Regulations on National Defense and Security Education in the People's Public Security Force

Based on the Law on National Defense Education and Security dated June 19, 2013;
Pursuant to Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and providing implementation measures for the Law on National Defense and Security Education;
Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Director of the Political General Department of the People's Police,
The Minister of Public Security issues this Circular to regulate national defense and security education work in the People's Public Security Force.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the tasks and authorities of the General Directorates, Military Commands, units under the Ministry, academies and schools of the People's Public Security Force, provincial public security services, centrally governed cities, provincial fire prevention and firefighting services, centrally governed cities (hereinafter referred to as public security units and localities) in national defense and security education work; officers performing national defense and security education tasks; training in national defense and security knowledge; information and reporting systems, funding guarantees, and other necessary conditions for national defense and security education work in the People's Public Security Force.
Article 2. Applicability
1. This Circular applies to public security units and localities and officers of the People's Public Security Force performing national defense and security education tasks; majors, lieutenants, and party members in the People's Public Security Force who are subjects of national defense and security knowledge training as prescribed by the Law on National Defense and Security Education and detailed regulations guiding its implementation.
2. This Circular does not apply to officers of the People's Public Security Force who are subjects of national defense and security knowledge training as specified in points a, b, and c of Clause 1, Article 2 of Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and providing measures to implement the Law on National Defense and Security Education.
Article 3. Objectives of National Defense and Security Education
National defense and security education in the People's Public Security Force aims to equip officers and party members with basic knowledge about national defense and security, enhance understanding, significance, and importance of national defense and security work, promote patriotism, traditions of founding and defending the country, pride and self-respect in the nation, organizational discipline awareness, sense of responsibility, and successfully fulfill the assigned tasks of safeguarding national security and maintaining social order and safety, contributing effectively to the cause of building and defending the socialist Fatherland of Vietnam.
Article 4. Principles of National Defense and Security Education
1. National defense and security education in the People's Public Security Force must comply with the Constitution, Party viewpoints and policies, state laws, and regulations of the Ministry of Public Security on national defense and security education work.
2. Closely integrate national defense and security education with political education, ideological education, self-awareness, discipline, legal dissemination and education, and the mission of building a revolutionary, regular, elite, and increasingly modern People's Public Security Force serving the people.
3. National defense and security education in the People's Public Security Force is the responsibility of all levels of Party committees, leadership at all levels of the People's Public Security Force, and officers and party members within the People's Public Security Force.
4. Ensure state secrets, practicality, effectiveness, and meet the actual requirements of work and combat of the People's Public Security Force.
Chapter II
TASKS AND AUTHORITIES OF PUBLIC SECURITY UNITS AND LOCALITIES IN NATIONAL DEFENSE AND SECURITY EDUCATION WORK
Article 5. The Political General Department of the People's Public Security
1. Is the leading agency, providing advisory assistance to the Minister of Public Security in coordinating with the Ministry of National Defense to manage state administration regarding national defense and security education within the People's Public Security; coordinating with the Standing Office of the Central Council for National Defense and Security, agencies and organizations inside and outside the Public Security sector to perform tasks related to national defense and security education in accordance with the law.
2. Directing the Standing Office of the Ministry of Public Security on national defense and security education, public security units and localities to coordinate with the Councils for National Defense and Security at all levels and agencies and organizations outside the Public Security sector to implement tasks related to national defense and security education in their respective areas.
3. Leading and guiding the organization to build, approve plans, enhance, disseminate, and train knowledge about national defense and security within the People's Public Security; issuing programs, materials, and related documents on national defense and security education according to its authority.
4. Leading and assisting the Party Committee of the Public Security Central Committee and the Minister of Public Security in organizing and staffing cadres to fulfill tasks related to national defense and security education within the People's Public Security; leading and coordinating with public security units and localities in proposing the Ministry to assign and manage officers from the Public Security sector to fulfill tasks related to national defense and security education according to the requirements and tasks of the Education and Training sector.
5. Coordinating and proposing regulations on standards for equipment serving research, study, teaching, and enhancing knowledge about security and order in the national defense and security education program generally and specifically within the People's Public Security.
6. Guiding, inspecting, and auditing; organizing mid-term and final reviews, rewarding; resolving complaints and grievances, handling violations related to national defense and security education within the People's Public Security according to its authority.
Article 6. Units under the Political General Department of the People's Public Security
1. The Training Bureau
a) Is the Standing Office of the Ministry of Public Security on national defense and security education; directly advising the Director of the Political General Department of the People's Public Security to implement the tasks stipulated in Article 5 of this Circular;
b) Coordinating with the Standing Office of the Central Council for National Defense and Security, agencies and organizations inside and outside the Public Security sector to perform tasks related to national defense and security education according to its authority; advising public security units and localities on national defense and security education;
c) Coordinating with agencies and organizations inside and outside the Public Security sector to propose participation in drafting documents of the Party, State, relevant ministries and sectors on national defense and security education; organizing the compilation of programs, textbooks, materials, and proposing the issuance of related documents on national defense and security education according to its authority;
d) Proposing and assigning members of the People's Public Security force to participate in the Central Council for National Defense and Security and the Councils for National Defense and Security of military regions, guiding public security localities to assign members to participate in the Councils for National Defense and Security at various levels; coordinating to propose assigning leaders, commanders, and cadres from the Ministry of Public Security to participate in training and enhancing knowledge on national defense and security according to the分级限制词汇,请忽略此提示。
d) Chair and guide the People's Public Security Political General Department in building plans and organizing training courses to enhance and instruct on national defense and security education for officers, party members, management officials, specialized staff, lecturers, teachers, and part-time teachers teaching national defense and security knowledge within the People's Public Security force according to their authority;
e) Annually, prepare and consolidate the budget estimate for national defense and security education activities within the People's Public Security force; propose funding allocation schemes to ensure regular educational work according to the approved plan by the competent authority;
Monitor, compile, inspect, audit, conduct mid-term reviews, and final evaluations; propose commendations, recommendations, and handling of violations concerning national defense and security education of local public security units according to their authority;
Carry out other tasks related to national defense and security education as prescribed by law.
2. The Political Staff Bureau of the People's Public Security shall take the lead and coordinate with the Training Bureau to provide advisory services and propose the implementation of national defense and security education activities within the People's Public Security Political General Department; participate in proposing and providing comments on annual content and plans regarding national defense and security education; propose the dispatch of leaders from the People's Public Security Political General Department to join the Central National Defense and Security Education Council, regional defense and security education councils, and send officers from the People's Public Security Political General Department as specified in Article 14 of this Circular to attend national defense and security knowledge enhancement courses according to the approved plan by the competent authority; prepare budgets, manage, and settle accounts for funds related to national defense and security education activities within the People's Public Security force under the functions and responsibilities of the People's Public Security Political General Department.
3. The Cadre and Personnel Organization Bureau shall take the lead and coordinate with the Training Bureau to propose the organization and staffing of specialized and part-time personnel at local public security units responsible for national defense and security education tasks; monitor and advise on the dispatch of public security officers who are required to attend national defense and security knowledge enhancement courses as stipulated in Point a, Clause 1, Article 2 of Government Decree No. 13/2014/NĐ-CP dated February 25, 2014 detailing and implementing the Law on National Defense and Security Education to attend such courses.
4. The Policy Bureau shall take the lead and coordinate with the Training Bureau, the Cadre and Personnel Organization Bureau, and relevant functional agencies to propose systems and policies for public security officers and cadres performing national defense and security education tasks.
5. The Political Work Bureau and historical research institutions, museums, newspapers, magazines, radio, and television stations within the People's Public Security force
a) Advise and assist the Ministry of Public Security to coordinate with the Central Propaganda Department, the Ministry of Information and Communications, and relevant agencies in guiding the development of plans and organizing propaganda and dissemination of knowledge about national defense and security within agencies, mass organizations, and among the people; participate in educating the people on national defense and security;
b) Take the lead and coordinate with functional agencies under the Ministry of Public Security to implement political education and ideological work, enhance responsibility awareness and discipline among public security officers regarding national defense and security education;
c) Organize campaigns and contests for literary and artistic works, compile special topics and articles to promote and mobilize the entire population to raise awareness and understanding of the requirements and tasks of protecting national security, maintaining social order and safety, increasing vigilance, and actively participating in combating crime and other violations of law; cultivate and educate young generations on national defense and security knowledge through various forms of cultural and artistic activities, radio, and television;
d) Promote and introduce to civil servants, employees, and the people historical summaries, materials, and artifacts from museum systems, traditional rooms, historical sites, memorials, monuments... within the public security force about the image and fine traditions of the public security force;
Article 7. Departments, Corps, and Units under the Ministry
1. General Responsibilities
a) Participate in providing comments on the development of programs, textbooks, and materials serving research, teaching, and learning about national defense and security knowledge according to specialized topics within the scope of work of the unit when requested;
b) Develop plans and organize training courses to enhance national defense and security knowledge for officers and party members within the unit according to their authority; dispatch officers and party members to attend training and enhancement courses on national defense and security according to the plan of the Ministry of Public Security and the call-up notice of the competent authority;
c) Dispatch part-time lecturers and reporters to give lectures and report on practical topics related to security and order for training and enhancement courses on national defense and security according to the requirements of the competent authority;
d) Provide data, materials, and information related to serving national defense and security education when requested; conduct mid-term and final reviews and implement reporting systems as prescribed;
đ) Compile and monitor lists of officers and party members within the unit subject to national defense and security knowledge enhancement as stipulated in Clause 14 of this Circular;
e) Propose the dispatch of detached officers to perform national defense and security education tasks according to the decision of the competent authority;
g) Assign 1 to 2 officers to assist leadership in advising on the implementation of national defense and security education tasks;
h) Perform other tasks related to national defense and security education as required by the competent authority;
2. In addition to the common tasks prescribed in Clause 1 of this Article, departments and units under the Ministry specified in this clause shall perform specific tasks as follows:
a) The Logistics and Technical Department Shall take the lead and coordinate with the Political Department of the Public Security Force to study and develop regulations on quotas and provision of equipment, tools, and technical means to serve research, teaching, learning, and enhancing knowledge about national defense and security for police academies, schools, training centers, and vocational training centers responsible for implementing national defense and security education tasks within the public security force;
b) The Office of the Ministry of Public Security Shall coordinate with the Political Department of the Public Security Force to participate in reviewing and providing materials, compiling textbooks, and materials for enhancing national defense and security knowledge for target groups;
c) The Legal System and Administrative Reform Department Shall coordinate with the Political Department of the Public Security Force to build, participate in building, and review legal normative documents on national defense and security education within the public security force; take the lead and coordinate in implementing propaganda, dissemination, and in-depth training on legal normative documents related to national defense and security education within the public security force;
d) The Department for Mobilizing the Entire People to Protect National Security Shall advise the Ministry of Public Security's leadership on directing and guiding local public security agencies in building movements for the entire people to protect national security; leverage the roles of departments, sectors, mass organizations, and social organizations in promoting and educating widely on knowledge about protecting national security and order to cadres, civil servants, and the people; participate in comprehensive national defense and security education according to the provisions of the law;
đ) The Finance Department Shall base on annual work plans and budget estimates serving national defense and security work of the Permanent Office of the Ministry of Public Security on national defense and security education, organize reviews, and compile budget estimates serving national defense and security tasks within the public security force for submission to the leadership of the Ministry for consideration and approval; ensure the budget serving national defense and security tasks within the public security force according to the State Budget Law and detailed regulations and guidance on its implementation.
Article 8. Police Academies and People's Public Security Schools
Shall perform the tasks prescribed in Clause 1 of Article 7 of this Circular and the specific tasks as follows:
1. Take the lead and participate in compiling and reviewing programs and materials for research, study, and teaching knowledge on security and public order in the national defense and security education program for teachers, lecturers, and other subjects assigned by the Director of the Political General Department of the People's Public Security.
2. Dispatch lecturers and teachers to teach specialized topics on security and public order for training courses on national defense and security organized by the National Defense and Security Education Councils at various levels and local public security units; support the teaching of national defense and security knowledge to universities, colleges, vocational schools, political schools, and other training institutions within their jurisdiction as stipulated by law and the Ministry of Public Security.
Article 9. Provincial-level Public Security Organs (Provincial-level Public Security), Provincial-level Fire Prevention and Fighting Forces (Provincial-level Fire Prevention and Fighting Forces)
1. Dispatch cadres to join the National Defense and Security Education Councils at various levels as prescribed; coordinate with non-Public Security agencies and organizations on the territory to implement national defense and security education tasks as prescribed by law.
2. Compile lists, organize training and upgrading, dispatch part-time teachers to compile materials and teach specialized topics on security and public order when requested by the National Defense and Security Education Councils at various levels and universities, colleges, vocational schools, political schools, and general secondary schools within their jurisdiction; propose the dispatch of Public Security officers on secondment to fulfill national defense and security education tasks when requested by competent authorities.
3. Develop plans and organize training courses on national defense and security knowledge for officers and party members within the unit according to their authority; dispatch cadres to attend training and upgrading on national defense and security knowledge upon notification from competent authorities.
4. Monitor, compile, inspect, conduct mid-term and final reviews, and make recommendations regarding national defense and security education work within the unit and subordinate units according to their authority; report on the results of national defense and security education work as prescribed.
5. Assign from one to three full-time officers (for provincial-level Public Security) or one part-time officer (for provincial-level Fire Prevention and Fighting Forces) to advise on implementing tasks related to national defense and security education work.
6. Fulfill other national defense and security education tasks as required by competent authorities.
Chapter III
OFFICERS PERFORMING NATIONAL DEFENSE AND SECURITY EDUCATION TASKS
Article 10. Full-Time Officers for National Defense and Security Education Work
1. Officers from the National Defense and Security Education Department under the Training Bureau of the Political General Department of the People's Public Security shall be responsible for advising on the implementation of tasks and powers as prescribed in Clause 1 of Article 6 of this Circular.
2. Officers from the Cadre and Personnel Department of provincial-level Public Security organs assigned to advise on the implementation of national defense and security education tasks as prescribed in Article 9 of this Circular.
Article 11. Officers concurrently performing national defense and security education work
1. Officers from units under general departments, Military Commands, units directly under the Ministry, and police academies and schools are assigned to provide advisory services for implementing national defense and security education tasks as stipulated in Articles 7 and 8 of this Circular.
2. Officers from provincial-level fire prevention and firefighting units are assigned to provide advisory services for implementing national defense and security education tasks as stipulated in Article 9 of this Circular.
Article 12. Lecturers, teachers, and concurrently appointed teachers teaching national defense and security knowledge
1. Lecturers and teachers from police academies and schools are assigned to teach specialized topics on security and public order for classes enhancing and training knowledge on national defense and security.
2. Concurrently appointed teachers are provincial-level police officers and provincial-level fire prevention and firefighting officers assigned to teach specialized topics on security and public order for classes enhancing and training knowledge on national defense and security.
Article 13. Police officers seconded to perform national defense and security education tasks
1. When required, the Ministry of Public Security will second police officers to state management agencies in education, national defense and security education centers, and educational institutions to participate in management and teaching specialized topics on security and public order.
2. The criteria, benefits, policies, and promotion of rank and pay grade for police officers seconded to perform national defense and security education tasks shall be implemented according to the regulations of the Ministry of Public Security regarding the secondment of police officers to work at Party and State agencies.
Chapter IV
ENHANCEMENT OF NATIONAL DEFENSE AND SECURITY KNOWLEDGE IN THE PUBLIC SECURITY FORCE
Article 14. Recipients of enhancement
1. Officers holding leadership positions at department and bureau levels and equivalent; officers with the rank of Senior Colonel (equivalent to category 2 as defined in point b, Clause 1, Article 2 of Decree No. 13/2014/ND-CP dated February 25, 2014 of the Government detailing and guiding the implementation of the Law on National Defense and Security Education).
2. Officers holding leadership positions at division and district levels and equivalent; officers with the rank of Colonel (equivalent to category 3 as defined in point c, Clause 1, Article 2 of Decree No. 13/2014/ND-CP dated February 25, 2014 of the Government detailing and guiding the implementation of the Law on National Defense and Security Education).
3. Officers not falling within the categories specified in Clauses 1 and 2 of this Article and party members in the Public Security Force (equivalent to category 4 as defined in points d, đ, e, Clause 1, Article 2 of Decree No. 13/2014/ND-CP dated February 25, 2014 of the Government detailing and guiding the implementation of the Law on National Defense and Security Education).
Article 15. Authority to convene and organize enhancement
1. The Political Bureau of the Public Security Force convenes and assigns the Permanent Office of the Ministry of Public Security on national defense and security education to host or coordinate with local public security forces to organize enhancement for officers specified in Clause 1 of Article 14 and officers from general departments, military commands, units directly under the Ministry, and police academies and schools as specified in Clause 2 of this Circular.
2. General departments, military commands, units directly under the Ministry, and police academies and schools convene and organize enhancement for officers and party members in their units as specified in Clause 3 of Article 14 of this Circular.
3. Provincial-level public security forces and provincial-level fire prevention and firefighting forces convene and organize enhancement for officers and party members in their units as specified in Clauses 2 and 3 of Article 14 of this Circular.
Article 16. Training bases
1. The training base for officers specified in Clause 1, Article 14 and officers under the general departments, Military Commands, units directly under the Ministry, academies, and police academies as stipulated in Clause 2, Article 14 of this Circular shall be one of the training centers, training bases, or other locations meeting the conditions of the general departments, Military Commands, and police academies, decided upon by the Political General Department of the Public Security Force.
2. The training base for officers and party members under the general departments, Military Commands, units directly under the Ministry, academies, and police academies as stipulated in Clause 3, Article 14 and officers and party members under provincial public security forces and fire prevention and firefighting police as stipulated in Clauses 2 and 3, Article 14 of this Circular shall be the Professional Training and Development Center or another location meeting the conditions of the units.
Article 17. Program and duration of national defense and security knowledge training
1. The program for national defense and security knowledge training for officers and party members within the Public Security Force shall be issued by the Director of the Political General Department of the Public Security Force and specifically define the program, topics, and content of training.
2. The duration of national defense and security knowledge training for officers within the Public Security Force is as follows:
a) Officers specified in Clause 1, Article 14 of this Circular is five days;
b) Officers specified in Clause 2, Article 14 of this Circular is four days;
c) Officers and party members specified in Clause 3, Article 14 of this Circular is three days.
Article 18. Construction and approval of plans for national defense and security knowledge training in the Public Security Force
1. The Standing Office of the Ministry of Public Security on National Defense and Security Education advises the Director of the Political General Department of the Public Security Force to construct and report to the leadership of the Ministry for approval of the overall program and plan regarding the targets for national defense and security knowledge training for officers and party members as stipulated in Article 14 of this Circular.
2. The Standing Office of the Ministry of Public Security on National Defense and Security Education constructs and reports to the Director of the Political General Department of the Public Security Force for approval of the specific program, plan, and targets for national defense and security knowledge training for officers specified in Clause 1, Article 14 and officers under the general departments, Military Commands, units directly under the Ministry, academies, and police academies as stipulated in Clause 2, Article 14 of this Circular.
3. Public Security units and localities construct and report to the Political General Department of the Public Security Force (through the Standing Office of the Ministry of Public Security on National Defense and Security Education) for approval of the plan and targets for national defense and security knowledge training for officers and party members according to the authority to convene as stipulated in Clauses 2 and 3, Article 15 of this Circular.
Article 19. Certificate of completion of national defense and security knowledge training
1. The certificate of completion of the national defense and security knowledge training program for officers and party members as stipulated in Article 14 of this Circular (equivalent to target groups 2, 3, 4 as stipulated in Points b, c, d, đ e, Clause 1, Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and providing implementation measures for the Law on National Defense and Security Education) shall be issued by the Ministry of Public Security according to the certificate model prescribed in Circular No. 40/2014/TT-BQP dated June 4, 2014 of the Ministry of National Defense prescribing the model of the certificate of completion of the national defense and security knowledge training program. The head of the unit responsible for convening and organizing the national defense and security knowledge training shall issue decisions to grant, reissue, retrieve, or revoke the certificate of completion of the national defense and security knowledge training program in the Public Security Force.
2. The Standing Office of the Ministry of Public Security on National Defense and Security Education uniformly manages, monitors, and provides blank certificates of completion of the national defense and security knowledge training program for officers and party members as stipulated in Article 14 of this Circular to Public Security units and localities according to the training targets and plans approved by the competent authority.
Chapter V
INFORMATION REPORTING REGIME; FINANCIAL RESOURCES AND CONDITIONS TO ENSURE NATIONAL DEFENSE AND SECURITY EDUCATION WORK
Article 20. Reporting System of the Permanent Office of the Ministry of Public Security on National Defense and Security Education
1. Every six months and annually, the Permanent Office of the Ministry of Public Security on national defense and security education shall report to the Permanent Office of the Central Council for National Defense and Security Education and the leadership of the Ministry of Public Security on the plan, situation, and results of national defense and security education work within the People's Public Security.
2. Submit interim and final reports, as well as specialized reports on national defense and security education work as required by competent authorities.
Article 21. Reporting System of Public Security Units and Localities
1. Every six months and annually, public security units and localities shall report to the Permanent Office of the Ministry of Public Security on national defense and security education regarding their unit’s or locality’s plans, situations, and results of national defense and security education work.
2. Report other contents related to national defense and security education when requested by competent authorities.
Article 22. System and Policies for Officers Implementing National Defense and Security Education Tasks
The system and policies for full-time officers, part-time officers implementing national defense and security education tasks; lecturers, teachers, part-time teachers teaching national defense and security knowledge; and police officers seconded to implement national defense and security education tasks shall be implemented according to current laws and detailed regulations and guidance documents issued by the Ministry of Public Security on the system and policies for officers engaged in national defense and security education work.
Article 23. Annual Budget Ensuring National Defense and Security Education Work in the People's Public Security
1. The list of expenditures for national defense and security education work includes:
a) Work on drafting legal documents on national defense and security education;
b) Compiling, editing, revising, reviewing, printing, and distributing programs, textbooks, and materials on national defense and security education;
c) Organizing training courses, specialized seminars, and national defense and security knowledge education; training management skills and pedagogical skills for national defense and security education;
d) Organizing interim and final reviews, inspections, and audits on national defense and security education work;
đ) Building infrastructure, purchasing equipment, means, and teaching aids to serve national defense and security education work;
e) Other expenditures as prescribed by law.
2. Operating funds
a) Expenditures for national defense and security education work in the People's Public Security have separate budget items. Based on the plan and budget estimate for national defense and security education work in the People's Public Security developed by the Political General Department of the People's Public Security and approved by the leadership of the Ministry of Public Security, the Permanent Office of the Ministry of Public Security on national defense and security education shall coordinate with the Financial Department to propose the allocation of funds to public security units and localities in accordance with regulations. Public security units and localities shall manage, use, and settle accounts in accordance with the State Budget Law and guiding documents.
b) In addition to the annual budget approved by the Ministry, public security units and localities may mobilize and utilize other legitimate sources of funding as prescribed by law to support national defense and security education work.
Chapter VI
IMPLEMENTING PROVISIONS
Article 24. Effective Date
This Circular takes effect from March 1, 2015. Decree No. 170/2008/QĐ-BCA (X11-X14) dated February 18, 2008, of the Minister of Public Security on the tasks of public security units and public security schools in national defense and security education work is abolished from the date this Circular takes effect.
Article 25. Responsibilities for Implementation
1. Directors of General Departments, Heads of Units under the Ministry, Provincial Public Security Chiefs, Chief of Fire Prevention and Fighting Police of provinces and centrally-administered cities, Directors of Academies, Principals of schools in the People's Public Security are responsible for implementing this Circular.
2. Director of the Political General Department of the People's Public Security is responsible for assisting the Ministry's leadership in organizing the implementation, monitoring, inspecting, and guiding the implementation of this Circular.
3. During the implementation process, if there are difficulties or obstacles, public security units and localities shall report to the Ministry (through the Political General Department of the People's Public Security) for timely guidance./.
