Guidelines for integrating disaster prevention and control content into planning and development plans for economic and social sectors.

Based on the Law on Disaster Prevention and Control No. 33/2013/QH13;

Based on Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the preparation, approval, and management of overall socio-economic development planning;

Based on Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP dated September 7, 2006 on the preparation, approval, and management of overall socio-economic development planning;

Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to the Government Decree No. 66/2014/NĐ-CP dated July 4, 2014 detailing and guiding the implementation of certain provisions of the Law on Natural Disaster Prevention and Control;

Pursuant to Decision No. 44/2014/QĐ-TTg dated August 15, 2014 of the Prime Minister detailing the levels of natural disaster risk;

The Minister of Planning and Investment issues this Circular to guide the integration of disaster prevention and control content into planning and development plans for economic and social sectors.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Circular guides the principles and contents of integrating disaster prevention and control content into sectoral development plans, national socio-economic development plans, and development plans of ministries, sectors, provinces, centrally governed cities (hereinafter referred to collectively as provincial level); district-level cities, districts, towns (collectively referred to as district level); and socio-economic development plans of communes, wards, towns (collectively referred to as commune level).

This Circular applies to agencies and organizations involved in the preparation, review, approval, supervision, and evaluation of the integration of disaster prevention and control content into sectoral development plans and socio-economic development plans.

Article 2. Interpretation of Terms

1. Vulnerable groups are individuals with characteristics and circumstances that make them more susceptible to adverse impacts from disasters compared to other groups within the community. Vulnerable groups include: children, elderly people, pregnant women or women nursing infants under 12 months old, persons with disabilities, persons suffering from serious illnesses, and the poor.

2. Sectoral development planning is the justification and selection of reasonable development and distribution schemes for sectors and fields over a long-term period across the country and within each province and centrally governed city.

3. Socio-economic development plan is a tool for state economic management according to objectives, expressed through development goals to be achieved within a specific timeframe for a nation or locality, along with measures and policies aimed at achieving these goals effectively and efficiently.

4. Integrating disaster prevention and control content into sectoral development and socio-economic development plans is a selective process of incorporating disaster impact assessments, prioritized risk reduction measures, and climate change adaptation solutions into the planning and development processes of sectoral development and socio-economic development plans.

Article 3. Principles of integrating disaster prevention and control content

1. Disaster prevention and control content must be integrated into sectoral development and socio-economic development plans.

2. Integration of disaster prevention and control content should be based on the results of risk assessment, types of disaster risks, risk zones corresponding to each type and level of disaster risk for sectors and/or localities.

3. Prioritize multi-purpose projects, combining engineering and non-engineering solutions, aiming towards sustainable development and vulnerable groups in the integration of disaster prevention and control content.

4. Financial resources for disaster prevention and control activities should be integrated and balanced during the drafting of planning outlines and tasks; during the budget preparation process for socio-economic development plans and investment development plans.

Chapter II

IMPLEMENTATION OF INTEGRATING DISASTER PREVENTION AND CONTROL CONTENT INTO PLANNING AND DEVELOPMENT PLANS FOR ECONOMIC AND SOCIAL SECTORS

Article 4. Implementation process for integration

1. Review and evaluate the implementation of disaster prevention and control content in previous planning and plans.

a) Review and study relevant legal documents, programs, and plans related to disaster prevention and control and climate change adaptation;

b) Review studies, reports, and forecasts on trends of disasters and climate change that may affect industry development, economy, and society;

c) Evaluate the situation of disasters and losses caused by disasters to the economy, society, and environment during the planning period. Based on annual and five-year summary reports on disaster prevention and control work, ministries, sectors, and localities forecast and identify types of disasters that frequently occur, including frequency, intensity, and loss data for each type of disaster: determine the most dangerous, frequent, and harmful disasters; conduct analysis and evaluation of the extent of damage caused by disasters in each field.

2. Analyze the status and ability to withstand disasters of vulnerable groups in the future regarding the economy, society, and environment:

a) Differences in vulnerability based on gender: between men and women; income level: between the rich and the poor; age: elderly and young people; education level, awareness, and population density;

b) Vulnerable groups, including: the poor, children, single elderly, female heads of households, persons with disabilities, ethnic minorities;

c) Groups residing in areas prone to disaster impacts such as islands, coastal areas, lowlands, flood-prone regions, areas often hit by flash floods, landslides along riverbanks, canals, or occupations vulnerable to disasters such as river and sea fishing, aquaculture in rivers, canals, ponds, beaches; inland waterway transport, tourist sites, households without stable occupations, frequently moving to find work.

3. Identify causes, including both objective and subjective reasons leading to losses in each field (economy, society, and environment):

a) The accuracy of weather and hydrological forecasting information; the timeliness and ability to receive forecasting and warning information at the grassroots level and among the public, especially vulnerable groups;

b) Proactive implementation of disaster prevention and control measures;

c) Compliance with relevant planning standards and technical regulations on safety for disaster prevention and control projects;

d) Readiness of communication equipment and rescue facilities;

e) Adherence to safety regulations in managing transportation means and participating in traffic during disasters;

f) Availability of safe shelters for boats and emergency points in critical disaster areas;

g) Rescue operations for people, ships, and structures directly affected by disasters;

h) Implementation of the "four-in-place" principle: On-site command; on-site forces; on-site equipment and supplies; and on-site logistics support;

i) Local government's capacity for inspection and supervision.

4. Determine disaster prevention and control solutions in priority order according to the types of frequently occurring disasters.

5. Monitor and evaluate the implementation of integration

a) Content of integration results assessment:

The degree of integration of disaster prevention and control content (including engineering and non-engineering measures) and climate change adaptation into economic and social development indicators set out in the plan;

Actual resources mobilized for investment in disaster prevention and control and climate change response;

Investment effectiveness of disaster prevention and control programs, projects, and initiatives under the management of the sector or locality;

Comparison of material losses caused by disasters and climate change with the gross regional domestic product (GRDP) or production value of the locality or sector before and after integration;

Impact of disasters and climate change on social issues such as human and property losses; housing problems for families affected by disasters; poverty levels; livelihoods of residents; disease outbreaks; healthcare services; impact on students' education; community contributions to restore damaged schools and clinics after integration;

Negative environmental impacts caused by disasters and climate change compared to before integration;

Community awareness about disaster prevention and control and climate change;

Number of plans, programs, and projects integrated and not integrated with disaster prevention and control and climate change content.

b) Timeframe for assessing integration results:

For planning: Conducted after every quarter of the planning period. A final assessment is conducted at the end of the planning period.

For plans: Conducted once a year (end-of-year summary), combined with the assessment of the previous year's plan implementation and preparation of the next year's plan. A final assessment is conducted at the end of the five-year plan period, combined with the assessment of the previous five years' plan implementation to prepare for the next five-year plan.

Article 5. Integration of disaster prevention and control content into industry development plans and socio-economic development plans.

1. For existing plans: Conduct reviews and supplement disaster prevention and control contents that were not previously mentioned or were mentioned but are not consistent with the disaster prevention and control plan and standards, or pose risks to the safety of dedicated disaster prevention and control facilities.

2. For newly developed plans, it is necessary to comply with the integration process of disaster prevention and control contents from the initial stages of developing the plan.

3. Integrate disaster prevention and control content into the work of assessing implementation situations, specific goals, tasks, and solutions of each plan.

4. The integration process shall be carried out as prescribed in Article 4 of this Circular.

Article 6. Integration of disaster prevention and control content into national socio-economic development plans and industry development plans.

1. Integrate the content of reviewing and evaluating disaster situations into the basic investigation stage, assessing advantages, difficulties, and challenges; determining socio-economic development needs for the planning period or additional needs of Ministries, sectors, and localities.

2. When establishing a system of socio-economic development indicators, it is necessary to calculate the impacts of disasters and climate change; proactive preventive measures, response, recovery, and reconstruction solutions.

3. When formulating groups of solutions for the national socio-economic development plan and sectoral development plans, select solutions that have been studied and proposed in strategies, programs, and projects related to disaster prevention, mitigation, and reduction to ensure the most appropriate solutions.

4. The integration process shall be carried out as prescribed in Article 4 of this Circular.

Article 7. Integration of disaster prevention and control content into provincial/municipal/district socio-economic development plans.

1. Collecting information and preparing for implementation:

a) Provincial, municipal, and district People's Committees issue directives on the development of socio-economic development plans incorporating disaster prevention and control content for relevant departments, organizations, and units within their jurisdiction;

b) Disseminate disaster prevention and control content to staff responsible for planning:

Basic knowledge about disasters in the area and suitable preventive and control measures;

Disaster prevention and control plans and other related plans;

Principles and content of integrating disaster prevention and control into socio-economic development plans.

2. The integration process shall be carried out as prescribed in Article 4 of this Circular.

Article 8. Sources of funds for implementing integrated disaster prevention and control content.

Ministries, sectors, and localities base their sources of funds assigned in medium-term and annual plans to implement the integration of disaster prevention and control content into development plans and socio-economic development plans, including:

1. State budget investment capital: Central government budget investment capital for central ministries and sectors; targeted supplementary capital from the central government budget for localities; investment capital in local government budgets.

2. Investment capital from government bonds and local government bonds.

3. Disaster Prevention and Control Fund.

4. Official Development Assistance (ODA) capital and preferential loans from foreign sponsors.

5. State investment development credit capital (capital provided by the Vietnam Development Bank and the Social Policy Bank).

6. Regular funding for planning, adjusting plans, and developing industry and socio-economic development plans.

7. Other lawful sources of capital as stipulated by law.

Ministries, sectors, and all levels of People's Committees are responsible for prioritizing investment capital in annual and medium-term plans to build disaster prevention and control facilities serving socio-economic development in their jurisdictions.

Chapter III

IMPLEMENTATION

Article 9. Responsibilities of Ministries and Levels

1. The Ministry of Planning and Investment:

a) Take the lead in inspecting and supervising the implementation of this Circular;

b) Aggregate the contents of disaster prevention and control incorporated into sectoral and local development plans to be included in the national economic and social development plan.

2. Ministries and agencies at the ministerial level shall be responsible for incorporating disaster prevention and control contents into the planning and development plans within their jurisdiction.

3. Provincial People's Committees and Municipal People's Committees under the Central Government:

a) Direct the Department of Planning and Investment to take the lead in aggregating and incorporating disaster prevention and control contents into provincial/municipal economic and social development plans; monitor, inspect, and evaluate the incorporation of disaster prevention and control contents into economic and social development plans at various levels in the locality;

b) Direct the Department of Planning and Investment to take the lead and coordinate with the Department of Agriculture and Rural Development and related agencies to review the contents of disaster prevention and control incorporated into sectoral and economic and social development planning;

c) Direct the Department of Planning and Investment and the Department of Finance to prioritize allocating funds in the annual budget to implement socio-economic development measures that incorporate disaster prevention and control contents.

Article 10. Effective Date

1. This Circular takes effect from July 20, 2016.

2. Ministries, agencies at the ministerial level, People's Committees at all levels, and related organizations shall be responsible for implementing this Circular. Any difficulties encountered during implementation should be promptly reported to the Ministry of Planning and Investment for research and appropriate amendments and supplements./.
