Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 141/NĐ-CP dated October 24, 2013 of the Government detailing and guiding the implementation of certain provisions of the Higher Education Law;

Pursuant to Decision No. 174/2008/QĐ-TTg dated December 31, 2008 of the Prime Minister stipulating standards, procedures for appointment and removal of professor and associate professor positions; Decision No. 20/2012/QĐ-TTg dated April 27, 2012 of the Prime Minister amending and supplementing some articles of the "Regulation on Standards, Procedures for Appointment and Removal of Professor and Associate Professor Positions" issued together with Decision No. 174/2008/QĐ-TTg;

Considering the proposal of the Director of the Department of Personnel Organization,

The Minister of Education and Training issues this Circular amending and supplementing some articles of the Regulation on the organization and operation of the State Council for Academic Titles, Sectoral Councils for Academic Titles, Inter-sectoral Councils for Academic Titles, and Institutional Councils for Academic Titles issued together with Circular No. 25/2013/TT-BGDĐT dated July 15, 2013 of the Minister of Education and Training.

Article 1. Issuing this Circular amending and supplementing some articles of the Regulation on the organization and operation of the State Council for Academic Titles, Sectoral Councils for Academic Titles, Inter-sectoral Councils for Academic Titles, and Institutional Councils for Academic Titles issued together with Circular No. 25/2013/TT-BGDĐT dated July 15, 2013 of the Minister of Education and Training as follows:

1. Amend and supplement Clause 3 Article 4 as follows:

"3. Having sufficient health and time to perform the duties of the State Council for Academic Titles; the age of members of the State Council for Academic Titles at the time of appointment shall not exceed 70 years old. In special cases, the Minister of Education and Training shall submit for approval."

2. Amend and supplement Clause 4 of Article 11 as follows:

"4. Having sufficient health and time to perform the duties of the Sectoral Council for Academic Titles; the age of members of the Sectoral Council for Academic Titles at the time of appointment shall not exceed 67 years old for those holding the position of Associate Professor, and not exceed 70 years old for those holding the position of Professor."

3. Amend and supplement Clause 3 and add Clause 4 of Article 19 as follows:

"3. Having sufficient health and time to perform the duties of the Institutional Council for Academic Titles; the age of members of the Institutional Council for Academic Titles at the time of appointment shall not exceed 67 years old for those holding the position of Associate Professor, and not exceed 70 years old for those holding the position of Professor."

4. If a member of the Institutional Council for Academic Titles is disciplined with a warning or higher penalty, the Head of the Higher Education Institution shall propose the Chairman of the State Council for Academic Titles to issue a decision to remove them from office and appoint a replacement."

4. Amend and supplement Clause 5 of Article 20 as follows:

"5. The Chairman of the State Council for Academic Titles shall consider and decide specifically on the establishment of the Institutional Council for Academic Titles at higher education institutions training arts, sports, and other special cases."

5. Repeal Article 23.

Article 2. This Circular takes effect from April 14, 2014.

Article 3. The Chief of the Office, Directors of the Departments of Personnel Organization, the Bureau of Teachers and Educational Management Staff, the Department of Legal Affairs, Heads of units related to the Ministry of Education and Training, Heads of management agencies of higher education institutions, Chairmen of the State Council for Academic Titles, and Heads of higher education institutions are responsible for implementing this Circular./.
