Based on the Labor Code dated June 18, 2012;
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 45/2013/NĐ-CP dated May 10, 2013 of the Government detailing certain provisions of the Labor Code on working hours, rest periods, occupational safety, and labor hygiene.
At the proposal of the Director of the Department of Occupational Safety and Health,
The Minister of Labor, Invalids, and Social Affairs issues this Circular stipulating the List of Machinery, Equipment, and Materials with Strict Requirements for Occupational Safety.
Article 1. List of Machinery, Equipment, and Materials with Strict Requirements for Occupational Safety
1. Attached hereto is the List of Machinery, Equipment, and Materials with Strict Requirements for Occupational Safety (hereinafter referred to as the List).
2. Ministries authorized under Article 18 of Decree No. 45/2013/NĐ-CP dated May 10, 2013 of the Government detailing certain provisions of the Labor Code on working hours, rest periods, occupational safety, and labor hygiene, when proposing amendments or supplements to the List, shall prepare and submit a dossier to the Ministry of Labor, Invalids, and Social Affairs. The dossier includes:
a) A letter proposing amendments or supplements to the List, including the following main contents:
- Name of machinery, equipment, or materials proposed for inclusion in the List, including both scientific name and trade name (if applicable);
- Justification for amending or supplementing the List;
- Assessment of the capability of technical safety inspection organizations to inspect the proposed machinery, equipment, or materials;
- Method of selecting or appointing organizations to conduct inspections of the proposed machinery, equipment, or materials.
b) Draft inspection procedures or proposals for bases to conduct inspections (national technical standards or regulations that have been issued).
Article 2. Implementation
1. The Department of Occupational Safety and Health, Ministry of Labor, Invalids, and Social Affairs is responsible for implementing this Circular; compiling and reporting to the Ministry of Labor, Invalids, and Social Affairs the suggestions for amending or supplementing the List from the Ministries.
2. Departments of Labor, Invalids, and Social Affairs of provinces and centrally-administered cities are responsible for coordinating with relevant agencies to disseminate and guide the implementation of this Circular to enterprises, agencies, organizations, cooperatives, households, and individuals using machinery, equipment, or materials with strict requirements for occupational safety within their jurisdiction; compiling and annually reporting to the Ministry of Labor, Invalids, and Social Affairs on the implementation of this Circular along with the report on occupational safety and labor hygiene conditions within their jurisdiction.
Article 3. Effectiveness
1. This Circular takes effect from May 1, 2014.
2. Circular No. 32/2011/TT-BLDTBXH dated November 14, 2011 of the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of technical safety inspections of various types of machinery, equipment, and materials with strict requirements for occupational safety ceases to be effective from the date this Circular takes effect.
3. During the implementation process, if there are any difficulties, agencies, organizations, and individuals should promptly reflect them in writing to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution./.

Steam and hot water pipeline systems of Class I and II with an outer diameter of 51 mm or more, and pipeline systems of Class III and IV with an outer diameter of 76 mm or more according to Vietnam Standard TCVN 6158:1996 and TCVN 6159:1996.

Pressure vessels with a rated working pressure higher than 0.7 bar (excluding hydrostatic pressure) according to Vietnam Standard TCVN 8366:2010.

Tanks and containers used for storing or transporting liquefied gases or liquids with a working pressure higher than 0.7 bar, or solids in powder form without pressure but transported using gas at a pressure higher than 0.7 bar according to Vietnam Standard TCVN 8366:2010.
