Article 1. Scope of regulation and subjects of persons in accordance with
1. This Circular stipulates the probation period for the profession titles of kindergarten teachers, primary school teachers, lower secondary school teachers, upper secondary school teachers in public schools (collectively referred to as teachers), college lecturers, university lecturers in public institutions (collectively referred to as lecturers).
2. This Circular applies to persons who have been recruited as teachers in preschool education facilities, general education facilities, regular education facilities, specialized schools; persons who have been recruited as lecturers in colleges (excluding vocational colleges), universities, academies, regional universities, national universities within the national education system (collectively referred to as educational facilities).
3. Private educational facilities shall implement this Circular based on the actual conditions of their units, applying the provisions herein.
Article 2. Probation period for profession titles of teachers and lecturers
1. To be appointed to the profession title of kindergarten teacher, the recruited person must complete a probation period of six months.
2. To be appointed to the profession title of primary school teacher, the recruited person must complete a probation period of six months.
3. To be appointed to the profession title of lower secondary school teacher, the recruited person must complete a probation period of nine months.
4. To be appointed to the profession title of upper secondary school teacher, the recruited person must complete a probation period of nine months.
5. To be appointed to the profession title of lecturer, the recruited person must complete a probation period of twelve months.
Article 3. Special cases regarding the probation period for profession titles of teachers and lecturersnationalconcerning the special period for probation according to the occupational title of teacher or lecturer
1. The maternity leave period according to social insurance regulations, sick leave periods of three days or more, summer vacation, Tet holiday, unpaid leave, detention periods, arrest periods, suspension from work periods according to the regulations of competent authorities of the recruited person shall not be counted towards the probation period. The continuation of the probation period shall be carried out immediately after the recruited person has completed the maternity leave period according to social insurance regulations; completed the sick leave period; ended the detention, arrest, or suspension from work period according to the regulations of the competent authority.
2. Persons recruited as teachers or lecturers who have taught in educational facilities suitable for the position applied for for at least twelve consecutive months are exempt from completing the probation period.
3. Recruits who are lecturers with a doctoral degree and have participated in teaching during their time as a graduate student may have their probation period shortened upon consideration by the head of the educational facility.
4. The heads of educational facilities shall decide the date to continue the probation period for cases where the required probation period has not been fully completed as specified in Clause 1 of this Article.
Article 4. Organization of Implementation
1. This Circular takes effect from May 6, 2016.
2. The Director of the Office, the Director of the Department of Teachers and Educational Management Staff, the Heads of relevant units under the Ministry of Education and Training, the Chairpersons of People's Committees of provinces/cities directly under the Central Government, Directors of Departments of Education and Training, and the heads of educational facilities are responsible for implementing this Circular.
