Circular No. 05/2018/TT-BLDTBXH guiding the adjustment of pensions, social insurance benefits, and monthly allowances for subjects specified in Clauses 1, 2, 3, and Clause 8 of Article 1 of Decree No. 88/2018/NĐ-CP dated June 15, 2018 issued by the Government.

CIRCULAR

GUIDING THE ADJUSTMENT OF PENSION AND SOCIAL INSURANCE BENEFITS MONTHLY ALLOWANCES FOR OBJECTS PROVIDED IN CLAUSES 1, 2, 3 AND CLAUSE 8 ARTICLE 1 DECREE NO. 88/2018/NĐ-CP DATED JUNE 15, 2018 OF THE GOVERNMENT

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;and Society;

Pursuant to Decree No. 88/2018/NĐ-CP dated June 15, 2018 of the Government adjusting pension, social insurance benefits and monthly allowances (hereinafter referred to as Decree No. 88/2018/NĐ-CP);

Considering the proposal of the Director of the Social Insurance Department;

The Minister of Labor - War Invalids and Social Affairs issues this Circular guiding the adjustment of pension, social insurance benefits and monthly allowances for objects provided in clauses 1, 2, 3 and clause 8 Article 1 Decree No. 88/2018/NĐ-CP dated June 15, 2018 of the Government.ARTICLE 1. APPLICABLE OBJECTS

Article 1. Subject1. Cadres, civil servants, workers, employees (including those with voluntary social insurance participation time, and persons retiring from the Nong Dan Nghe An Social Insurance Fund according to Decision No. 41/2009/QĐ-TTg dated March 16, 2009 of the Prime Minister); military personnel, public security officers and cryptographers receiving monthly pensions before July 1, 2018.

1. Officials, civil servants, workers, employees (including persons with voluntary social insurance contribution periods, retirees from the farmer social insurance fund of Nghe An Province under Decision No. 41/2009/QĐ-TTg dated March 16, 2009 of the Government Prime Minister); military personnel, public security officers and cryptographers receiving monthly pension before July 1, 2018.

2. Cadres of villages, towns, and townships as provided in Decree No. 92/2009/NĐ-CP dated October 22, 2009, Decree No. 121/2003/NĐ-CP dated October 21, 2003, and Decree No. 09/1998/NĐ-CP dated January 23, 1998 of the Government receiving monthly pensions or allowances before July 1, 2018.

3. Persons currently receiving monthly disability benefits under the law; persons currently receiving monthly allowances under Decision No. 91/2000/QĐ-TTg dated August 4, 2000 and Decision No. 613/QĐ-TTg dated May 6, 2010 of the Government Prime Minister; rubber workers receiving monthly allowances before July 1, 2018.

3. Persons currently receiving monthly disability benefits as provided by law; persons currently receiving monthly allowances according to Decision No. 91/2000/QĐ-TTg dated August 4, 2000 and Decision No. 613/QĐ-TTg dated May 6, 2010 of the Prime Minister; rubber workers receiving monthly allowances before July 1, 2018.

Article 2. Adjustment of pension and social insurance benefits and monthly allowances

As of July 1, 2018, the amount of pensions, social insurance benefits, and monthly allowances for individuals specified in Article 1 of this Circular shall be increased by 6.92% compared to the amounts of pensions, social insurance benefits, and monthly allowances in June 2018. Specifically:

Article 3. Implementation Organization

1. Provincial People's Committees directly under the Central Government shall be responsible for directing the Department of Labor - Invalids and Social Affairs and relevant agencies to disseminate, publicize, inspect, and urge the implementation of the provisions in this Circular.

2. The Vietnam Social Security is responsible for implementing the adjustment of pensions, social insurance benefits, and monthly allowances as stipulated in Decree No. 88/2018/NĐ-CP and guided by this Circular; to prepare a report according to the model attached to this Circular and submit it to the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance before January 15, 2019.

Article 4. Effective Date

This Circular takes effect from August 15, 2018. The provisions in this Circular shall be implemented as of July 1, 2018.

Any difficulties encountered during implementation should be reported to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
