Guidelines on positions for civil servants in specialized technical fields of natural resources and environment natural resources and environment

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;
At the proposal of the Director of the Personnel Department and the Director of the Legal Department;
The Minister of Natural Resources and Environment issues this Circular to provide guidelines on positions for civil servants in specialized technical fields of natural resources and environment.
Article 1. Scope of Regulation
This Circular provides guidelines on positions for civil servants in specialized technical fields of natural resources and environment from central to local levels.
Article 2. Applicability
This Circular applies to administrative agencies and organizations under the natural resources and environment sector from central to local levels, including:
1. Administrative agencies and organizations under Ministries and ministerial-level agencies assisting the Ministers and Heads of ministerial-level agencies in state management of the natural resources and environment sector.
2. Specialized agencies performing advisory functions to assist provincial People's Committees in state management of the natural resources and environment sector.
3. Specialized agencies performing advisory functions to assist district People's Committees in state management of the natural resources and environment sector.
Article 3. Principles for determining job positions
Positions for civil servants in specialized technical fields of natural resources and environment are determined according to the principles stipulated in Article 3 of Decree No. 62/2020/ND-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.
Each position must have a specific name and be linked to a civil servant rank.
Article 4. Basis for determining job positions
Positions for civil servants in specialized technical fields of natural resources and environment are determined based on the criteria specified in Clause 1, Article 4 of Decree No. 62/2020/ND-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.
Article 5. List of positions
1. The list of positions for civil servants in specialized technical fields of natural resources and environment in administrative agencies and organizations under Ministries and ministerial-level agencies assisting the Ministers and Heads of ministerial-level agencies in state management of the natural resources and environment sector includes 33 positions specified in Appendix I attached hereto.
2. The list of positions for civil servants in specialized technical fields of natural resources and environment in specialized agencies performing advisory functions to assist provincial People's Committees in state management of the natural resources and environment sector includes 20 positions specified in Appendix II attached hereto.
3. The list of positions for civil servants in specialized technical fields of natural resources and environment in specialized agencies performing advisory functions to assist district People's Committees in state management of the natural resources and environment sector includes 8 positions specified in Appendix III attached hereto.
Article 6. Job Description
1. The job description for civil servants in specialized technical fields of natural resources and environment in administrative agencies and organizations specified in Appendix IV attached hereto.
2. The level framework of each group of competencies in the job descriptions shall be implemented in accordance with Circular No. 12/2022/TT-BNV dated December 30, 2022 of the Minister of Home Affairs guiding positions for leading and managing civil servants; common professional specialties; support and service positions in administrative agencies and organizations; and common professional specialties; support and service positions in public service units.
Article 7. Transitional Provisions
Civil servants currently holding a higher rank than the required rank for the positions specified in this Circular shall retain their current rank until new regulations on salary system are issued.
Article 8. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from September 18, 2023.
2. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, municipal People's Committees directly under the Central Government, and related organizations and individuals are responsible for implementing this Circular.
3. During implementation, if there are any difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Natural Resources and Environment for consideration and resolution./.
