worked in planning and investment for ten years or more.

b) Individuals (excluding those mentioned in Clause a of this Article) must have worked in the Planning and Investment sector for fifteen years or more for males and twelve years or more for females.

2. Individuals transferred to work in the Planning and Investment sector must have continuously worked for twenty years, including at least ten years in the Planning and Investment sector.

 * Calculation of working time: Working time is calculated from the date the decision on acceptance or the indefinite-term contract becomes effective (including time spent studying and performing special tasks); cumulative time working in planning activities is included.

For the General Statistics Office, working time is calculated from the date of Decision No. 01/NĐ-CP dated January 4, 2007 issued by the Prime Minister regarding the incorporation of the General Statistics Office into the Ministry of Planning and Investment.

3. Exclusion from consideration for awarding "Memorial Badge" in the following cases:

a) Leaders of the Ministry of Planning and Investment (current position, retired, or transferred).

b) Individuals working in the Planning and Investment sector who have been conferred the title of "Heroic Laborer"; "Independence Medal"; "National Model Worker".

c) Individuals specified in Clause 1, Clause 5, and Clause 6 of Article 2 who meet one of the following criteria:

- Contributing significantly to leadership and guidance, contributing to the development of the Planning and Investment sector; 

- Achieving scientific research works that win Ho Chi Minh Prize or State Prize with practical value for the development of the Planning and Investment sector; - Making positive contributions to building and consolidating friendly relations and cooperation between countries and international organizations and the Planning and Investment sector, actively contributing to the development of the Planning and Investment sector.

- Providing substantial financial and material support for the development of the Planning and Investment sector.

Article 6. Conditions for awarding the "Memorial Badge"

1. Individuals must meet the criteria and conditions stipulated in Article 5 of this Circular.

2. In cases where individuals meet the criteria stipulated in Article 5 but have been disciplined from reprimand to below dismissal, they may be considered for the award two years (counted from the date the disciplinary removal decision takes effect) after the disciplinary period has ended. The disciplinary period will not be counted towards the awarding of the "Memorial Badge"

3. Individuals involved in civil or criminal cases (...) without a conclusion from competent state agencies shall not be considered for the award.

Chapter III

PROCEDURES, REQUIREMENTS FOR CONSIDERING AWARDS, GRANTING AWARDS, AND HANDLING VIOLATIONS

Article 7. Procedure for Proposing to Award the "Memorial Plaque"

1. For units proposing commendation

a) Units under the Ministry shall be responsible for comparing with the prescribed criteria, compiling a list and dossier of cadres of their unit to submit to the Ministry's Commendation and Reward Council (through the Department of Commendation and Reward). (through the Department of Mobilization and Reward)

b) Departments of Planning and Investment, Management Boards of Industrial Zones, Export Processing Zones, and Economic Zones of provinces and centrally-administered cities shall compare with the prescribed criteria, compile a list and dossier of cadres of their unit (including provincial and city leaders and individuals working at district and county-level Finance and Planning Rooms) to submit to the Ministry of Planning and Investment (through the Department of Commendation and Reward).

c) Central Ministries, sectors, mass organizations; State-owned Corporations and Economic Groups established by Decision of the Prime Minister shall compare with the provisions of this Circular, compile a list and dossier to submit to the Ministry of Planning and Investment (through the Department of Commendation and Reward).(through the Department of Mobilization and Reward).

d) Units under the Ministry that have work relations with individuals specified in Clauses 1, 5, and 6 of Article 2 of this Circular shall compare with the prescribed criteria, compile a list and dossier to submit to the Ministry's Commendation and Reward Council (through the Department of Commendation and Reward).of the Ministry (through the Department of Mobilization and RewardArticle 2. Social work tasks of hospitals).

2. For the Department of Commendation and Reward:

a) The Department of Commendation and Reward is the Standing Office of the Ministry of Planning and Investment's Commendation and Reward Council, responsible for examining and consolidating the commendation lists of agencies and units specified in Clause 1 of this Article in accordance with regulations, and submitting them to the Minister (Chairman of the Ministry's Commendation and Reward Council) for consideration and decision.of the Mobilization and Reward Council of the Ministry)shall examine and decide.

b) In special cases, the Department of Commendation and Reward is responsible for proposing individuals who meet the criteria for receiving the "Memorial Plaque" according to regulations, and submitting them to the Minister of Planning and Investment for consideration and decision.

Article 8. Files for considering the awarding of the Commendation Medal

1. Petition for awarding the "Memorial Plaque" (Model No. 1).(Model No. 1)Model No. 2)

2. Extract from the Minutes of the Commendation and Reward Council Meeting (Model No. 2).(m(Model No. 3)

3. List of individuals proposed for awarding the "Memorial Plaque" (Model No. 3).(for individuals who have retired or passed away confirmed by the unit managing cadres or the unit issuing the retirement decision), (Model No. 4)

4. Summary of the individual's work history (for retired individuals or those deceased confirmed by the unit managing cadres or the unit issuing the retirement decision), (Model No. 4).(through the Department of Mobilization and Rewardired or passed away confirmed by the unit managing cadres or the unit issuing the retirement decision),

5. Copies of commendation decisions for individuals specified in Clause 5 of Article 5 of this Circular and decisions to remove disciplinary actions.(if applicable).

Article 9. Time for Submitting Dossiers for Awarding the "Memorial Plaque"

1. Agencies and units specified in Article 7, Clause 1, Points a and b: Based on the provisions of this Circular, they shall compile a list and dossier of individuals within their agency or unit who meet the conditions for awarding the "Memorial Plaque" and submit it to the Ministry of Planning and Investment's Commendation and Reward Council (through the Department of Commendation and Reward) before October 1st each year.i đua - Khen thưởng)before October 1st each year.trước ngày 01 tháng 10 hàng năm.

2. Individuals specified in Article 7, Clause 1, Points c and d: The time for submitting dossiers must be 10 working days prior to the planned date for presenting the "Memorial Plaque".

Article 10. Organization of Presentation of the "Memorial Plaque"

1. Heads of agencies and units under the Planning and Investment sector shall organize the presentation of the "Memorial Plaque" during the traditional anniversary of the Planning and Investment sector on December 31st each year.

2. Based on the specific circumstances of each agency and unit, organize the presentation of the "Memorial Plaque" for individuals awarded the "Memorial Plaque" in accordance with the solemn, dignified, and frugal regulations currently in force.

Article 11. Handling violations, addressing complaints and reports

1. Organizations and individuals related to the proposal for awarding the "Memorial Plaque" shall be responsible under the law for the accuracy of the application dossier.

2. Organizations and individuals have the right to lodge complaints and reports regarding the awarding of the "Memorial Plaque" in accordance with the Law on Complaints, the Law on Reports, and the Law on Encouragement and Commendation. The authority to resolve complaints and reports shall be implemented in accordance with current laws.

Chapter IV

IMPLEMENTING PROVISIONS

Article 12. Abolition of existing regulations

The provisions of this Circular replace the provisions of Circular No. 07/2009/TT-BKH dated October 14, 2009 of the Ministry of Planning and Investment guiding the awarding of the Memorial Plaque "For the Cause of the Planning and Investment Sector of Vietnam".

Article 13. Effective Date

This Circular takes effect from December 5, 2012.

Article 14. Implementation Organization

The Ministry of Planning and Investment's Award and Commendation Council, heads of units under the Ministry, Directors of Provincial Departments of Planning and Investment, Heads of Industrial Park Management Boards, Export Processing Zone Management Boards, and Economic Zone Management Boards of provinces and centrally-administered cities, and relevant agencies and units shall be responsible for implementing this Circular. During implementation, if there are difficulties, agencies and units shall reflect them to the Ministry of Planning and Investment for study and appropriate amendments.
