JOINT CIRCULAR

Guidelines for implementing regulations and policies for officers, non-commissioned officers, soldiers, and civil servants of public security who participated in the war to protect the country and international missions in Cambodia and assistance to Laos after April 30, 1975

Implementing Clause 2, Article 9 of Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister on regulations and policies for individuals participating in the war to protect the country and international missions in Cambodia and assistance to Laos after April 30, 1975, who have been demobilized, discharged, or retired (hereinafter referred to as Decision No. 62/2011/QĐ-TTg);

The Ministers of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance hereby provide guidelines for implementation as follows:

This Circular provides guidelines for implementing monthly allowances, one-time allowances, health insurance, and funeral expenses for officers, non-commissioned officers, soldiers, and civil servants of public security who directly participated in the war to protect the country at the southwestern border and northern border, and international missions in Cambodia and assistance to Laos (hereinafter collectively referred to as direct participation in the war to protect the country and international missions) after April 30, 1975 within the areas and time periods specified in Article 3 of Decision No. 62/2011/QĐ-TTg, who have been demobilized, discharged, or retired.

a) Officers, non-commissioned officers, and soldiers of the People's Public Security recruited into the Public Security force after April 30, 1975, who directly participated in the war to protect the country and international missions, with less than 20 years of service in the Public Security force, currently not eligible for retirement benefits, disability benefits, or monthly veteran benefits, and fall under one of the following categories:

who have been demobilized, discharged from service, or retired

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

- Demobilized, discharged, or retired before April 1, 2000.

- War invalids who were demobilized, discharged, or retired before April 1, 2000; severely wounded war invalids currently undergoing rehabilitation at war invalids rehabilitation centers managed by the Department of Labor - Invalids and Social Affairs or those who have returned home.

Article 1. Scope of Regulation and Applicability

- Transferred to another profession or transferred to become civil servants of public security and then retired before April 1, 2000 but unable to implement or have returned to their locality without having their benefits resolved.

- Discharged from military service to work in international cooperative labor or sent to work in international cooperative labor and then discharged before April 1, 2000.

b) Civil servants of public security who directly participated in the war to protect the country and international missions, retired before January 1, 1995, currently not eligible for retirement benefits or monthly disability benefits.

Implemented according to the provisions of Clause 2, Article 2 of Decision No. 62/2011/QĐ-TTg.

Article 2. Method of calculating the period of benefit entitlement

1. The period of benefit entitlement for the subjects specified in point a, Clause 2, Article 1 of this Circular is the actual working period in the People's Public Security force (including working periods in the military and cryptology services) plus the period of direct participation in the war to protect the country and international missions belonging to the groups of subjects specified in points b, c, d, đ, Clause 1, Article 2 of Decision No. 62/2011/QĐ-TTg (if applicable). If there is a break in the period of benefit entitlement, it will be accumulated.

For cases where the subject transfers to another profession and then retires, or has been demobilized, discharged, or retired to their locality for a period of time before continuing to work at agencies, organizations outside the People's Public Security force or engaged in international cooperative labor, and then again discharged, retired, or severely wounded war invalids currently undergoing rehabilitation at war invalids rehabilitation centers managed by the Department of Labor - Invalids and Social Affairs, the working period outside the People's Public Security force (not directly participating in the war to protect the country and international missions), the period of international cooperative labor, and the period of rehabilitation at war invalids rehabilitation centers managed by the Department of Labor - Invalids and Social Affairs will not be counted towards the period of benefit entitlement.

3. Subjects not applicable

2. The period of benefit entitlement for the subjects specified in point b, Clause 2, Article 1 of this Circular is the period of direct participation in the war to protect the country and international missions. In cases where the subject has a period of direct participation in the war to protect the country and international missions belonging to the groups of subjects specified in points b, c, d, đ, Clause 1, Article 2 of Decision No. 62/2011/QĐ-TTg or there is a break, the period will be accumulated.

3. The period of entitlement to a one-time allowance if there is a fractional month from six months to less than twelve months will be calculated as a full year, and less than six months will be calculated as half (1/2) year. The period of entitlement to a monthly allowance will be rounded to a full year (twelve months).

1. The period for enjoying the benefit regime for the subjects specified in point a, Clause 2, Article 1 of this Circular is the actual working time in the People's Public Security force (including working time in the military and cryptologic services) plus the time directly participating in wars to defend the country and international missions as stipulated in points b, c, d, đ, Clause 1, Article 2 of Decision No. 62/2011/QĐ-TTg (if applicable). If there is a break in the period, it will be accumulated.

For cases where individuals change careers afterwards and then terminate their employment, or have been demobilized, discharged from military service, terminated employment and returned to their localities for a period before continuing work at agencies, units, organizations outside the People's Public Security force, or engaged in international cooperative labor, and then again discharged from military service, terminated employment, or severely wounded veterans undergoing rehabilitation at veteran rehabilitation centers under the Ministry of Labor, Invalids and Social Affairs management, the working time outside the People's Public Security force (not directly participating in wars to defend the country and international missions), the time spent on international cooperative labor, and the time spent in rehabilitation at veteran rehabilitation centers under the Ministry of Labor, Invalids and Social Affairs management shall not be counted towards the period for enjoying the benefit regime.

2. The period for enjoying the benefit regime for the subjects specified in point b, Clause 2, Article 1 of this Circular is the time directly participating in wars to defend the country and international missions. In cases where the subject has time directly participating in wars to defend the country and international missions belonging to the groups of subjects specified in points b, c, d, đ, Clause 1, Article 2 of Decision No. 62/2011/QĐ-TTg or if there is a break, such time will be accumulated.

3. The period for enjoying a one-time allowance if there is a fractional month from six months to less than twelve months shall be calculated as a full year, and less than six months shall be calculated as half (1/2) year. The period for enjoying a monthly allowance shall be rounded to a full year (twelve months).

Article 3. Subsidy System

1. Monthly Subsidy System

a) Officers, non-commissioned officers, and soldiers of the People's Public Security who fall under the category specified in point a, Clause 2, Article 1 of this Circular, having worked for at least 15 but less than 20 years (including those who were discharged or left their jobs after December 15, 1993, and are currently working in communes participating in mandatory social insurance but do not meet the conditions to enjoy retirement benefits according to regulations when leaving work in the commune, or those whose time working in the Public Security force cannot be combined with time working in the commune to meet the conditions for retirement benefits) shall receive monthly subsidies calculated based on the number of years counted towards the benefit; the specific levels of enjoyment are as follows:

- From 15 to less than 16 years, the subsidy amount is 925,000 VND/month.

- From 16 to less than 17 years, the subsidy amount is 971,250 VND/month.

- From 17 to less than 18 years, the subsidy amount is 1,017,500 VND/month.

- From 18 to less than 19 years, the subsidy amount is 1,063,750 VND/month.

- From 19 to less than 20 years, the subsidy amount is 1,110,000 VND/month.

Example 1: Mr. Nguyen Van A joined the People's Public Security in May 1975, participated in combat operations in the Southwest border area in 1978, was discharged and left his job in September 1992.

The method of enjoying benefits for Mr. Nguyen Van A is as follows:

Mr. Nguyen Van A's actual working period in the People's Public Security from May 1975 to September 1992 is 17 years and 5 months. Mr. Nguyen Van A's monthly subsidy level is 1,017,500 VND/month.

Example 2: Mr. Tran Van B joined the People's Public Security in October 1975, was assigned to work in the Lao People's Democratic Republic in January 1979, transferred to work at the People's Court of District P in October 1991, and retired in 1993.

The method of enjoying benefits for Mr. Tran Van B is as follows:

Mr. B's actual working period in the Public Security from October 1975 to October 1991 is 16 years and 1 month (the time transferred to work at the People's Court of District P is not counted towards the benefit). Mr. B's monthly subsidy level is 971,250 VND/month.

Example 3: Mr. Do Van C joined the People's Public Security in May 1975 and participated in combat operations in the Southwest border area; due to family circumstances, he was discharged in January 1978; he then worked in a northern border commune from January 1979 to January 1981, directly participating in combat operations from February 1979 to January 1981, was re-recruited into the Public Security in February 1982, and retired in January 1993.

The method of enjoying benefits for Mr. Do Van C is as follows:

Mr. Do Van C's actual working period in the People's Public Security is 13 years and 9 months (including: first period from May 1975 to January 1978 is 2 years and 9 months; second period from February 1982 to January 1993 is 11 years), and the time serving as a commune cadre directly participating in combat operations in the northern border area from February 1979 to January 1981 is 2 years. The total working period counted towards the benefit is 15 years and 9 months. Mr. C's monthly subsidy level is 925,000 VND/month.

Example 4: Mr. Le Van D joined the Public Security in May 1975; performed anti-Fulro duties in the Central Highlands in August 1976, was discharged and returned to the locality in June 1992.

The method of enjoying benefits for Mr. Le Van D is as follows:

Mr. D's actual working period in the Public Security from May 1975 to June 1992 is 17 years and 1 month. Mr. D's monthly subsidy level is 1,017,500 VND/month.

b) When the Government adjusts pension, social insurance benefits, and monthly subsidies, the aforementioned subsidy levels will also be adjusted accordingly; the adjustment implementation date will follow the Government's regulations starting from January 1, 2012.

c) Person Receiving Monthly Subsidies dies from January 1, 2012 onwards, they will cease to receive from the following month; the person handling funeral arrangements will receive a one-time subsidy equal to three months' worth of the deceased's current monthly subsidy.

Example 5: Mr. Tran Dinh K received monthly subsidies from January 2012 at a rate of 925,000 VND/month; in March 2012, Mr. Tran Dinh K passed away, his family received subsidies until the end of March 2012, and the person handling his funeral arrangements received a one-time subsidy of:

3 months x 925,000 VND/month = 2,775,000 VND.

2. One-Time Subsidy System

a) Officers, non-commissioned officers, and soldiers of the People's Public Security who fall under the category specified in point a, Clause 2, Article 1 of this Circular, having worked less than 15 years (including those who were discharged or left their jobs and are currently working in communes participating in mandatory social insurance or have worked less than 20 years in the People's Public Security before working in communes and have now retired, but the time worked in the Public Security cannot be combined with time worked in the commune to calculate social insurance benefits) shall receive a one-time subsidy calculated based on the number of years counted towards the benefit; the specific levels of enjoyment are as follows:

- From 2 years and below, the one-time subsidy amount is 2,500,000 VND.

- From the third year onwards, each additional year of work adds 800,000 VND.

b) Civil servants of the Public Security who fall under the category specified in point a Clause 2, Article 1 of this Circular shall receive a one-time subsidy calculated based on the number of years directly participating in wars to protect the country and international missions, specifically as follows:

- From 2 years and below, the subsidy amount is 2,500,000 VND.

- From the third year onwards, each additional year of work adds 800,000 VND.

c) The one-time subsidy levels specified in points a and b of this clause shall be calculated using the following formula:

Amount of subsidy enjoyed = 2,500,000 VND + [(number of years counted towards the benefit - 2 years) x 800,000 VND]

Example 6: Mr. Pham Van H joined the People's Public Security in April 1977, participated in combat operations in the northern border area in March 1979, and was discharged and left his job in October 1981. His actual working period in the Public Security is 4 years and 7 months, rounded up to 5 years.

The one-time subsidy amount that Mr. Pham Van H enjoys is:

2,500,000 VND + [(5 years - 2 years) x 800,000 VND] = 4,900,000 VND.

Example 7: Ms. Nguyen Thi Q was recruited as a worker for the Public Security in February 1977, from May 1979 to October 1982, she directly participated in combat service in Loc Binh district, Lang Son province, in November 1982, she transferred to work at the General Department X, Ministry of Public Security, and stopped working in January 1989 to return to her locality.

The calculation of one-time allowance for Ms. Q is as follows:

The time directly participating in the war to protect the country from May 1979 to October 1982 is 3 years 6 months, which is calculated as 4 years. The benefit received is:

2,500,000 VND + [(4 years - 2 years) x 800,000 VND)] = 4,100,000 VND.

d) Subjects entitled to receive one-time allowance according to the guidance at point a, b of this clause but who passed away from January 1, 2012 onwards shall still be entitled to receive one-time allowance according to the guidance at this clause and the person handling funeral arrangements shall be entitled to receive funeral expenses according to the provisions of Article 4 of this Circular.

3. In cases where the subject is defined in Clause 2, Article 1 of this Circular but has passed away before January 1, 2012 (including those who passed away while still working), then one of the following relatives of the subject shall be entitled to receive a one-time allowance of 3,600,000 VND: spouse; legitimate children; father, mother, or legal foster parent.

Article 4. Health insurance and funeral expenses regime

Subjects defined in Clause 2, Article 1 of this Circular who have not yet received health insurance benefits shall be entitled to receive health insurance benefits according to the laws on health insurance; upon passing away, the person handling funeral arrangements shall be entitled to receive funeral expenses according to the current laws on social insurance.

1. Documents serving as the basis for reviewing entitlement to benefits include original documents or documents considered equivalent to original documents or related documents, specifically:

1. Application dossier for monthly allowance

a) Personal declaration form of the subject (Form 01A) (three copies).

b) Minutes of the review and approval by the Policy Council of the commune, ward, town (hereinafter referred to collectively as the commune) where the subject resides (Form 02), original copy (three copies).

c) Official letter of review and recommendation (with attached list) of the Provincial Public Security Department, centrally administered city (Form number 03) where the subject resides.

d) One or several original documents or documents considered as original or related documents (original or certified copy by the personnel organization agency of the Provincial Public Security Department, centrally administered city) proving that the subject is eligible and meets the conditions to receive monthly allowance as follows:

- Decision on demobilization, discharge, transfer, resignation; Decision of the agency sending to international labor cooperation; Decision or related documents regarding the settlement of discharge, transfer, resignation allowances; Decision on issuing disability certificate and disability allowance or extract from disability file; cadre resume (or military resume); Party member resume; resume of overseas labor; social insurance card (if available); death certificate, death notice (in case of death).

- Confirmation of work history issued by the agency or unit before demobilization, resignation, transfer (Form 08, original) signed and stamped by the head of the agency or unit directly managing the subject before demobilization, resignation, transfer, or international labor cooperation dispatch (county level and above). If the agency or unit merges or dissolves, the newly established agency or the direct superior of the dissolved agency confirms.

- Related documents proving work history in the People's Public Security, such as: Recruitment decision, transfer decision, appointment decision, promotion decision, grade promotion, admission list to public security school, cadre list, injury transfer list, hospital transfer list, medals and awards related to participation in wars to protect the country, files on policies for persons with meritorious services, one-time retirement pension, monthly pension, self-declaration, list of revolutionary service history for state rewards with confirmation by the unit, death certificate, death notice (in case of death), or other related documents if available.

2. Application dossier for one-time allowance

a) Declaration form of the subject (Form 01B) or relative of the subject (Form 01C) for deceased subjects (two copies).

b) Minutes of the review and approval by the Policy Council of the commune where the subject resides (Form 02), original copy (two copies).

c) Official letter of review and recommendation (with attached list) of the Provincial Public Security Department, centrally administered city (Form number 03) where the subject resides.

d) One or several original documents or documents considered as original or related documents (as guided at point d of Clause 1 of this Article), if available.

3. Dossier transferred to the Department of Labor - Invalids and Social Affairs of the province, centrally administered city where the subject resides for implementation of monthly allowance payment, health insurance, and funeral expenses.

a) Dossier for monthly allowance

- Introduction letter of the General Department of Policy - General Department of Force Building of the Public Security (Form number 05), original copy.

- Decision on receiving monthly allowance of the Director of the General Department of Policy - General Department of Force Building of the Public Security (Form number 04), original copy.

- Personal declaration form of the subject.

- Minutes of the review and approval by the Policy Council of the commune.

b) Dossier for one-time allowance

Decision on receiving one-time allowance (Form number 06) with attached list of subjects entitled to one-time allowance of the General Department of Policy - General Department of Force Building of the Public Security.

Article 6. Responsibilities and Procedures for Implementation

1. The subject shall submit one copy of the personal declaration form (Form 01A or 01B), and their relatives shall submit one copy of the relative declaration form (Form 01C) along with one or more of the documents specified in point d, Clause 1 and point d, Clause 2, Article 5 of this Circular to the People's Committee of the commune (through the village head) where they are registered as permanent residents.

2. Commune People's Committee

a) Establish a Village Policy Council chaired by the Chairman (or Vice-Chairman) of the People's Committee, with a Labor - War Invalids and Social Affairs officer serving as the permanent member, and other members including representatives from the local Party Committee, the Vietnam Fatherland Front, the School or Deputy Head of the Police Station. The Village Policy Council is responsible for organizing meetings to review applications for benefits for subjects. When conducting reviews, the village head and the secretary of the village party cell where the subject resides shall be invited to attend.

b) Guide the village head in receiving applications from subjects or relatives of subjects who have registered as permanent residents in the locality and subjects who are residents of another locality requesting confirmation of their application to enjoy benefits; check, review, and compile reports to the People's Committee of the commune (through the Village Policy Council).

c) Direct the Village Policy Council to receive applications reported by the village head, compile, and classify applications into two categories: subjects entitled to monthly allowances and subjects entitled to one-time allowances; organize public and thorough review meetings in three stages:

- Stage 1: Review cases with original documents or documents considered as originals.

- Stage 2: Review cases with related documents.

- Stage 3: Review cases without documents.

Within five working days from the receipt of the report from the village head, the People's Committee of the commune must complete the review process, establish and confirm the report, and transfer the file to the Police Department of the district, town, city, or provincial capital (hereinafter referred to collectively as the Police Department of the district).

Cases where the subject is unclear, the time for benefit enjoyment is incorrect, or there are complaints or accusations shall be left for verification and clarification; if conditions are met, report later.

d) In cases where the subject was born in one locality but now resides in another and requests confirmation of their application, after the Village Policy Council has reviewed and found them eligible, the People's Committee of the commune shall confirm and request the local authority where the subject currently resides to consider and propose the enjoyment of benefits according to regulations.

3. County-level Public Security Organs

a) Direct the area-responsible officers to cooperate with the People's Committee of the commune in guiding the establishment of applications and organizing reviews and proposals for benefits for subjects under the Police Force.

b) Receive applications transferred from the People's Committee of the commune; within ten working days from the date of receiving all required documents, complete the verification and investigation process, and prepare lists by category of subjects and transfer them to the Provincial Police Department.

4. Public Security Department of the province or centrally-administered city

a) Receive applications transferred from the Police Department of the district.

b) Within ten working days from the date of receiving all required documents transferred from the Police Department of the district, complete the verification and investigation process, prepare the application for benefit enjoyment, and send it to the Policy Bureau - General Department of Building Police Forces.

c) Receive applications that have been processed and returned by the Policy Bureau - General Department of Building Police Forces to:

- Organize the payment of one-time allowances to the subjects or their relatives.

- Deliver the Decision on Monthly Allowance Enjoyment to the subjects.

- Transfer the application to the Department of Labor - War Invalids and Social Affairs according to the guidance provided in Clause 3, Article 5 of this Circular.

5. The Policy Bureau - General Department of Building Police Forces

a) Receive and review applications transferred from the Provincial Police Departments.

b) Within ten working days from the date of receiving all required documents transferred from the Provincial Police Departments, complete the review process, issue decisions on monthly and one-time allowances, and transfer the Decisions to the Provincial Police Departments where the subjects reside for implementation according to regulations.

c) Compile the budget for one-time allowance payments, report to the Ministry of Public Security to request the Ministry of Finance to allocate funds; coordinate with the Financial Bureau to allocate funds to ensure the operation of police units and localities.

Article 7. Funding Assurance

1. The budget for monthly and one-time allowance payments as stipulated in Article 3 of this Circular shall be guaranteed by the central government budget. The Ministry of Finance shall allocate funds to the Ministry of Labor - War Invalids and Social Affairs to authorize the local Departments of Labor - War Invalids and Social Affairs to make payments for monthly allowances; the Ministry of Finance shall allocate funds for one-time allowance payments based on the proposal of the Ministry of Public Security.

2. The budget for purchasing health insurance and implementing funeral expenses as stipulated in Article 4 of this Circular shall be guaranteed by the local government budget.

3. The budget for ensuring the work of reviewing and paying one-time allowances as stipulated in Clause 2, Article 3 of this Circular shall be four percent of the total budget allocated for subjects by the central government; the monthly allowance payments shall be implemented according to the regulations for preferential allowances for persons with meritorious service.

The content of the budget for ensuring the work of payment includes: Propaganda and dissemination of policies; organization of conferences, seminars, training, and professional development; review and assessment of applications; interim and final summaries; printing of materials, forms, office supplies, procurement, and repair of equipment to serve management, review, and payment tasks. The level of implementation shall be in accordance with current state regulations.

Article 8. Implementation organization

1. Ministry of Public Security

a) Coordinate with relevant ministries and sectors to direct, urge, and inspect the implementation of this Circular; propose and guide adjustments to the monthly allowance levels for subjects when the Government adjusts pensions and monthly allowances according to the guidance provided in point b, Clause 1, Article 3 of this Circular.

b) Direct police units and localities to take responsibility for confirming the work history of subjects within their jurisdiction (Form 07) upon request by the subjects or functional units and bear legal responsibility for such confirmation.

c) Direct the General Department of Public Security Force to be responsible for propaganda, dissemination, and directing the organization to implement this Circular within the People's Public Security. Take the lead in coordinating with competent agencies inside and outside the Public Security sector to monitor, propose solutions to difficulties and issues arising during the implementation of this Circular; compile and prepare budget estimates to ensure compliance with the guidance provided in Article 7 of this Circular.

d) Financial Department

Organize the transfer of funds to local public security units to implement monthly allowance payments and direct the settlement of accounts according to regulations; coordinate with the General Department of Public Security Force and relevant functional units to resolve difficulties arising in the organization and implementation of this Circular.

2. Ministry of Labor, Invalids and Social Affairs

a) Direct the Departments of Labor, Invalids, and Social Affairs to accept applications for monthly allowance benefits that have been reviewed and approved by the Policy Department - General Department of Public Security Force for management, monthly allowance payment to beneficiaries, and one-time allowance payment to relatives of beneficiaries who have passed away according to point c, Clause 1, Article 3 of this Circular.

b) Direct the adjustment of the monthly allowance level for beneficiaries when the Government adjusts pensions and monthly allowances according to point b, Clause 1, Article 3 of this Circular.

c) Implement medical insurance and funeral expenses as stipulated in Article 5 of this Circular.

3. Provincial People's Committees

Direct sectors under its authority to organize and implement medical insurance and funeral expenses as stipulated in Article 6 of Decision No. 62/2011/QĐ-TTg and the guidance provided in Article 5 of this Circular.

4. The Ministry of Finance

Ensure funding for the implementation of monthly allowance benefits, one-time allowance benefits, and payment fees according to the financial request of the Ministry of Public Security and the Ministry of Labor, Invalids, and Social Affairs.

Article 9. Effective Date

1. This Circular takes effect from June 20, 2012.

2. The benefits and policies prescribed in this Circular shall be implemented from January 1, 2012.

3. From January 1, 2012, police officers and soldiers of the People's Public Security who participated in the anti-US war to save the country and were discharged, retired, or resigned and fall under the category of beneficiaries entitled to one-time allowance according to Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister, but have not yet received a decision on one-time allowance from the competent authority, shall be subject to the application of the one-time allowance level as guided in point a, Clause 2 and Clause 3, Article 3 of this Circular. In cases where the beneficiary has directly participated in wars to protect the country and international missions in multiple agencies and units, the Ministries and sectors shall base their responsibility for resolving benefits for the beneficiary on the final working agency or unit of the beneficiary according to Article 9 of Decision No. 62/2011/QĐ-TTg.

4. 5. Those who falsify or forge documents to obtain benefits will be subject to disciplinary action or criminal liability and must return the amount received; compensate for losses (if any) according to the provisions of the law. If there are difficulties during the implementation process, agencies, units, and localities should report to the inter-Ministry (through the Ministry of Public Security) for coordination in resolution.
