REGULATIONS ON THE AUCTION OF QUOTA DUTY IMPORTING SUGAR IN 2017

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
BASED ON Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Commerce regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
BASED ON Decree No. 17/2010/NĐ-CP dated March 4, 2010 of the Government on auctioning assets;
Pursuant to Decree No. 52/2009/NĐ-CP dated June 3, 2009 of the Government detailing and guiding the implementation of certain provisions of the Law on Management and Use of State Property;
At the proposal of the Director of the Department of Import-Export;
The Minister of Industry and Trade issues this Circular guiding the auction of quota duty for importing sugar of 2017.
Article 1. Scope of Regulation
This Circular stipulates the quantity of quota duty for importing sugar and the principles of auctioning quota duty for importing sugar in 2017.
Article 2. Applicability
1. Direct traders who use sugar as raw material for production and traders using raw sugar to produce refined sugar.
2. Individuals and organizations related to the importation of sugar under the quota duty in 2017.
Article 3. Quantity of quota duty for importing sugar to be auctioned in 2017
The quantity of sugar (HS Code 1701) to be imported under the quota duty in 2017 is 89,500 tons.
Article 4. Principles of Auction
1. The auction of quota duty for importing sugar in 2017 shall be conducted through the Pilot Auction Committee for Quota Duty Importing Sugar in 2017.
2. The principles, procedures, and formalities for selling assets at auction shall be carried out in accordance with the laws on auctioning, taking into account the nature of the assets being auctioned.
3. The Ministry of Industry and Trade establishes the Pilot Auction Committee for Quota Duty Importing Sugar in 2017. The Chairman of the Auction Committee promulgates the Auction Regulations for the Pilot Quota Duty Importing Sugar in 2017.
Article 5. Import Procedures
1. After receiving the Report on the Results of the Auction from the Auction Committee, the Ministry of Industry and Trade shall issue a notification granting the right to use the import duty quota for sugar to the successful bidders.
2. When handling import procedures, in addition to complying with current regulations, traders must present the notification document from the Ministry of Industry and Trade granting the right to use the quota duty for importing sugar to the Customs Branch at the border gate.
Article 6. Effectiveness
This Circular takes effect from May 15, 2017 to December 31, 2017./.
