Based on the Vietnam Maritime Code dated 25 the 11 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;15;

The Minister of Transport issues this Circular to regulate the monitoring and acceptance criteria for coastal information public services.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. Scope of regulation: This Circular stipulates the monitoring and acceptance criteria for coastal information public services.
2. Applicability: This Circular applies to organizations and individuals involved in the supervision and acceptance of coastal information public services.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Coastal information system is a maritime telecommunication network infrastructure invested in and managed by the State, operated by Vietnam Maritime Electronic Information Joint Stock Company.
2. Coastal information public service is a service provided by the coastal information system, including:
a) INMARSAT distress watch service: a service that receives distress alerts from vessels in distress through the INMARSAT system, then processes and forwards information to assist search and rescue operations, while supporting communication between shore units and distressed vessels and other vessels participating in search and rescue operations.
b) COSPAS-SARSAT distress watch service: a service that receives distress alerts from vessels in distress through the COSPAS-SARSAT system, then processes and forwards information to assist search and rescue operations, while supporting communication between shore units and distressed vessels and other vessels participating in search and rescue operations.
c) DSC distress watch service: a service that receives distress alerts from vessels in distress through the Digital Selective Calling system, then processes and forwards information to assist search and rescue operations, while supporting communication between shore units and distressed vessels and other vessels participating in search and rescue operations.
d) RTP distress watch service: a service that receives distress calls from vessels in distress through VHF channel 16, then processes and forwards information to assist search and rescue operations, while supporting communication between shore units and distressed vessels and other vessels participating in search and rescue operations.
e) RTP MSI broadcast service: a service that broadcasts maritime safety information through VHF channel 16.
f) NAVTEX MSI broadcast service: a service that broadcasts maritime safety information through narrowband direct printing on frequencies 518kHz, 490kHz, and 4209.5kHz.
g) EGC MSI broadcast service: a service that broadcasts Enhanced Group Call maritime safety information through the INMARSAT-C system.
h) LRIT information service: a service providing LRIT information of vessels flying the Vietnamese flag and foreign-flagged vessels according to the SOLAS Convention.
i) Maritime industry information connection service: a service operating an internal network (referred to as maritime intranet) to connect and share specialized maritime information provided by the Ha Noi Maritime Information Processing Center.
3. Area A1: is the sea area within the coverage range of at least one VHF coastal radio station where vessels can continuously send distress alerts by calling a specific number.This area has a radius of about 30 nautical miles from the coastal radio station.).
4. Area A2: is the sea area outside Area A1 and within the coverage range of at least one MF coastal radio station where vessels can continuously send distress alerts by calling a specific number.This area has a radius of about 250 nautical miles from the coastal radio station.).
5. Area A3: is the sea area outside Areas A1 and A2 and within the coverage range of the INMARSAT geostationary satellite where vessels can continuously send distress alerts.This area extends from latitude 700 North to latitude 700 Male).
6. Area A4: is the sea area outside Areas A1, A2, and A3, essentially the polar regions from latitude 700 North to the North Pole and from latitude 700 South to the South Pole but does not include any other sea areas.
7. LRIT information: is information about identification code, position, and time of position determination of vessels transmitted from LRIT equipment.
8. Vietnam's LRIT Identification and Long Range Tracking Information Zone (hereinafter referred to as Vietnam's LRIT Information Zone): is the information zone organized and announced by the Ministry of Transport in accordance with Vietnamese laws and relevant international conventions to which Vietnam is a member, including: Inland Waterway LRIT Zone, Territorial Sea LRIT Zone, 1000-nautical-mile Zone, and Selected LRIT Zone.
9. Shore unit: refers to units related to the reception and processing of distress, urgent, safety, and security information, typically search and rescue coordination agencies, coastal radio stations, and ship owners.

Chapter II
REGULATIONS ON CRITERIA FOR SUPERVISION AND ACCEPTANCE OF COASTAL INFORMATION SERVICES
OF PUBLIC INTEREST
Article 3. Requirements for Providing Coastal Information Public Services
The provision of coastal information public services shall be carried out in accordance with the basic requirements of technical standards, specifically as follows:
1. For INMARSAT distress monitoring service
a) The provision of INMARSAT emergency monitoring service shall comply with the following requirements: Service area; Monitoring time; Language of monitoring; Service availability; Success rate of emergency alerts processed; Time to relay search and rescue information to distressed vessels; Monitoring method; Communication methods between distressed vessels and shore units.
b) Data on INMARSAT emergency alerts (data on emergency alerts and the process of handling these alerts) collected by the Haiphong INMARSAT Ground Station must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Data storage on computers and paper record storage.
Storage period: At least one year.
2. For the COSPAS-SARSAT emergency monitoring service:
a) The provision of COSPAS-SARSAT emergency monitoring service shall comply with the following requirements: Service area; Monitoring time; Service availability; Success rate of emergency alerts processed; Time to contact distressed vessels; Data transmission channel to MCC/SPOCs in the system; Communication methods with distressed vessels; Communication methods with shore units.
b) Data on COSPAS-SARSAT emergency alerts (data on emergency alerts and the process of handling these alerts) collected by the Vietnam National Maritime Search and Rescue Centre's Ground Station for COSPAS-SARSAT (LUT/VNMCC) must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Data storage on computers and paper record storage.
Storage period: At least one year.
3. For the DSC emergency monitoring service:
a) The provision of DSC emergency monitoring service shall comply with the following requirements: Service area; Monitoring time; Language of monitoring; Service availability; Success rate of emergency alerts processed; Time to relay search and rescue information to distressed vessels; Follow-up communication methods; Communication methods with shore units; Communication methods between distressed vessels and shore units.
b) Data on DSC emergency alerts (data on emergency alerts and the process of handling these alerts) collected by Vietnamese coast radio stations must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Data storage on computers and paper record storage.
Storage period: At least one year.
4. For the RTP emergency monitoring service:
a) The provision of RTP emergency monitoring service shall comply with the following requirements: Service area; Monitoring time; Language of monitoring; Service availability; Success rate of emergency alerts processed; Time to relay search and rescue information to distressed vessels; Communication methods with shore units.
b) Data on RTP emergency alerts (data on emergency alerts and the process of handling these alerts) collected by Vietnamese coast radio stations must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Recording emergency alert data (audio recording) on computers and paper record storage.
Storage period: Computer-stored data must be retained for at least one quarter; paper records must be retained for at least one year.
5. For the MSI RTP broadcasting service:
a) The provision of MSI RTP broadcasting service shall comply with the following requirements: Service area; Language; Service availability; Success rate of broadcasts; Source information processing time.
b) Data on source messages, processed source messages, and received messages (from VHF receivers) of the MSI RTP broadcasting service provided by Vietnamese coast radio stations must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Storing source message data and processed source message data in paper records or on computers; storing received message data on computers.
Storage period: Computer-stored data must be retained for at least one quarter; paper records must be retained for at least one year.
6. For the MSI NAVTEX broadcasting service:
a) The provision of MSI NAVTEX broadcasting service shall comply with the following requirements: Service area; Language; Content of MSI NAVTEX messages; Service availability; Success rate of broadcasts; Source information processing time.
b) Data on source messages, processed source messages, and received messages (from NAVTEX receivers) of the MSI NAVTEX broadcasting service provided by Vietnamese coast radio stations must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Storing source message data and processed source message data in paper records or on computers; storing received message data on computers.
Storage period: At least one year.
7. For the MSI EGC broadcasting service:
a) The provision of MSI EGC broadcasting service shall comply with the following requirements: Service area; Language; Content of MSI EGC messages; Service availability; Success rate of broadcasts; Source information processing time.
b) Data on source messages, processed source messages, and received messages (from INMARSAT C terminals) of the MSI EGC broadcasting service provided by the Haiphong INMARSAT Ground Station must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Storing source message data and processed source message data in paper records or on computers; storing received message data on computers.
Storage period: At least one year.
8. For the LRIT information service:
a) The provision of LRIT information service shall comply with the following requirements: Service area; Monitoring time; Availability; Success rate of processed LRIT messages.
b) LRIT information data (LRIT message containing LRIT information, LRIT request messages, and other information) processed by the LRIT Information Station must be stored for supervision and acceptance of coastal information public services. Storage requirements include:
Storage method: Data storage on computers and paper record storage.
Storage period: At least one year.
9. For the maritime industry information connection service:
a) The provision of maritime information connection services according to requirements for: Operation time; Service availability; Successful incident resolution rate.
b) Operational data and network Intranet incident handling data during the provision of maritime information connection services must be stored for monitoring and acceptance of coastal public service information. Storage shall comply with the following requirements:
Storage method: Data storage on computers and paper record storage.
Storage period: At least one year.
Article 4. Provisions on criteria for monitoring and accepting coastal public service information
1. Criteria for monitoring and accepting quantity and volume of coastal public service information
a) Criteria for monitoring and accepting quantity and volume of INMARSAT, COSPAS-SARSAT, DSC, RTP distress watch services, including:
Watchkeeping time: is the time when the coast radio station performs watchkeeping to be ready to receive distress alerts from vessels in distress;
Number of received distress alerts: is the total number of distress alerts received by the coast radio stations.
b) Criteria for monitoring and accepting quantity and volume of MSI RTP, NAVTEX, EGC broadcast services, including:
Number of MSI broadcasts: is the total number of MSI broadcasts sent out by the coast radio stations.
c) Criteria for monitoring and accepting quantity and volume of LRIT information services, including:
Watchkeeping time: is the time when the LRIT information station performs watchkeeping to be ready to receive and provide LRIT information;
Number of LRIT messages containing LRIT information: is the number of LRIT messages received by the LRIT information station from ships or foreign data centers;
Number of LRIT messages requesting LRIT information: is the number of LRIT messages received by the LRIT information station from end-users or foreign data centers;
Number of LRIT information access accounts: is the number of accounts provided to state management agencies to access LRIT information;
Number of integrated vessels: is the number of Vietnamese-flagged vessels integrated into the LRIT system.
d) Criteria for monitoring and accepting quantity and volume of maritime information connection services, including:
Operation time: is the time when the Ha Noi Maritime Information Processing Center operates the maritime Intranet network to be ready to provide specialized maritime information connection services;
Number of application software: is the number of application software operated and utilized on the maritime Intranet network to connect and share specialized maritime information.
2. Criteria for monitoring and accepting quality of coastal public service information
a) Criteria for monitoring and accepting quality of INMARSAT distress watch service as stipulated in Appendix I attached hereto;
b) Criteria for monitoring and accepting quality of COSPAS-SARSAT distress watch service as stipulated in Appendix II attached hereto;
c) Criteria for monitoring and accepting quality of DSC distress watch service as stipulated in Appendix III attached hereto;
d) Criteria for monitoring and accepting quality of RTP distress watch service as stipulated in Appendix IV attached hereto;
đ) Criteria for monitoring and accepting quality of MSI RTP broadcast service as stipulated in Appendix V attached hereto;
e) Criteria for monitoring and accepting quality of NAVTEX MSI broadcast service as stipulated in Appendix VI attached hereto;
g) Criteria for monitoring and accepting quality of EGC MSI broadcast service as stipulated in Appendix VII attached hereto;
h) Criteria for monitoring and accepting quality of LRIT information service as stipulated in Appendix VIII attached hereto;
i) Criteria for monitoring and accepting quality of maritime information connection service as stipulated in Appendix IX attached hereto.
Chapter III
IMPLEMENTATION
Article 5. Responsibilities of agencies and organizations related to the supervision and acceptance of coastal information public services
1. The Vietnam Maritime Administration shall be responsible for developing plans and organizing the implementation of supervision and acceptance of coastal information public services according to the criteria stipulated in this Circular and relevant laws.
2. The Vietnam Maritime Electronic Information Joint Stock Company shall be responsible for coordinating with the Vietnam Maritime Administration to implement the provisions of this Circular.
Article 6. This Circular takes effect from March 15, 2019.
Article 7. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Maritime Administration, the General Director of the Vietnam Maritime Electronic Information Joint Stock Company, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
